The purpose of this letter is to request release, on behalf of Mr. David Hicks, of a portion of
the monies being escrowed for improvements to Prince Creek Estates.

RE:Prince Greek Estates
Dear Dave:
The purpose of this letter is to request release, on behalf of Mr. David Hicks, of a portion of
the monies being escrowed for improvements to Prince Creek Estates.
The total request is for $ 16,000 as detailed in "Exhibit B" Prince Creek Estates Cost Estimate
dated 7129194 by S.G.M., lnc. for the construction of two water wells. We visually observed
that the two wells were placed in the field. Mr. Shelton has indicated that this invoice
accurately represents the work completed by his company.

SUBDTVTSION IMPROVEMENTS AGREEM ENT
KNOW ALL MEN BY THESE PRESENT that:
WHEREAS, DAVID HICKS AND CONNIE HlCKS(hereinafter "Developer"),
entered into a Subdivision lmprovements Agreement recorded in Book 710 at Pages 879 to 885
of the Garfield County records on August 2nd,l994for the improvement of the Prince Creek
Estates Subdivision : and
WHEREAS, the obligation of the Developer has been satisfied in part, as verified in a
March 27, 1995lrom Dean Gordon P.E., certifying that the partial improvements identiJied
in Exhibit "B" of the Subdivision Improvements Agreement have been installed per the
approved plans and specifications and part of the improvements described in SIA Exhibit B.
NOW THEREFORE, at the request of the Developer and in consideration of the
premises and prior agreements, the Board hereby acknowledges the partial satislaction of the
Subdivision Improvements Agreemententered into by the Developer and the BoardofCounty
Commissioners of Garheld County, Colorado, for Prince Creek Estates Subdivision, in the
amount of $20,000.00 and the release of the same amount with a Letter of Credit, from Alpine
Bank in Carbondale, Colorado, while retaining $50,000.00 for the improvements not
completed.

Dear Mike:
On Thursday, March 23rd,l inspected the waterline construction done to date at Prince Creek
Estates. Work done to date has been completed in a manner keeping with standard
construction methods.
There is a 12" and 4" PVC irrigation line t 12" above the 4" PVC potable waterlines which
were not part of our plans. SGM holds no responsibility in regards to the irrigation lines, or
their placement with respect to the potable waterlines.

Dear David:
Per your request, we have completed a construction cost estimate for road and water system
improvements at Prince Creek Estates. The estimate was done from the plans produced by SGM
dated May 26, 1994. The total cost of on-site improvements will be approximately $75,000.
the breakdown for these costs are outlined below.
The cost of road improvements is based on a lGfoot wide road using 6' of Class 6 aggregate
based course totaling $15,000.
The cost of the water system is approximately $50,000. This includes the installation of two
wells at $8,000 each, 2500 linear feet of collection and distribution piping at $20,000, 5000
gallon cistern at $5,000, and the control building and necessary appurtenances at $12,000.
Due to the variability of the well and control building costs, we have added approximately l0%
to the subtotal of $68,000.
There will be no significant revegetation costs required for this work.
The cost estimate is based on conversations with local contractors and prices for similar work
the past two years. The costs for the project are subject to change, based on field conditions
and contractor availability.
