Located approximately I mile southwest of Silt on CountY Road 346. Request to divide a 44.5 acre site into single family lots Individual We1ls Individual septic systems A/R/RD North z A/I South: A/R/RD East z A/R/RD West z A/R/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN: The proposal is wiLhin District B, Subdivision,/Rura1 Serviceable Areas, L/2 to I mile radius, Ivlinor Environmental Constraints. Distr ict B density may be the same as the existing subdivision, but should not exceed three (3) units per acre. Developments within District B shall connect to an existing central- water system or construct its own central water system. The proposed density is consistent with the Plan, but the individual wel-Is proposed are not consistent with Plan language for technical services. II. DESCRIPTION OF THE PROPOSAL: A. Site Description: Steeper slopes of roughly 202 grade on the southern boundary represent a small portion of the project. The gentle sloping agricultural land is the predominant physical feature. B. Project Description: This request for 12 single family lots of 3.5 acres +, is less than then previous Sketch PIan proposals of IB single family-Iots of 2 acres +. The applicant's previous submittals were denied due to inconsistency wiEfr the PIan language. Earlier proposals were denser with a central water system and individual septic systems. This proposal substitutes individual weIls for the central water system.previous denials were also based on the poor access to the development due to the condition of the Silt Bridge. IIT. I{AJOR ISSUES AND CONCERNS: A. On August 22, 1983, the Board of County Commissioners approvedl by resolutionl the Preliminary PIan for the J-Mar Estates Subdivision with the following conditions: I. That covenants be provided with the Final Plat and at a minimum have the following provisions: a. That all dogs will be attended by the owner, tied up or kept inside a fenced enclosure; b. Provisions for annual payment to the West Divide Water Conservancy District be included, with recourse for the Homeowners Association to assess property owners if necessary; A 150 foot rear yard setback for Lots 5, 6,7, B and 9; That the Homeowners Association will agree to hook up to the SiIt waLer and sewer systems when the services are availabl-e. That all driveways shall have a minimum of a l-5 inch culvert thatextends at least three feet beyond the driving surface. That thedriving surfaces shall be at least 16 feet in width with at least d. e. a L2 inch sub-base and 6 inch base course.Page 2 2. That Giomi Lane will be oesigned to have a 3 inch asphalt mat 24feet in width, with a 6 inch aggregate base course 32 feet in width , for its entire length. That all recommendations forculverts on County Road 346 be included in the final design. 3. That the applicant provide a 51000 gallon water storage tank centrally Located in the subciivision with a letter of approval from the Silt-New Castle Fire District. 4. The developer comply with aII recommendations of the Division of Water Resources per the letter dated June 23, 1983. 5. That plat notes on the Final PIat include:a. That engineered individual sewage systems and house foundations may be required.b. That lots 5,6,71 8 and 9 shaIl have a 150 foot rear yard seLback in addition to all other setbacks required by the Garfield County Zoning Resolution. c. That all lots will hook up to the Silt water and sewage system when available.d. That all structural improvements shall be subject to the Chen and Associates recommendations in the GeotechnicalInvestigations for J-it1ar Estates, Job. No.25r366. 6. That the applicant comply with all recommenciatlons of Chen and Associates Geotechnical Analysis of the J-Mar Estates Subdivision as recommended by the Colorado Geological Survey. 7. That the Homeowners Association be incorporated and a fund beestablished to ensure that there will be money avail-able to pay for water from the West Divide llater Conservancy District, in perpetu ity . 8. That the water rights from the Rising Sun Ditch be conveyed tothe homeowners equally and that irrigation easements and culverts be noted and provided as a part of the subdivision improvementsat Fina1 PIat. 10. ft is the agreement of the applicant and the Board thaL the applicant shall make a contribution or improvements to the SiltBridge in the amount of One Thousand Dollars and Nor/Cents($I,000.00) per Iot for twelve (L2) Iots for a total amount of Twelve Thousand DoIlars and No/Cents ($12r000.00), which moneyshall be paid prior to the recording of the final plat for thesubject subdivision, or as otherwise provideo in the Subdivision Improvements Agreement . The applicant has addressed these conditions in full as required in the resolution approving the Preliminary Pl-an. IV. FINDINGS: 1. That the applicant has complied with al-I Preliminary Planconditions of approval prior to approval.2. That the Final PIat meets the requirements of Section 4.03 ofGarfield County Subdivision Regulations of L979r ds amended. V. RECOMMENDATION: ApprovaI. (3)
