I have completed my geologic investiqation o{ the approximatel.y
12 acre parcel which is along the west side o{ the Frince Creeh
Road, It is located approximately I/4 miLe north o{ Prince 0reefl

Cournty , Col orado.
The topography o{ the lot consiets o{ a larqe pasture area to
the west o{ the Coutnty Road, which is we1I {encedr utith a

The pasturre is {Iocld irrigated. The buri idinc sites are on either
side o{ the drainaqB way which aLsio act:i as the atrce$s area f mr
the driveway. There are six 3 acre lots proposed.
The Ceoloey of this site consistc, o{ older terrace deposits
which Lie well above the terrace deposits at the level of
Highway lEI to the west. These deposits typically coneist o{
siItso sands, cobbles and Bome bourlders in a crutdely
stratified manner. Althourgh no bedrocll is visible near the
site, trends of outcrgp in the vicinity plurs the geoloqic
mappi ng by Fox <1974 ) i ndi cate that the I'lancos Shal e of
Cretaceous age is present at depth and probably dips about 20
degrees to the north. Depth to the shale could be anywherg
between s() and loc) +eet, There are no {aurlts evident nor are
there any other geologic strutctures evident which could
adversely a{{ect this site.
The building gites, as can be seenr are all on gently west
sloping terrain with no geoLogic haeards associated with them.
Any smaL1 drainage swales should be avoided, Although terrace
materials are unconsolidated, they do tend to be fairly stable
unless Lrnduly sLlpersaturated EEr for instance, by poor irriqation
practices. There are no natural drainages which can af{ect these
sites on both sides of the main drainage, which is very small'

SUBJECT: Use Restrictions for Permits lssued as the only well on 35+ Acres
The following standards are adopted as policy to. provide lor the consistent evaluation and
conditioning of appiications tor new well perrnitsand iequests to amend the use of existing wells
approved as the only exempt wellon.a tract of 35 acres or more under the provisions of section
g7-g2-602(3xbxll). only wells outside designated ground water basins are atfected'

Dear Dave:
Thank you for the referral for a six lot subdivision. The applicants, David and Connie
Hicks, are proposing to cr€te six single-family lots of approximately two acres each. The proposed
water supply for this subdivision is to be from the shared use of two domestic wells, permit nos.
105764 and 174240.
Pursuant to Section 30-28-136(h)G), C.R.S - L973, ttre State Engineer's Office offers the
following opinion for your consideration regarding material injury to decreed water rights and the
adequacy of the proposed water supply:
The two domestic well permia were issued as the only well on parcels of 35 acres or more.
The use of permit no. 17424A is limited to ordinary housetrold purposes inside three (3) single family
dwellings, the irrigation of not more than one acre of home lawns and gardens, and the watering of
domestic animals.
The use of permit no. 105764 is limited to ordinary houSehold purposes inside one (1) single
family dwelling, the irrigation of not more than one acre of home lawns and gardens, and the
watering of poultry, domestic animals, and livestock on a farm or ranch. This permit currently
cannot serve more than one single-family dwelling. Our present policy on domestic wells limits the
use to one single-family dwelling unless the applicant specifred more than one dwelling on the
application form. As of January !,lgg4, we will amend domestic permits issued as the only well
on 35 acres or more to indicate they can serye three single-family dwellings if the following
documents are submitted to this offtce:
1. A letter, signed by the applicant, requesting amendment of the permit, and speci$ing the
uses desired.

2. If the applicant for the amendment is not the original applicant of record, an application
for a change in ownerqhip/address (Form No. GWS-I1) and a copy of a deed showing they
are the owner(s) of the 35+ acres described in the existing well permit.
3. A legal description of the 35+ acre tract, if that information has not already been
submitted.
ln order to assure that a permanent water supply will be available on an equitable basis to
all lots, we r@ommend the following:
l. The wells should be located on an outlot owned in common by all properfy orvners
using 0re wells. Access to the wells and the right to establish and maintain pipelines
shall be provided by easements where necessary.
2. The wells should be jointly owned by the lot owners.
3. Covenants and/or other mechanisms should establish a lot owners association with
powers to make decisions concerning management and operation of the wells. A
joint maintenanc€ agreement is a required part of such an association.
Use of the two domestic wells may be shared between the proposed lots as long as the
individual conditions of approval on each permit are complied with and the limitations on use are
not exceeded. This will require that permit no. 105764 be amended to indicate it can serve three
single-family dwellings. No additional well permis will be available on the two 35* acre parcels
designated by the existing well permits without a plan for augmentation approved by water court.
Under current statutes and policies, the proposed water supply appears adequate, and there
is a presumption of no material injury to decreed water rights. Should you have further questions
