Development (Aspen Equestrian Estates Subdivision)
PROPOSAL: Removal of 600 Square Foot limitation for pasturing and
livestock structures in the Open Space District

I. BACKGROUND. DESCRIPTION OF PROPOSAL
Aspen Valley Polo Club is proposing an amendment to the PUD Guideline for the
Preshana Farm PUD to remove the 600 Square Foot limitation for pasturing and livestock
structures in the Open Space District. The amendment would allow the installation of
pasturing and livestock buildings in excess of 600 square feet within the Open Space
District. All other provisions of the Open Space District are proposed to remain as
approved, including 5 percent building lot coverage and 10 percent imperuious surface
maximums.
The current PUD language requires that buildings for animals located in the Open Space
District not exceed 600 square feet. The Applicant would like to remove this size
restriction of 600 square feet from this provision in the PUD.
This would modify section B. 1.d. Pasturing of livestock including structures providing
shelter for livestock and livestock feed when the footprint of the structure is 600 square
feet or less, as follows: Pasturing of livestock including structures providing shelter for
livestock and livestock feed.

II. AUTHORITY - CRITERIA
This request is being considered in accordance with Garfield County Land Use and
Development Code, Section 6-203 PUD Zoning Amendment. Subsequent to the Pre-
Application meeting the Director of the Community Development Department made the
determination that the request is a Minor Modification to the PUD. Said determination
was formalized in the Pre-Application summary a copy of which was included in the
Application submittal. The Application has been processed in accordance with Section
6-203(8)(a) including submittal of an application, completeness review, scheduling of the
date for the Director's Decision on the request, and public notice. The Review Criteria is
contained in Section 6-203(C) and further detailed in the Staff Analysis section of this
Staff Report.
III. STAFF REVIEW AND ANALYSIS
1. Public notice required for the Minor Modification to the PUD including mailing to
property owners within the PUD and any mineral rights owners within the PUD has been
completed with documentation provided by the Applicant. No public comments have
been received at this time.

2. Section 6-203(C) Review Criteria are addressed in the following sections. The
criteria are shown in italics and staff analysis shown in bold.
Section 6-203(C)(1). Conform to the Comprehensive Plan
The Garfield County Comprehensive Plan 2030 designates the site as Medium/High
Density Residential. At the time Preshana Farm PUD was approved, it was
determined to be in compliance with the Comprehensive Plan. Since the impacted
parcels with the Preshana Farm PUD are zoned Open Space and the uses and
intensity of uses will not increase, it is Staff's opinion that the proposed
amendment remains consistent with the Comprehensive PIan.
Section 6-203(C)(2). /s consistent with the efficient development and the
preseruation of the character of the development;
The proposed amendment will not change the character of the overal! development
as it will not alter the permitted uses or intensity of those uses. Although the
amendment will allow livestock structures to be larger than 600 square feet, a
maximum building coverage and impervious surface coverage remain as approved
at 5 percent and 10 percent respectively.

Section 6-203(C)(s).Do not increase the density
The proposed Minor PUD Modification will not change the density of the
development.
Section 6-203(C)(4). Do not decrease the amount of dedicated Open Space
The proposed Minor PUD Modification will not change the amount of dedicated
Open Space.
Section 6-203(C)(5). Do not affect, in a substantially adverse manner, either the
enjoyment of the land abutting upon or across the road from the PUD or the public
interest;
As the proposed amendment does not alter permitted uses or intensity of those
uses, it is Staff's opinion that the proposed Minor PUD Modification will not
adversely impact land abutting or across the road from the PUD or the public
interest.
Section 6-203(C)(6). Do not change the use category of the PUD between
residential, commercial, or industrial uses
The proposed Minor PUD Modification will not change any use category.
Section 6-203(C)(7).

Will not be granted solely to confer a special benefit upon
Staff understands that no special benefit to an individual person would be granted
as a result of the proposed Minor PUD Modification.
Section 6-203(C)(8). Shall not affect the rights of the residents, occupants, and
owners of the PUD to maintain and enforce those provisions at law or in equity.
The proposed PUD Modification is being considered in accordance with the Land
Use and Development Code. Other than the elimination of a maximum livestock
building size in the Open Space District, the rights of owners, residents, or
occupants within the PUD remain unchanged.
IV. SUGGESTED FINDINGS FOR APPROVAL
The following are suggested findings for approval of the Minor Modification to the CMC
PUD.
1. That proper public notice was provided as required for the Director's Decision.
2. That consideration by the Director was extensive and complete, that all pertinent
facts, matters and issues were submitted or could be submitted and that all
interested parties were provided the opportunity to have input on the request.
3. That for the above stated and other reasons, approval of the Minor PUD
Modification request by the Aspen Valley Polo Club, LLC is in the best interest of
the health, safety, and welfare of the citizens of Garfield County.
4. That the Minor PUD Modification has been determined to be in general
conformance with the Comprehensive Plan 2030, as amended.
5. That subject to compliance with conditions of approvalthe Minor PUD Modification
is in conformance with the Review Criteria contained in Section 6-203(C), Review
Criteria of the Garfield County Land Use and Development Code, as amended.
V. RECOMMENDATION
Staff suppofis an approval by the Director of the Community Development Depaftment
subject to the above findings and the following conditions of approval.
1. That all representations made by the Applicant in the Application shall be
conditions of approval unless specifically altered by the conditions of approval contained
herein.
2. The amended PUD Plan and all associated documents shall be recorded with the
Garfield County Clerk and Recorders Office within 30 days from this approval.

Description of Request: Text Amendment to the Preshana Farm Planned Unit Development as
recorded by reception number 562197. The amendment would modify
Section LB.l.d. of the Preshana Farm Planned Unit Development
P.U.D. Zone District Descriptions by removing the requirement in the
O.S. Open Space District that livestock and livestock f'eed structures be
limited to 600 square feet or less.
All persons affected by the proposed Land Use Change Permit are invited to comment regarding
the application. You may state your views by letter, or you may call the Community
Development Department at (970) 945-8212 regarding the application. The Director will give
consideration to the comments of surrounding property owners, and others affected, in deciding
