I have also attached a copy of correspondence I tended t,o the Board of County Commissioners last November regarding titleissues on the Crouctr property and County Road 1-62A. FinaIIy, I have att,ached copies of notes recej-ved from the County Clerk'soffice, a'S such notes concern public hearings and not,ice t,o Adrienne Crouch. A11 of these documenEs are tendered in order that you may prepare for the May 4, 2009 meeting at whj-ch Ms. Crouch has been invited to appear for further discussion of the issues setforth in her letter. At its meeting of April 20, 2009, t,he BOCC reguest,ed that staff provide advice on both the legal and substantive issues regarding County Road L52A immediately beforethe May 4Eh meeting. A number of the issues raised by Ms. Crouchrelate to proper completion of the subdivision improvements agreement for Sun Mesa, documents that may be in your office in conformance with a final plat, conduct of public hearings andnotice as it relates to those public hearings, and the status of County Road 152A as it relates to access to the Sun Mesa PUD and subdivisi-on. I have requested that t,he County Surveyor and Pat,rick Burwell from Commonwealth Tit,le be ready Eo discuss issues Ms. Crouch has raised relative to work they performed. Many of the documents requesEed by Ms. Crouch will be held in the building and planning department files if they sEi11 exist. Additionally, all of the meetings for which she claims a lack of notice were conducted byyour department as land development concerns. When will you be moving the road offof My properly? There have never been road constnrction drawings or drainage drawings assotiut"d with County Road 162A. This is a requirement of the Stirling SIA. In addition, a title policy or chain of title wan never accompanied with the Henderson Stirling Plat , #44t4y'l,in November 1992.I did not join in on tht ptuL even though my property is in the NENW 29,875,66 PM. I have never had notification of any of the Stirling Subdivisions, including the Sun hrtesa SuMivision, the Henderson Stirling Subdivision, the Ruth Stirting SuMivision, or the Stirling Ranch PUD, or the ResuMivisions of Lots 23 andRenrbdivisions of Lot 28. The notificdion of neighbors is required by Statute. The title policy that I received over County Road l621^is not complete as the chain of is not correct. See my recorded document . (Exhibit A). There are many flawed statements in the review and the plat also shows land in Sectiou 20"7 E7-S-. - - The Resolution of 1983 for Ruth R Stirting describes the plat in the planning Departuent file. I have brougfut that plat with me today. This plat is not in compliance with the State Statutes and shows the land by Co Rd 102. In addition, Ruth Stirling did not receive the land from her divorce decroe fiom John Stirting rmtil Octob€r l983.The Resolution was passed in September 1983. Again, no notification- I believe Garfield County is ignoring the State Statutes as they relate to SuMivision approvals and Notification. Anyone can plat land, as long as All of the included landowners approve, and sign the plat before recording. All of the jurisdictions, whether County or Crty ask for atitle commituent during the approval process, in orderto be sure who owns the property and vfio should sign the plat. Also all encroactnne, ts must be identified. In summary, I am asking the county When are you moving the road offof my property? When may I receive the Construction drawings of both l62[arrd l62,rcquired in approval of the Stirling SIA?- When will the drainage problems be fixed on my properly? On September 2, 2008, I finally received Lfrat Commitment, together with all of the attachments related to the Schedule B exceptions. I have attached a copy of that Commitment together with the documents supporLing the Lxceptions. That Title Commitment related so1ely to that portion 6f County Road L62A conveyed by .fohn and Ruth Stirling in November of ],992. tfre Commitment focused directly on the easement deeds transferring property, as executed by both of those parties, to Garfield County-foi tha purpose of access and public uEitity location. County Road 1,62 north of County Road L62A was not the subject of this ipecific Commitment. The northern portion of County Road 162 was th; subject of deeded right-of-way transfers and prescriptive use claims, none of whj-ch directly involved the Crouch property or property owners. The northern portion of County Road l-52 does not ippl"r Lo be the subject of the Adrienne Crouch challenge. The BOCC focused Road ]-62 at an earlier t'ime. deed and dedication, as well as the Crouch exemPtion request, specifically stated that County Road crossed her ProPertY. In regard to the Title Commitment for County Road L62A, I would draw your attention to Schedule B - Exceptions, The first 8 County Road L62 as it Passes across not the subject of the current Title attention on that port,ion of County It was the subject of both an ancient wherein Adrienne Crouch L62 was a Public road as it .