HomeMy WebLinkAboutLand Use Change PermitLAND USE CHANGE PERMIT for A parcel of land situated in NE~NE~ of Section 29, Township 7 South, Range 87 West of the 6th P.M ., County of Garfield, owned by Glen Sloop and Leslie Lewis, known as Lot 2 of the Sloop Subdivision Exemption Plat, Garfield County, recorded as Reception No. 803929 on June 14, 2011, in the records of the Garfield County Clerk and Recorder, and more particularly described in a Bargain and Sale Deed recorded at Reception No. 859985 with the Gartield County Clerk and Recorder. (Assessor's Parcel No. 2391-291-06-002) In accordance with and pursuant to provisions of the Garfield County Land Use and Development Code. as amended. and the Director•s Decision Letter dated June 8, 2016 the Director of the Community Development Department hereby authorizes the following activity: An Accessory Dwelling Unit as shown on the site plan attached as Exhibit ''A" . (GAPA-04-16-8442) This Administrative Land Use Change Permit is issued subject to the conditions set forth in Exhibit "B" and shall be valid only during compliance with such conditions and other applicable provisions of the Garfield County Land Use and Development Code, as amended, Building Code, and other regulations of the Board of County Commissioners of Garfield County, Colorado. X--- Exhibit B Conditions of Approval 1. All representation of the Applicant contained in the application shall be considered conditions of approval unless specifically modified by the Director Decision. 2. The Applicant shall comply with Standards for ADU's contained in Section 7-701 of the Land Use and Development Code. 3. The Applicant shall comply with all plat notes contained on the Sloop Subdivision Exemption Plat recorded at Reception No. 803929 with the Garfield County Clerk and Recorder including but not limited to plat notes on weed management, access, lighting, defensible space and site specific soils analysis. 4. The Applicant shall comply with the foundation recommendations contained in the Geotechnical Report prepared by H.P. Geotech dated March 28, 2016. 5. The Applicant shall properly permit with the County and install a new onsite waste water treatment system to serve the ADU. At the time of permitting the Applicant shall provide an updated soils report or addendum to the existing report that addresses the proposed OWTS and any specific recommendations. At the time of permitting the Applicant shall also confirm that the proposed OWTS meets all setback requirements from domestic wells and existing leach fields. 6. The Applicant shall upgrade that portion of the access roadway serving the ADU that is shared with Lot 1, to maintain a minimum of 16 ft . of width , with shoulders and drainage ditches in compliance with Section 7 -107. The driveway upgrades shall be completed prior to issuance of a certificate of occupancy for the ADU. 7. The ADU shall be required to meet all Garfield County Building Code Requirements. Grading and drainage shall be addressed as part of the Building Permit process. 8. The Applicant shall comply with the Best Management Practices for wildlife compatibility outlined in the CPW referral letter dated May 17, 2016. 9. The ADU shall utilize noncombustible roof materials or other materials as recommended by the local fire agency. 10. All exterior lighting shall comply with Section 7-304 and electric service line extensions to the ADU shall be below grade. 11. Testing for radon after construction is completed is recommended.
