County Commissioners that the subdivision in question, Stirling
Ranch Planned unit Development (PUD), di-d not enjoy public accessby use of that road. While your correspondence does not indicatethat exLent of difficulty, it does assert that a portion of County
Road 1624' is located on Crouch property.
Currently, the Board of County Commissioners has beenpresented with a survey of County Road t.62A that demonstrates thelocation of the right-of-way and the exist.ing paved. roadway,toget.her with a depict.ion of adj oining property ownership.Addit.ionally, t.he Board has been presented with and accepted deedsfor additional right-of-way ut.ilized in relocated portions of
County Road L62 and L62A. Those documents do not confirm any ofthe representations set forth in the second (2"d) paragraph of your
correspondence of November 2, 2004. Indeed, the road lying inproximity to t.he Crouch residence, which I believe is Count.y Road762, was relocated by a deed and vacation process in 2002.Therefore, through t.his correspondence, r am requesting that youprovide all supporting information, including alI deeds, plats,title opinlons or ot.her documentation support.ing your cl-aim that

Here is a copy a plat recorded on November 24o, 1992, Book 769,Page 979, Reception
number 4trlL4tr7.The first page shows the Northern part of County Road 162 and the
second ths Southern portion, as it turns into County Road 162A-
The triangular .93 acre parcel is clearly indicated, as is the old fence and the county road
easemert, and the existing access road which we use- The easement and existing road are
not on her property, except for thc srnall portion on the Southeast comer of her property,
which we have moved.
She may be referring to the old jeep road within that triangular .93 acre piece of
property???

As promised, here is the Deed showing that John Stirling conveyed 0.93 acres of land to
the Barnes (assumed to be prior owners of the Crouch Property). It appears clear that
neither County Road 162 nor 162,4. lies within that parcel of ground that is owned by
Crouch.

Re: Adrienne Crouch - County Road 162A
Dear Commissioners:
This letter is written on behalf of our client Adrienne Crouch whose
residence address is 0389 County Road 162, Carbondale, Colorado and whose mail
address is P.O. Box 1704, Carbondale, Colorado 81623. The purpose of the letter is to
again bring to your attention and to require that without further delay County Road 162A
be relocated so that it is not located in part on Ms. Crouch's property.
County Road 162A runs north and south with respect to the Crouch
property, which lies principally to the west of the Road. Pursuant to the 1992
Subdivision Improvements Agreement entered into by the County with John Stirling the
western boundary of the Road was to be the eastern boundary of the Crouch property
which is a historic fence line described in a deed recorded June 12, l98l in book 574 at
page 303 of the real property records of the County. However, the Road was established
with a western boundary on the eastern line of the NW4 NW4 Section 29,T75, R87W
of the 6ft PM, which line is west of the eastern boundary of the Crouch properfy and thus
is within her property. Resolutions Nos. 2003-105 and 2003-106 of the Proceedings of
the County Commissioners in November 2003 with respect to the Stirling Ranch Planned
Unit Development required that County Road 162A be correctly aligned so that no
portion of it is located within the Crouch property. The foregoing has not occurred. The
amount of Crouch property which is wrongfully burdened by County Road 162A is a .93-
acre parcel somewhat triangular in shape having a width of approximately l0 feet at its
northern point and approximately 53 feet at its southern point. Moreover, part of the
Road is only a few feet from the front door of Ms. Crouch's residence.

It is not the responsibility or obligation of Ms. Crouch to pursue private
remedies for the above wrongful encroachment of the County Road on her property or for
the enforcement of Resolution Nos. 2003-105 and 2003-106. Rather, it is the obligation
of the County to cause its Road to be in the proper location. Accordingly, demand is
hereby made that the County cause County Road 162A to be realigned so that it does not
encroach upon the Crouch property, to regrade a portion of the Crouch property upon
which the Road is now located and to revegetate that property. Please confirm promptly
that this action will be taken and the timetable for doing so.