*""pt-iorr" are standard disclaimers contained in "o**it*.nts in Colorado. Exceptions 9-LL are standard of mineral interests found in the chain of title for a of countsy roads. Garfield county, pursuant to state claim arry mineral rights underlying county Road exceptionl, even if applicable to Garfield County, do our interest in the subject roadway. all title reservations great number law, does nof L62A. The not endanger Exception L2 concerning a potential overlap of parcels does raise a pJtentially significant issue. For that purpose, I reguested peimission to retain the services of Scott Aibner, Garfield County Surveyor, ES suggested in the e-mail correspondence of Pat'rick gurwell of Septeirber 2, 2OOB (see attached). Scott Aibner has now complet.ed his work on this project, p11t_t1ng both descriptions tha! ,erl contained in the deeds trom Stirtings versus the potential overlap as set forth in the exceptj-ons to title noted by Mr' Burwe1l. The attached plat from Mr. Aibner demonstrates that there is no overlap between the deeds, hence, ro title defect that would be the subje-ct of exclusion L2 in schedule B. I have attached a copy of ttr. Aj-bner's plat to this letter. You will note that Ehe pf'al conLains other rLlevant informaEion, as we1,l as the plaEting of the potentially conflicting deeds. County Road L62 is depicted aS it crosses the Crouch property, showing the centerline of E'he ancient road deed coinciAing to a significant degree with the location of the current County Road L62 ' Exception 13 in Schedule B relates Eo an easement granted by HoIy Cro=i Electric Association. While this transfer predates the deed to the CounLy, the public utility easement and the road right-of- way are not mutualiy excl-usive. Rather, it is common for bot'h prlfi" utilitie" "rrd public roads to exist within the same righg- of -way. Board of CountY Commissioners November 20, 2008 Page 3 Excepti-on L4 was not the subject of research by the County Survlyor, although that can be lccomplished if the BOCC desires' Neither Mr. Burwell's nor my view of this easement appears to indicate thaE it would preclude the location of the entirety of County Road L62A. This easement was first established through a 19g3 ixemption. The easement commences at the southern terminus of County ndad !62A, at the point where it now enters the Sun Mesa pUD. From that point iC extends in a northeasterly direction across private property to a parcel located some di-stance to the east of County-nola {eZX. (A graphic depiction.,of the subject easement is contained in Ehe elanning Department files for the RuEh Stirling Exemption-Resolution 83-301 and the Henderson/Stirting Uxemption-Resolution '92-103. ) This easement does noE appear to impait Crouch property. However, further platting may be desirable. Exception 15 concerns a to directly affect the Finally, exceptions l-5 and L'7 involve the conditions of approval for the Henderson/Stirting Exemption Plat (ResolutLon 92-103). The exemption was finalized and rec-orded at the same time the Stirling deeds were recorded for the benefit of the county. The Title Commitment does not indicate that any parcels authorized by the Henderson/Stirling exemption were conveyed and recorded prior to ttre conveyance "td t""ofaitg of conveyance of the right-of-way for County nola LG2A. Theretoie, n'one of the platted information or condilions set forth in the resolution of approval should affect t,itle conveyed to the County. Even if such transfer of a parcel had occurred and been recorded prior to conveyance to the County' none of the conditions of the resolution, Iega] descriptions or platting appear to be inconsistent with the right-of-way conveyance. No public action taken. o ResolutionJor Crouch Title Problems - Ms. M. Adrienne Crouch Louis Buettner and Adrienne Crouch were present. This should have been Louis Buettner addressing title not Adrienne Crouch Louis identified 7 major problems and they basically go to legal matters. Last November he tried to speak to the Commissioners since the County Attorneys were involved. First item - informed to come up with a solution, so the first is to an old road right of way dedicated in 1913. The document itself isn't real clear if it is an easement or a fee title. The County has been taxing this property with this right of way included in it the property, so I assume it is an easement. I would put forth that Ms. Crouch and the County enter into a boundary agreement to settle where that road is - the road basically can't be found because the monumentation that the road is tied to has been lost in the last 120 years. The present day monumentation that is in the field, the record on how it was established has not been supplied to me, I requested that information this from the County Surveyor and I have received no reply. I can only assume there is no record of how that monument for the section corner was established. There is a great deal of evidence that the monument can be anywhere from 70 to 200 feet off - the 70 feet is based on lot line adjustments that have been made in the area and the 200 feet offis based on the theory that a found road in the area crossing the Crouch property is the old road but it is not conclusive evidence. That would put that section corner 200 feet off. Another problem that I have identified is when the Sun Mesa PUD and the Stiring Ranch PUD, the required roadway for them was acquired, the Lot2l of Sun Mesa, the entrance to that lot to. the public road was burdened across the Crouch property. The County required Sun Mesa and Stiring both where a county road to their property that is identified currently as l62A.It joins the Crouch property on the east and the construction of that road was supposed to be designed and engineered and constructed in the field; the design and engineering of that road, the constriction of that road now floods the Crouch property. Plus at the SE corner of the Crouch property the road was constructed on the Crouch property. In 2003 this problem was brought forth to the County, the Board here, it is on the Minutes page 193. The County Surveyor was instructed to verify the item of encroachment and he did go out and he located the road on the property. 