t.BACKGROUND AND REQUEST
On Monday, July 21, 2008, the Board
of County Commissioners (the Board)
approved a Preliminary Plan
Application for the Oak Meadows
Ranch PUD, Filing 4, Phase lll,
memorialized in Resolution 2008-95,
attached as Exhibit C. The Preliminary
Plan approval was granted to subdivide
a 44.67-acre property within the Oak
Meadows PUD into 25 residential lots,
common area and quasi-public area.
This approval provided the Applicant,
Oak Meadows lll, LLC, 1 year to file a
final plat application to Garfield County.
On August 3, 2OO9 the Board approved
a request to extend the validity of the
Preliminary Plan to July 21 , 2010 by
Resolution 2009-59, attached as
Exhibit D.
A second request was received from an investment group that acquired the propedy
through foreclosure. That request was to extend the Preliminary Plan for two (2) years
however the Board approved the extension for one (1) year thus the expiration of the
Preliminary Plan was set for July 21, 2011. This Board action was memorialized in
Resolution 2010-47, attached as Exhibit E.
Oak Meadows Ranch Filing 4 Phase lll
Preliminary Plan Extension - July 5, 2016
A third request was received to extend the Preliminary Plan for an additional two (2)
years, which the Board approved and memorialized in Resolution 201 1-38. Expiration of
the preliminary plan was extended to July 21 ,2013, attached as Exhibit F.
A fourth request was received to extend the Preliminary Plan for an additional two (2)
years, which the Board approved and memorialized in Resolution 2013-39. Expiration of
the preliminary plan was extended to July 21 ,2015, attached as Exhibit G.
A fifth request was received to extend the Preliminary Plan for an additional two (2)
years, and the Board approved a one year extension memorialized in Resolution 2015-
36. Expiration of the preliminary plan was extended to July 21 ,2016, attached as Exhibit
H.
A sixth request'has been received to extend the Preliminary Plan for an additiona! one
(1) year, see Exhibit B.
The property owners, John C. Richert for Terrix Financial Corp., Ethan A. Jacobson, and
Emerald lsle Lending Company, request the Board grant an additional 1-year extension
to the Preliminary Plan which would expire on July 21,2017.
II. AUTHORITY
Section 4-101(l) of the Unified Land Use Resolution of 2008, as amended, the "ULUR', requires
the Applicant seek an extension prior to expiration of a Division of Land apprwal, specifically the
ULUR states:
l. Extension of Approval.
Prior to the expiration of a Land Use Change Permit or Division of Land approval, the
Applicant may request an extension of the expiration date as follows:
1. Application shall be made to the decision maker that issued the original
approval.
2. Extensions of 1 year may be granted for all Land Use Change Permits and
Division of Land approvals, except Final Plats, which are limited to a 90-
day extension.
3. Requests for longer periods of time, or additional time extensions following
the first extension, shall be made to the BOCC prior to the expiration of the
current approval.
4. lf an Applicant fails to request an extension prior to expiration of the
approval, the approval wil! be void and the Applicant must submit a new
application for the Land Use Change Permit or Division of Land approval.
III. BOCCCONSIDERATION
The Board has the option to extend the timeframe in which to submit a final plat pursuant
to the LUDC and Preliminary Plan requirements.

Recitals
A. Garfield County is a legal and political subdivision of the State of Colorado for
which the Board of County Commissioners (Board) is authorizedto act.
B. On the 5ft day of Jlly,2016, the Board of County Commissioners opened a public
meeting upon the question of whether a two-year extension to file a Final Plat should be
granted, granted with conditions, or denied at which meeting the public and interested
persons were given the opportunity to express their opinions regarding the issuance of said
extension.
C. The Board of County Commissioners acted on the basis of substantial competent
evidence produced at the aforementioned meeting.
D. The Preliminary Plan for the "Oak Meadows Ranch PUD, Filing 4, Phase III'
subdivision was approved by the Board on July 21,2008 under Resolution No. 2008-95 for
real property described in the document recorded at Reception Number 735652 in the records
of the Clerk and Recorder, Garfield County, Colorado.
E. In accordance with the Garfield County Land Use Resolution of 2008, as amended,
and the Preliminary Plan approval the for the "Oak Meadows Ranch PUD, Filing 4, Phase
III" subdivision, the Applicant was required to file a Technically Complete Final Plat
application prior to July 21,2009.
F. The Board of County Commissioners considered a one-year extension of the
Preliminary Plan at a Public Meeting held on August 3,2009 and approved the extension to
file a Technically Complete Final Plat application to July 21"t, 2OlO as memorialized in
Resolution 2009-59.
G. The Board of County Commissioners considered a second request for extension of
the Preliminary Plan at a Public Meeting held on June 14, 2010 and approved the extension
to file a Technically Complete Final Plat application to July 21't,2011 as memorialized in
Resolution 2Ol0-47.
H. The Board of County Commissioners considered a third request for extension of

parties were heard at that hearing.
D. The requested extension is in the best interest of the health, safety and welfare of the
citizens of Garfield County.
