when the following proceedings, among others were had and done, to-wit:
RESOLUTION NO. e4-063
A RESOLU-TION CONCERNED WITH THE APPROVAL OF A PRELIMINI\RY PLAN FOR
PRINCE CREEK ESTATES.
WHEREAS, DAVID HICKS has flrled an application with the Board of County
Commissioners of Garfield County for approval of a Preliminary Plan for Prince' Creek Estates;
WHEREAS, the Garheld County Planning Commission reviewed the Pri.nce Creek Estates
application and recommended approval to the Board olCounty Commissioners;
WHEREAS, based on the material submitted by the applicant, the recommendation of the
Planning Commission and the comments of the Garfield County Planning Department, this Board
hnds as follows:
That proper publication, public notice and posting was provided as r,equired by law lor
the hearings belore the Planning Commission and Board of Count,y Commissioners.
That the hearings belore the Planning Commission and Board of County
Commissioners were extensive and complete, that all pertinent facts, .matters and issues
were submitted and that all interested parties were heard at that hearings.
That the Garfield County Planning Commission recommended approval of the
Preliminary Plan.
That the proposed subdivision of land is in compliance with the recommendations set
forth in the Comprehensive Plan lor the unincorporated area of the County.

That all data, surveys, analyses, studies, plans and designs as required by the State of
Colorado and Garfield County have been submitted, reviewed, and found to meet all
sound planning and engineering requirements of the Garfield County Subdivision
Regulations.
That the proposed subdivision of land conforms to the Garfield County Zontng
Resolution.
That for the above-stated and other reasons, the proposed PUD is in the best interest
of the health, safety, morals, convenience, order, prosperity and welfare of the citizens
of Garfield County.
NOW, THEREFORE, BE IT RESOLVED that the Preliminary Plan of Prince Creek Estates
for the following described unincorporated area of Garheld County be approved with the following
conditions:
All representations olthe applicant, either within the application or stated at the public
hearing with the Planning Commission, be considered conditions of approval.
The applicants shall establish a Homeowners Association and shall be incorporated in
accordance with the requirements of Colorado Revised Statutes. The Homeowner's
Association shall be responsible for the Basalt Water Conservation District water
contract, well maintenance, road maintenance and snow removal. The articles of
incorporation and restrictive covenants shall be reviewed by County Staffprior to the
approval of a Final Plat.
3. The applicants shall prepare and submit a Subdivision Improvements Agreement,
addressing all improvements, prior to recording a flrnal plat.
The applicants shall submit improvement plans lor all road, drainage and utility
improvements prior to the approval of a hnal plat.
A11 utilities shall be placed underground.
AII cut slopes created during construction shall be revegetated with native grasses using
certified weed-free seed, and monitored lor two years. Security will be in place through
the subdivision tmprovement Agreement to ensure survival.
The applicants shall pay $200 per lot in school impact lees prior to approval of the final
plat.
All roadways shall be designed and constructed in conformance with design standards
set forth in the Subdivision Regulations and in place at the time of hnal plat. A
driveway permit will be required lrom Road and Bridge Department.
Only one (l) dog will be allowed for each dwelling unit to protect adjacent agricultural
uses and wildlife- Kennels shall be installed prior to a certificate of occupancy, and
language ensuring compliance shall be enforced through the covenants. Dogs shall be
leashed or kenneled at all times.
Well Permit #105764 shall be amended, consistent with comments from the State
Engineer's Office, to allow for three (3) dwelling units.

I l.Easements lor waterlines shall appear on the Final PIat, and the well perrnits shall be
transferred to the Homeowners Association.
All security lighting shall be shielded, and directed downward.
Any future development of the 109 acre parcel on the site will require a tie-in to a
central sewer system.
Dog restrictions, requiring a fining system enforced by the HOA, shall be included
within the covenants.
The Fire District shall submit a letter of approval prior to Final Plat.
Each homeowner is responsible for weed control.
Well number 105764 shall be relocated to Lot 3 &4 on the north side of the property.
Evidence of relocation shall be shown on the well permit location data, and submitted
to the Garheld County Planning Department prior to Final Plat.