2003 to now no action has been taken to remove that road from the property. The construction of the road on the property, flooding of the propert/, I think is items that are County now as the road was supposed to be constructed and accepted by the County before the subdivisions or the PUD were approved for recording. Well, they are selling properties up there now so it must be on, but now the road is still on the property and there's still problems there. The last two items I have identified was the Crouch exemption and the Crouch exemption amended. The Crouch exemption was never recorded there was no public notice of that exemption plat. In 2002the Crouch exemption amended was recorded. Part of that process was the County would vacate a section of road in front of the Crouch house which was her driveway. I have not found any dedication of a road across her property that the County labeled 162 and I believe they were probably misled by Ms. Crouch. Her surveyor who labeled her driveway in front of her house as being 162 Road. I requested information about the 162 Road and Road & Bridge was unable to supply me with said information. The Crouch exemption, the vacation description, basically all description are supposed to for a geometric closed figure - in other wise a four (4) sided property should close four (4) sided.. That property description does not close by 10 feet. That land that was vacated by the Coun{y was then deeded back to Ms. Crouch in exchange for a transition from 1624 to her driveway. That description does not form a closed geometric figure by some 40 feet. I think that those two descriptions discrepancies help us but at the present time I'm not going to address either the exemption or the amended exemption because the other five items I think I have to have information on and agreement and elimination if possible before I tackle the re-division of the property. I have prepared a short summary including a boundary agreement that I will give you and as I say, I tried to start this last November. I was diverted the last meeting I had with the County offrcial was real quick, "is that what you want to know - that's a legal question - we can terminate right now" thank you, boom - that was it. No cooperation whatsoever. As I say I have prepared a short symposia of all these problems and I will give that to you right now. Do you have any questions? Commissioner Houpi-i t rro* that you've been in contact with our staff and so my questions would be geared toward them as to whether or not there's a response, some understanding of where we are in the process of some of the issues that have been raised Louis Buettner - a boundary agreeme-nt shouldn't require staffother than to saythey don't know where that is. I have contracted 2 of fhe Commissioners and I have received no response from them as to setting up a meeting one on one so as to clear up all their questions. What type of inspection there was performed on the road or what the plans for - been unable to locate any plans for the construction of the road but the property is being flooded and erosion is taking place - 4 years of erosion that is not required for my client to suffer. I would like to see a red flag put on this so your staffwill immediately repay - we have bent over backwards - we have been instructed by a lawyer to go out and fence off the Crouch and if necessary put a big boulder out there - this I think would be reckless endangerment and I have talked to Ms. Crouch and said don't do that but if it's necessary, legal counsel has told u to do that. Commissioner Houpt - understands he is very frustrated and can see the outline of issues. Louis Buethrer - has one more document and it includes a boundary agreement - it's a legal document. Commissioner Houpt - we'll give it to the County Afforney. Commissioner McCown - the County Surveyor is not a staffperson and does not work for us per se and we do not have the ability to direct him to do anything. If there is a need we can hire a private surveyor but what we need from you is a brief summary atthe end of the day and at the end of this process what are you wanting. Louis Buettner - a brief summary - I would like the 1913 road to be abandoned and before we can abandon it we must agree on where it is. I would like to have the record documents that the state statutes 1973 and 1963 require to be on record and either the County Surveyor's office or with the County Clerk if there is no County Surveyor's office; the Garfield County Surveyor section corner 1920,1929 