Compliance - Sterling Ranch PUD and SIA Requirements

At your meeting of November 3,2003, you initiated a public
hearing concerning amendments to the Sterling Ranch PUD
Subdivision. You continued that hearing for the purpose of
receiving further information concerning compliance of the
Developer wj-th varj-ous Subdivision ImprovemenLs Agreements that
have been executed during the l-ast ten (10) years. It is my
understanding that the specific issue concerni-ng the Board is the
SIA requirement to improve portions of County Roads L62 and L62 A
and the acquisit.ion of necessary right-of-way to accomplish t.hose
improvements. In regard t.o that specific i-ssue, I would draw the
Board's att,ention to the following:
1. In Sept.ember of L992, the Board and Developer executed an
initial Subdivision Improvements Agreement for development. of the
subject property. At the tj-me of execution of that Agreem.ent, the
current subdivision was known as t.he "Sun Mesa PUD". That. SIA was
recorded on September 10, L992.
2. As it. relates t.o the issue f or which the BOCC requested
clarification, that SIA contained a specific provision concerning
the development of external roads. That Agreement incorporated at
Exhibit K a depiction of the existing County Roads !62, L62 A and
the right-of-way needed to properly locate those roads and
improvement of those roads pursuant to other provisions of the SIA.
Exhibit K was prepared by High Count.y Engineering, Inc., or behalf
of the Developer. The first page of that document contains a
description of both the exisLing right.-of -way and the propert.y that
would need to be acquj-red for the proposed right-of-way. That
description is consistent with other exhibits attached to the SIA
concernj-ng needed property acquisition. You wil-l- note that on the
last page of Exhibit K, the existing road and right-of-way are
depicted at their enLrance to the Sun Mesa PUD, the area now in
dispute. Also depicted is the locat.ion of property belonging to
Adrian Crouch. Neither the existing road nor t.he proposed righL-
of-way is depicted as falling on her property. Therefore, the SIA
did not include a requiremenL for property acquisition from Crouch.

3. Subsequent to execution of t.he original sIA, the County
received. Deeds for aIl- property depicted on the first' page of
Sxhibit K, except for Garfinkel. Attached to this memorandum are
Deeds from Guarini's successors in interest, F'azzore, Ruth Stirling
and John Stirling on behalf of the Trust. No Deed was obtained
from Garfinkel. th" go.rd of County Commissioners, on the 15Eh of
March , tgg9, specifically found that acquisition from Garfinkel
would not be need.ed (see SIA, March 15, L999, paragraph 4 A',
attached heret.o) .
4. The Subdivision Improvements Agreement of March 15 , L999,
also recognized. t.hat the external road improvements had been
properly completed. This was based on representations from the-Oe.r.toper,s engineer of September 1, l-995. I have attached to this
Ietter a copy of t.he certification letter from Yancy Nichol on
behal-f of the Developer including the attachment indicat,ing that
aII improvemenLs to County Roads L62 and L62 A had been completed
in compliance with the Subdivision Improvements Agreement, except
for chip and seal.
5. Based upon the foregoing, to the point of the most recent
application now before the Board, all information to the County
indicated that the Developer was in compliance with the
requirements of the County. A11 property had been properly
acquired or the Developer had been relieved of the necessit,y to
acquire property on 162 and L62 A. Based on the representations of
th; Oeveloper's Engineer, dI1 improvemenLs have been properly
completed.
6. Through the process of review for the current
application, th; County discovered for the first' time that the
entrance road to the property, now known as the "sterling Ranch
pUD", had not been constructed at the location or in the manner
represented by t.he Developer's engineers. Contrary to the
requirements "f the original SIA and Exhibit K atLached to that
document, Lhe road at the entrance Lo the Sterling Ranch PUD was
not constructed in the alignment of the then existing road or
within the right-of-way that the Developer's Engineer said would be
necessary to construct that entrance road. Contrary to the
represenlations of t.he Developer and' the Engineer, the road had
been construcLed, in part, on property owned by Adrian Crouch' The
previous position of the Board. of County Commissioners was taken as
a direct result of erroneous representations by Lhe Developer.
Therefore, t.he BOCC may st.iII require compliance wit'h the original
SIA. Based upon the property transfers to the County in 1992 there
exists sufficient right-of-way within which to place County Road
L52 A on property that belongs t.o t.he public. To the extent county
Road L62 A was noL consLructed. in compliance with the original SIA,

there is a violat j-on of t,hat Agreement. . In all other respects,specifically concerning acquisition of property, the Developer has
achieved compliance with the requirements of the original SIA.
If you have further questions in regard to this memo, I will
be happy to address those matters ln separate correspondence or at
t.he continued public hearing on November 10, 2003.

