have by these presents laid out, platted, and subdivided the some into lots
as shown hereon and designate the some as Prince Creek Estates in the County
of Garfield, State of Colorado. That said owners do hereby dedicate and set
apart all of the access easements as shown on the accompanying plat to the
use of the Prince Creek Estates Homeowners Association and hereby dedicate
to the Prince Creek Estates Homeowners Association those portions of said real
property which are labeled as utility easements on the accompanying plat as
perpetual easements for the installation and maintenance of utilities, irrigation,
and drainage facilities, such utilities including but not limited to electric lines,
gas lines, telephone lines; together with the right to trim interfering trees and
brush, with perpetual right of ingress and egress for installation and maintenance
of such lines. Such easements and rights shall be utilized in a reasonable
and prudent manner; and further hereby dedicate that area described and
identified hereon as "County Road ROW Dedication" consisting of 0.073 ocre, to
the public forever.
Provided, however, that all access easements are subject to the right of joint
use of said access easements by the Owners, their successors and assigns for
roadway access to and from Prince Creek Road to and from all lands owned by
the Owners lying contiguous to Prince Creek Estates as depicted hereon, and
that afI utility easements are subject to the right of joint use of said utility
easements by the Owners, their successors and assigns for the installation and
maintenance of utilites, irrigation and drainage facilities to serve all lands
owned by the Owners lying contiguous to the Prince Creek Estates as depicted
hereon.
That all expense for street paving or improvements shall be furnished by the
seller or purchaser, not by the County of Garfield.
