HomeMy WebLinkAboutLand Use Change PermitLAND USE CHANGE PERMIT for A parcel of land situated in Section 13, Township 7 South, Range 88 West of the Sixth Principle Meridian, County of Garfield, State of Colorado; owned by the Joseph Kirkman and Jan Dirksen Williams Trust, located at #4 Redwing Lane, Carbondale, CO 81623 and more particularly described as Lot 4, Hawk Ridge Subdivision, according to the plat thereof recorded July 25, 1983 as Reception No. 344085 with the Garfield County Clerk and Recorder (Assessor's Parcel No. 2393-134-01-004) In accordance with and pursuant to provisions of the Garfield County Land Use and Development Code, as amended, and the Director's Decision Letter dated May 11, 2016 the Director of the Community Development Department hereby authorizes the following activity: An Accessoty Dwelling Unit as shown on the site plan attached as Exhibit ''A" (GAPA-03-16-8435) This Administrative Land Use Change Permit is issued subject to the conditions set forth in Exhibit "B" and shall be valid only during compliance with such conditions and other applicable provisions of the Garfield County Land Use and Development Code, as amended, Building Code, and other regulations of the Board of County Commissioners of Garfield County, Colorado. Exhibit B (Conditions of Approval) 1 . AU representation of the Applicant contained in the application shall be considered conditions of approval unless specifically modified by the Director Decision. 2. The Applicant shall comply with Standards for ADU's contained in Section 7-701 of the Land Use and Development Code. 3. The Applicant shall properly permit with the County and install a new onsite waste water treatment system to serve the ADU. Based on excavation inspections and additional soil assessments, an engineered onsite waste water treatment system may be required. 4. The ADU shall be required to meet all Garfield County Building Code Requirements. 5. The Applicant shall comply with the lighting standards contained in Section 7-304. 6. The Applicant shall utilize bear proof trash containers or store all trash within a secure portion of the structure such as a garage. Any fencing on the site shall be wildlife compatible pursuant to CPW guidelines. 7. The proposed ADU sha11 maintain the setbacks from the C&M ditch at the rear of the lot as shown on the site plan . The Applicant shall maintain the existing surface drainage improvements between the primary residence and the ADU along the general alignment of the ditch lateral, as shown on the final plat, unless an alternate engineered drainage plan is implemented. 8. The ADU shall utilize noncombustible roof materials or other materials as recommended by the local fire agency. 9. The Applicant shall comply with the recommendations contained in the HP Geotech soils and foundation study, dated February 12i 2016, including foundation drainage. · 10. The Applicant shall comply with the Garfield County Noxious Weed Management Plan. 11. In accordance with the referral Jetter from the Colorado Division of Water Resources, dated 5/11/16, it is highly recommended that the Applicant work with the Hawk Ridge Homeowners Association to update the Keller Well Permit No. 38074 -F to reflect the uses and approvals associated with the augmentation plan amendment decreed in Water Court Case No. 90CW102.
