Please consider thls letter a formal request for a 12-month ertension of the SUp Approvalfor
the S'Mile Ranch Gravel Plt (formatly known as t'he RTZ Gravel Pft). Elam ls diligently worklng
wlth varlous agencles, departments, dlvlsions withln the State of Colorado, as well as Garf,eld
County. Thls request ls to allow Elam adequate tlme to address al! aspects of the Special Use
Permlt condltlons stated wlthln the Resolution 2fi)$52, along with tire subsequent extenslons.
At thls time Elam ls in the review process forthe Dlvision of Reclamation, Mlning and Safety
IDRMS). This typlcally takes 90 days for this process. Elam ls also seeklng other ippllcable
permlts pertainlng to the 5 Mile Ranch Gravel Pit. We feel optlmistic about the tlmeframe ln
whiclr all required permits wlll be set ln ptace. We hope for an early Zotl commencement date.

Elam Construction, Inc. as lessees of a portion of the property owned by S-Mile Ranch,
LLC requests the Board of County Commissioners (the Board) approve a requested one-
year extension to satisfy the conditions of approval of the Land Use Change Permit.
The Board conditionally approved a request for "Extraction, Processing, Storage and
Material Handling of a Natural Resource" to allow for a gravel extraction operation to occur
on a 130.5-acre portion of a 1,200-acre property. The approval was granted at a public
hearing held on Monday July 13, 2009 and memorialized in Resolution 2009-52, EXHIBIT
E. The conditions of approval adopted by the Board include:
2. This approval shall expire if the Special Use Permit has not been issued within one year of the date of approval
of the application. The Special Use Permit shall expire fifteen (15) years from the date of issuance. If mining
operations have not ceased and reclamation of the site has not been completed to the satisfaction of Garfield
County and the DRMS, the Applicant may request dn extension of the permit be granted by the Board of
County Commissioners.

Conditions of approval required by the Board have not yet been satisfied therefore the
Applicant has requested a sixth extension to allow for an additional one-year period of time
to satisfy the conditions of approva!, until July 13,2017, EXHIBIT C. Pursuant to $4-101 l.
of the 2013 Land Use and Development Code, as amended:
I. Extension of Conditional Approval.
It is the Applicant's responsibility to timely satisfy any conditions of approval. Prior to the
expiration of a conditiona! approval, however, the Applicant may request an extension of
the expiration date as follows:
Supporting Documentation. Application shall be made to the decision maker
that issued the original approval and shall include a written explanation of
the reasons why the conditions have not been met and the estimated
timeframe in which the conditions will be met or completed.
First Extension.
Extensions of 1 year may be granted for all condltiona! Land Use
Change approvals, and Subdivision or Conservation Subdivision
Preliminary Plan approvals.
Exemptions and Final Plat approvals may be extended by a period of
90 days.
Additional Extensions. Requests for longer periods of time, or additional
time extensions following the first extension, shall be made to the decision
maker that issued the original approva!, prior to the expiration of the current
approval.
New Application Required. !f an Applicant fails to timely request an
extension as setforth in section 4-101.1., the approval will be void and the
Applicant must submit a new application for the desired Land Use Change
or division of land approval notwithstanding the foregoing, the BOCC may
grant an extension of an otherwise expired approval upon a finding by the
BOCC that the failure to file for an extension was due to extenuating
circumstances and that it benefits the public interest to grant the extension.
Statf recommends that the Board grant the requested one-year e)dension to allow for an
additional year to complete the condition of approval required by Resolution No. 2OO9-52
for the S-Mile Ranch Gravel Pit. Should the Board approve this request a Draft Resolution
is included as Exhibit K which would require satisfaction of conditions and issuance of the
