Dear Mr. George:
This is to acknowledge receipt of your letter and proposed operating plan
for the above referenced District. The purpose of the operating plan is to
obtain approval of a substitute water supply plan whereby contract allottees
within the Oistrict can divert frour existing or proposed points of diversions
including wells when these water rights would normally be called out.
The area where the Districtts water rights can be utilized for augmenta-
tion purposes has been identified as Area A on the map prepared and submitted
by the David E. Fleming Compan)r.
You have indicated that diversions will be replaced and not depletions
under this substitute water supply plan. This procedure is fine and will
facilitate administration of the plan provided the annual distribution of
diversions is made available to our Division Engineer, Mr. Lee Enewold.
Based upon the above and in accordance with CRS 1975, 57-80-120, I
approve the District's substitute water supply plan subject to the following
conditions:
1. The contract allottee will submit a well permit application and fee
for a well located in Area 'rA" of the District, an approved allotment
contract, and a map depicting the location of the well within the
District.
2. The District will assure that the Districtts map entitled I'Areas
Requiring Exchange or Augmentation Water Suppliesrt is maintained in
an up-to-date condition.
5. The District will submit, by April 15 of each year, a report identi-
fying each allottee by name and address, quantity of water- allocated,
the point of diversion, a monthly diversion schedule for the year in

rate of flow, ard sumation of monthly diversion rates for all allot-
tees. fuiy restrictions on use by each allottee including irrigated
acreage limitations will also be indicated.
4. The District shall also identify the person who will be responsible
for coordinating the release of vater from Ruedi Reservoir with my
Division Engineer, Mr. Lee Enewold. This person will also be respon-
sible for providing our Water Division 5 staff with up-to-date infor-
mation concerning any changes in the Districtrs operating plan such
as the addition of new allottees to the plan.
This plan will become effective upon receipt of the arurual report for
1983 and may be reviewed by submitting the annual report for 1984 prior toApril 15. 1984. If you have any qrrestions, please feel free to contact se.

Dear Mark,
I would like to recormend a minimum storage tank of 10,000 gal ,
for water, for the houses in this subdivision.
I would also reconrnend that after six lots have been sold or a
period of three years,that an adequate water system with fire
hydrants be installed.

Dear Mr. Bean:
We have received the above referenced proposal for 12 residential lots to
be seived by individual wells. The developer has obtained a contract with the
West Divide Water Conservancy District for augmentation of these wel1s. The
iontract is developed on the basis of an annual payment for delivery of the
augmentation water.
The West Divide Water Conservancy District has submitted a proposed sub-
stitute water supply plan to this office. We are currently reviewing_this
p1an. The Distrilt-aiso previously submitted- a map to this office. The pro-
posed subdivision is in area rrNr where no problem exists with intervening
water users not being able to access water carried in the Colorado River. ltle

Provisions should be made to turn the contract over to the homeowners
either as an association or individually. If the contract becomes
the responsibility of an association, they should have the power to
enforce individual compliance.
5. Lot purchasers should be made aware that use of the wells is subject
to payment of annual fees and other terms and conditions of the water
allbtment contracts. We recommend a covenant to this effect.

Dear Sir:
The South Side Soil Conservation District Board has reviewed
the J-Mar Estates Subdivision. Although the soil surveys indicate
some of the soils in this proposed subdivision have a high riskfactor for septic tanks, we note they are being planned. The
county sanitarian should make sure that the soils in the specificlocation are suitable for this type of system.
The steep hil1s on the south side of the property are a sourceof high water runoff potential. we note the problem was addressedin the report from shamrock surveying Service, but it is essentialthat the engineering plans for this proj ect protect the residences.

RE: J-MAR ESTATES PRELIMINARY PLAN
We have reviewed the plans and technical reports for this development and findthat geologic conditions wil I create some problems for residential development
whi ch wi I I requ'ire m'iti gati on measures. 0ur concerns are as fol I ows :
1) The geotechnical report indicates that the so'ils are very clayey andsensitive to moisture changes. Foundations must be engineered for swe11 ingsoil conditions as discussed in the soils report, or damage to structures and
improvements will occur. The soils report should be made available to each lot
owner so that foundations are properly built and residences are properly
landscaped in relation to the moisture sensitive soil s.
Z) The steep slopes along the southern property line are potential'ly unstable,
and an old landslide ex'ists along the slopes in parcels 5, 6, 7,8 and 9. Ifthese slopes are disturbed in any manner, slope instabif ity could become asignificant problem on these lots. We recommend that all improvements on theselots be restnicted inside a 150-ft setback zone along the southern lot line.
3) Safe long-term septic leach field operation may be a problem for this
development. Extremely c'layey soils were indicated jn both the SCS and Chen
and Associates reports, and this w'ill present problems for the use of
conventional leach fields. The thickness of the clayey soils over alluvial
gravels varies across the site, and groundwater po1'lution could occur if
improperly treated sewage effluent is allowed to reach the gravels. The costsof the specially engineered septic systems whjch will probably be requ'ired'inthjs area may make connection to central utilities feasible. The SCS report
states that condit'ions are severe for on-lot septic systems, and we recommendthat the deve'loper demonstrate otherwise prior to final approval of this
