A RESOLUTION CONCERNED WITH A LOCATION AND EXTENT APPLICATION FOR
ROARING FORKWATER AND SANITATION DISTRICT TO CONSTRUCT WATER AND
SA}.IITATION INFRASTRUCTURE IMPROVEMENTS TO PROVIDE SERYICE TO TIIE
RE-l SCHOOL AT EASTBANK

Recitals
A. Garlield County is a legal and political subdivision of the State of Colorado for which the
Board of County Commissioners is authorized to act.
B. Pursuant to law, the Board of County Commissioners of Garfield County has appointed
the Garfield County Planning Commission (the Commission) to act on its behalf.
C. The Roaring Fork Water and Sanitation Disuict (the Applicant) applied to the Commission
pursuant to File No. LAEA-06-16-8468 for a Location and Extent Review for infrastnrcture
improvements to provide service to the RE-l School located between SH 82 and the Roaring Fork
River at CR 154 on Lot l, Eastbank.

D. The proposed infrastructure will be extended from the north end of the konbridge PUD for
instaliation in the CR 109 and CR 154 Rights-of-Way, and the Hardwick Bridge Parcel No. 2185-
353-00-060.
E. Pursuant to Section 4-11 I (C) of the Garfield County Land Use and DeveloPment Code,
as amended, and C.R.S. $ 30-28-110(lXa) the District required to submit an application to the
planning commission that has jurisdiction over the territory in which the improvements are
proposed to be located for review and comment. Comments shall be provided regarding whether
the proposed improvement are in general conformance with the County's ComFrehensive Plan of
2030, as amended (the Comprehensive Plan). Pursuant to C.R.S. S 30-28-ll0 whenever any' county planning commission has adopted a master plan of the county, no public utilities, whether
publicly or privately owned, shall be constructed or authorized in the unincoqporated territory of
the county county until and unless the proposed location and extent thereof has been submitted to
and approved by such county.
F. In accordance with state law, the Commission has adopted a Master Plan. The Master Plan
applicable to this review is the Garfield County 203 Comprehensive Plan, as amended.
G. The Commission opened a public hearing on July 13,2016 upon the question of whether
the proposal is in general conformance with the Comprehensive Plan.
H. The Commission closed the public hearing on July 13,2016 to make a decision on the
request.
I. The Commission, on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determinations of fact:
1. That proper public notice was provided as required for the hearing before the Planning
Commission.
2. That the hearing before the Planning Commission was extensive and complete, that all
pertinent facts, matters and issues were submitted or could be submittqd and that all
interested parties were heard at that hearing.
That for the above stated and other reasons, approval of the Location & E:rtent request by
the Roaring Fork Water and Sanitation District for infrastructure improvements related to
the provision of water and sanitation services north of the konbridge PUD is in the best
interest of the health, safety, and welfare of the citizens of Garfield County.
That the [.ocation and Extent request has been determined to be in general conformance
with the Comprehensive Plan 2030, as amended.
That the l.ocation and Extent request is in conformance with the Review Criteria contained
in Section 4-111, Location and Extent of the Garfield County Land Use and Development
Code, as amended.

their Application submittal and at the public hearing before the Planning Commission.
RESOLUTION
NOW, THEREFORE, BE IT RESOLYED by the Planning Cornmission of Garfield County, as
foUows:
A. The foregoing Recitals are incorporated by this reference as part of the resolution.
B. Exhibit A describes the Iocation of the proposed infrastructure improvements.
C. The Location and Extent request for the infrashucture improvements for provision
of water and sanitation service north of the Ironbridge P{JD is hereby approved subject to the
following conditions of approval:
1. That all representations made by the Applicant in the Application shall be
conditions of approval unless specffically altered by the conditions of approval contained
herein.
2. That the District shall obtain all required federal, state and local permits required
for installation of the infrastructure.
