Area, Colorado (Blue Hill Quadrangle). lnterpretation
tables are attached.
lmpact: The impact to any drainages and to the site topography
should be very minimal. The site is gently sloping and is
approximately 2000 feet from the Crystal River.
Radiation Hazards: No known radiation hazard potential within the site.
Highway Access: The subdivision will be serviced by two - two lane roads
with a T'turn-arounds that access onto Garfield County
Road I I I (also known as Prince Creek Road). All six lots
will have access to one of the two feeder roads within the
subdivision.

Revlew of Property for On-sltg Wastewater Systems
As requested, Nelson Hnvironmenhl and Wastewater Solutions, Ltd., has performed a
preliminary soils study to determinE the suihbility of each of the proposed residential lots
for an on-site wastewator disposal system,
Gar{ield County is requiring that the means of wastewater disposal conform to
regulations, and if individuat sewage systems ar€ proposed, the soils on the property
ahould maet the crltarla eshblished in the Garficld County Regulations on lndividual
Sewsgc Dieporal Systeme and the Colorado Department of Health Quidelinee for
lndtuilual Sewage
-Disposal Systeme (Revlaed 1988) as a sultable soll. The
establlshed crlterla lnclude an acceptable percolation rate of between five and sixty
minutes per lnch, slopes ecross the bullding envelope of less than 30%, and an absence
of ground water or bedrock formations within eight feet of the sufface of the ground.
The waste\,vater from each of the four new residences proposed can be dispoeed of by
msans of an individuat sewage disposal system. Each lot is to be approxlmately 2 acres
ln size, Thero is sufiicient area on each lot to meet all rnlnlmum setback and locatlon
requirements for the placernent of the individual sewage dlsposal system. The alopE to
ihe West ls moderate and less than 6%.
ln general, the solls near each of the bullding envelopes should consist of a brownish
loam topsoll and a clay loam subsoll overlaylng a loam substratum to a dapth of more
than five feet. There are no rocks or boulders present in the soil. The percolation ratee
are llkely to be moderate, and the on-site disposal of wastewater flows should ba feasible.
This property is located within the soil survey mapped by the Soil Conservation Service.

mineralformations of the area. This soil hqs only moderate limitations for the lnstallation
of septlc aystems, dependent on the moderate permeability and somewhat sloffer
percolatlon rates.

all of which hsve conv€ntlonal sefiic systems, While the aoll on each lot should be
sulhble, well-developed, and sufllciently permeable, the applicant should be aware of
and prepare the further slte investigations required before permib and approvals can be
lssued by Garfleld County for the construc'tlon of an individual sewage disposal system.
A site speclflc percolation trest must be done on each lot to determlne the final deslgn of
ths septic systems beforo beginning the construction of the resldences.
ln summary, lt ls our opinion that an on-slte wastewater dlsposal aystem can be
conskuc'ted on each property that conform to the Garfleld County Regulatlons on
lndividuql Sewage Dlsposal Systemr.

1. A driveway apr:roach is understood to be that portion of the high-
way ri ght-of -way bet.ween the pavornent edqe and the property Ii-ne which
is designed and used for'the interchange of treiffic between the road*
\^ray pavement. and the abuttinq property.
2. ,qt any intersection, a driveway sha1.1 be restricted for a suf*
ficient, distance from the intersection to preserve tho norrnal and safe
movement of traffic. (1t. is recommended for rural residence entrances
that a minimum intersect,ion clearance of 50 feet be provided and for
rural commercial entrances a rninimurn of 100 feet lie provided. )
3. All entrances and exits shall be so located and constructed that
vehicles approachinq or using them will be abl.e to obt.ain adequate
sight distance in both directions along the highway i.n order to maneuver'
safely and without interfering with highway traffic.
4. The Applicant shall not be permitt,ed to erect any sign or display
mater ial , ei ther f i xod or movable, orr or ex t,en di n q over an y por tion
of the highway right-of*way.
5. Generally, no more than one approac;h shall be allowed any parcel
or property the frontage of which is less than one hundred (100) feet.
Additional entrances or exits for parcels or property having a frontage
in excess of one hundred ( 1 00 ) feet shalL be permitted only after'
showing of actual convenience and necessity.
6. All driveways shall be so located that the flared portion adjacent
to the traveled way will not encroach upon adjoining property.

feet, measured at right angles to the centerline of the driveway, except

The construction of this well shall be in compliance with the Water Well Construction and Pump lnstallation Rules
2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well
Construction and Pump lnstallation Contractors in accordance with Rule 17.
Approved pursuant to CRS g7-92-602(3)(bxll)(A) as the only well on a tract of land of +39.7 acres described as
that portion of the sw 1/4 of sec. 11 and the sE 1/4 of sec. 10, all in Twp. 8 south, Rng. 88 West of the 6th P'M.,
Garfield County, being more particularly described on the attached exhibit'A' (HICKS PHASE 2).
The use of ground water from this well is limited to fire protection, ordinary household purposes inside three (3)
single family dwellings, the irrigation of not more than one (1) acre of home gardens and lawns and the watering
of domestic animals.
The maximum pumping rate shall not exceed 15 GPM.
The return flow from the use of this well must be through an individual waste water disposal system of the
non-evaporative type where the water is returned to the same stream system in which the well is located'

mortgage thereon covered by this Commitment other than those shown in
Schedule B hereof, and shall fail to disclose such knowledge to the Company in
writing, the Company shall be relieved from liability for any loss or damage
resulting from any act of reliance hereon to the extent the Company is prejudiced
by failure to so disclose such knowledge. lf the proposed lnsured shall disclose such
knowledge to the Company, or if the Company otherwise acquires actual
knowledge of any such defect, lien, encumbrance, adverse claim or other matter,
the Company at its option may amend Schedule B of this Commitment
accordingly, but such amendment shall not relieve the Company from liability
previously incurred pursuant to paragraph 3 of these Conditions and Stipulations.
Liability of the Company under this Commitment shall be only to the named
proposed lnsured and such parties included under the definition of lnsured in the
form of policy or policies committed for and only for actual loss incurred in
reliance hereon in undertaking in good faith (a) to comply with the requirements
hereof, or (b) to eliminate exceptions shown in Schedule B, or (c) to acquire or
create the estate or interest or mortgage thereon covered by this Commitment. ln
no event shall such liability exceed the amount stated in Schedule A for the policy
or policies committed for and such liability is subject to the insuring provisions and
the Conditions and Stipulations and the exclusions from coverage of the form of
policy or policies committed for in favor of the proposed lnsured which are hereby
incorporated by reference and are made a part of this Commitment except as
expressly modified herein.
Any claim of loss or damage, whether or not based on negligence, and which arises
out of the status of the title to the estate or interest or the lien of the insured
mortgage covered hereby or any action asserting such claim, shall be restricted to
the provisions and Conditions and Stipulations of this Commitment.