This Anrcndrnent to Subdivision Improvements Agreement and Confirmation of Final Plat
fbr: Sun Mesa Planned Unit Development is made and entered into this 1.!!h day of
Ivlarch , 1.99 9, by and between the ESTATE OF JOHN STIRLING and the
BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO
(hereinafter referred to as the "County");
RECITALS
WHEREAS, on September 8, L992, the late John Stirling and the County executed a
Subclivision Improvements Agreement for real property then owned by Joha Stirling and known as
Sun Mesa Ptanned Unit Development ("Sun Mesa P.U.D."), all as described in that Subdivision
Improvements Agreement (with attachments) recorded on September 10, 1992, in the office of the
Clerk and Recorder for Garfield County, Colorado in Book 841 at Page 252 as Reception No.
438797: and
WHEREAS, the terms and conditions of said Subdivision Improvements Agreement were
being timety performed and fulfilled at the time of John Stirling's death prior hereto in 1998; and
WHEREAS, by reason of the death of John Stirling, the Estate of lohn Stirling has
succeedecl to all interest of the late John Stirling in the Sun Mesa P.U.D., including all his interest
in, rights under, and duties and obligations of, the Subdivision Improvements Agreement; and
WHEREAS, fire Personal Representative for the Estate of John Stirling and the County,
desire to anrend the recorded Subdivision Improvements Agreement to make public record such
succession of interest and assumption of obligations by the Estate to the existing Subdivision
lmprovements Agreement; and
WHEREAS, on or about September 10, 1992, the late John Stirling signed the Final Plat
tbr Sun Mesa P.U.D. as the same had been approved by the County; and
WHEREAS, the Final Plat for Sun Mesa P.U.D. was not recorded upon approval and
signing rn 1992, pending the completion of ttre acquisition of certain property for a county road
right of way; and
WHEREAS, there have been no changes in any respect to the Final Plat for Sun Mesa
P,U.D. as approved by the County and signed by all necessary persons on or about September 10,
1992: and
WHEREAS, the parties hereto agree that there is no further reason to delay the recording
of the Final PIat of Sun Mesa P.U.D; and

Paragraph 4.External Roads.
The acquisition of a Right of Way for the improvement of County Road 162
has been corrpleted to the satisfaction of ttre County. The County has
received deetls for tJre Right of Way from two of the three property owners
ancl mr lurther wurk is necessary to complete those transactions. A third
property owner, now Martin Garfinkle, has not agreed to convey property
frlr the Right of Way to the County however the County has determined that
it wilI not take action to acquire such additional ROW.
'ilre quiet title actinn has been successfully completed by a settlement where
deeds were tendered to the County for the existing Right of Way.
Tlre Estate has already paid the $7,724.64 to the County for its portion of
chip and seal surfacing of County Road 103 and that obligation has been
sltisfied.
The Estate shall post security for the chip and seal surfacing of County
Road 162 in the amount of $15,350.00 posted in the form of a letter of
credit sinrultaneously herewith. All other improvements have been certified
as complete Ibr the first two phases and security is necessary.

Upon review of the Final Amended Lot 23, Stirling Ranch PUD,
I have prepared a list of comments or corrections to be made prior to approval for survey
content and form.
l. The drawing is not to scale.
2. This drawing is abundant with information that is not needed and at the same
time lacks information to close Lot 23 . C62, C63 and C64 are missing.
3. I suggest only information pertaining to lot 23 be shown on the plat- The
previous lot line should be shaded or dashed so as not to compete with the new
information.
4. This plat could be one page by going with a l": 100' scale and eliminating
unneeded information.
5. The line chart is not needed.
6. A dimension is needed to indicate the width of the Trail Easement.
7 - The 10' easement along the westerly line needs a purpose, also the line
indicating the easement needs to be more prominent.
8. The benchmark note under the legend is not needed.
9- A dimension is needed where the trail easement closes on the westerly line of
Lot23.
10. All exterior boundary annotation should pertain to Lot 23 only-