and 1930. Can't address exemption plat - it was never recorded - I have documentation that states that the exception plat was signed and delivered to the County. That's the last time that we have any record of that plat. It was never recorded. The exemption amended plat - title doesn't mean anything -I don't know if it's truly amended to the exemption or if that was recorded or not but the land transfers made by that plat, permitted by that plat voidable. The Sun Mesa burden on the Crouch property for access Lot2l should never have happened, from reading the code -thut uti p-p.rties are to have public access .. I have mffiy, many responses where the Coturty doesn't know where 162 is and in fact I have a letter between a lawyer and her client talking about 162being600 feet or more from the east line of the Crouch property. The construction on the road into Sun Mesa and the Stiring PUD's has been before the Board in 2003 - no response. The construction is such that it floods and causes erosion on the Crouch property - those are the 7 items that I have identified and they are on this summary information that I have once more. Pursuant to correspondence of the BOCC dated June B, 2007, the County Surveyor and Commonwealth Title have been requested to provide certai-n information to the BOCC in order that they may proceed in consideration of the issues you and your representatives presented. At this ti-me, they have received a reiponse from Commonwealth Title. On June 22, 2007,, Dean Hubbell of Commonwealth Title, rendered a written opinion concerning your property as follows: "It is my opinion that the property is current.ly vested in Martha Adrienne Crouch subject to pri-or mineral reservations and conveyances to the County." From his title work, Mr. Hubbell discovered a 1913 conveyance to the Board of County Commissioners of Garfield County, Colorado by George Blue for road or right-of-way purposes. Additionally, he discovered the conveyance from yourseJ-f to Garfield Cgunty, al-so for road and right-of-way purposes. There are no other conveyances to Garfiel-d County in your chain of tit1e. I have attached a copy of the 1913 Deed to Board of County Commissioners of Garfield County, Colorado, as well as the plat of the subject roadway. That Deed combj-ned with the plat on file with the Clerk appears to establish a County right-of-way firmly and completely, absent vacation of that road. The only vacation of record, appears to be the smal1 portions of the right-of-way vacated in 2002 for your benefit and at your request and accomplished at the same time. That property was conveyed by you to the County to relocate the County Road. Therefore, tfre deeaed, surveyed and platted roadway Adrfenne Crouch JuIy 6, 200? Page 2 continues to exiSt. As SuCh, this roadway encumberS your property with a right-of-way in the nature of an easement, as described and platted. At this time, the BOCC has not directed that the County Srrrreyor establish t.he course and location of this road and right- of-way on your property In earl-ier correspondence, you and Mr. Buettner have referred t.o a document recorded at. Reception No. 22185 . Furt.her research by this office and the Office of the Garfield County Clerk and Recorder revealed that document is recorded in the County Road Books. A copy of that document is. attached hereto. You will- note from the commenLs set forth on that document, the Clerk and Recorder's Office has been unable to find the plat of the roadway set forth in that report. Nevertheless, the general description of the property that is taken from private owners for the benefit of this road appears to locate this road substantially to the north of your property. Therefore, it does not appear that the roadway established under this road viewers report is one that would encumber your interests. The t.itIe work by Mr. Hubbel1 also indicated that a plat map was recorded in your chain of title on December 2, 2002. Although not described in his research, f believe that plat map is the Amended Exemption Pl-at for the Crouch Exemption. That document was prepared by your representatives, filed with your signature and was premlsed upon your request to split your property based on the existence and location of County Road L62. In substantial part, the location of County Road L62, as you represented on that recorded pIat, coincides to a remarkable degree to the location of the County Road described and platted in 1913. In the southern portion of your property, the road that you portray as a County Road on the exemption plat diverges from the described and platted 1913 County Road and exits your property at its southern boundary. The title work from Mr. Hubbell- did not reveal a deed or other dedication document for that portion of County Road L62t that digresses from the 1913 description in the southern extremity of your property. However, that portion of the roadway that you iep.esented as County Road 152, appears to have been used for many years as a public road providing access to property at your southern boundary. To the extent there j-s a divergence between the existing road and the described and platted 1913 road, it would appear that there may be two lega11y existing right-of-ways across your property.
