In 2008, the Board of County Commissionus for Guficld County ("BOCC") approved the Preliminary Plan for the lronbridge, Phase III subdivision under Resolution No, 2008-42. The Preliminary Plan approval roquirod the Applicant to file a Technically Complete Final Plat application prior to March 10, 2009 (the expiration of said approval), unloss extonded. The Applicant has obtained several extensions of the Preliminary Plan approval for lronbridge, Phase III. Most recently, the Applicant obtained an extension to submit a Technically Complete Final Plat application'under Resolution 20ll-09 that expired on March 10, 2013. The Applicant only recently discovercd that this expiration date lapsed without obtaining an additional extension. By letter dated April 18, 2013, the Applicant requcstod an exemption fiom scction 4-101.I.4 of tho prior Garfiold County Land Use Code for an cxtension of prcliminary plan approval for Ironbridge, Phase tII (the "Original Request for Extension"). Shortly thereafter, Garfiold County roviswod and considered amendments to the land use code that would affeqt the Applicant's Original Roquest for Extension. Applicant attended several hearings with the BOCC regarding such amendments. County staff directed Applicant to withdraw its Original Request for Extension pcnding final approval of amendments to the land use code, On July 15, 2013, the BOCC approved the land use code amendments, including those amended section 4-101.I.4. Accordingly, the purpose of this letter is to request approval fiom the BOCC for sxtension of Preliminary Plan approval for lronbridge, Phase III pursuant to Oarfield County Land Use Code Section 4-101.I., which states: 4, New Application Required. If an Applicant fails to timely request an extonsion as set forth in section 4-101.I,, the approval will be void and the Applicant must submit a new application for the desired Land Use Changc or KARP NEU HANLON, P.C. Page2 division of land approval notwithstanding the foregoing, the BOCC may grant an extension of an otherwise expired approval upon a finding by the BOCC that the failure to file for an extension was due to extenuating circumstances and that it benefits the public interest to grant the extension. Herc, the existence of numerous extenuating cirqumstances warrant an extension of the Preliminary Plan approval for lronbridge, Phase III. Further, dre public interest will be served by such an cxtension. The Applicant is a banlaupt entity ourrently under Chapter 1l bankruptcy in the Unitod States Bankruptcy Court of the Southem District of Now York, Case No. 08-13555. The Applicant has not been in a financially viable position in which to complete the development of Ironbridge, Phase III. Pursuant to the bankruptcy, the Applicant has the Ironbridge property for sale. Given the precarious state of the Applicant, it has simply not had the resources in which to develop Phase III; however, the Applicant seeks to maintain the Preliminary Plan approval for the property. Further, the Preliminary Plan approval has only recently lapsed. My firm did not rtpresent the Applicant when it obtained the most recent Preliminary Plan approval extension. Upon change of counsel, notice was nol provided of the pending approval expiration. When the expimtion was discovered, we immediately contacted the Garlield County Community Development Department as desqribed above in this letter. [n regard to public intercst, obtaining an extension of the Preliminary Plan approval for Phase III will help facilitate more rapid development of this property once a change in ownership occurs. In addition, approval would avoid foes for public hearings and review of a project that is unchanged. The public would be best served by such an outcome. As a rcsult, wc rtspectfully request that the BOCC grant the Applicant's rcquost and, pursuant to Land Use Code Seotion 4-101.I.4, extend the Preliminary Plan approval for lronbridge, Phase III for two (2) years. The Applicant's request demonstrates extenuating circumstances which resulted in expiration of the Preliminary Plan including: o The Applicant is a bankrupt entity;. Change in legal representation did not include notice of pending expiration. The Applicant seeks a two-year extension of the lronbridge Phase lll Preliminary Plan which, if granted, would expire on March 10,2015. BACKGROUND The Board granted Preliminary Plan approval for this subdivision on March 10, 2008, Resolution No. 2008-42 (Exhibit D), with a one year timeframe in which the final plat application must be accepted as complete by the Community Development Department. Prior to the expiration the owner requested the Board extend the Preliminary Plan for a one year period and the Board, in a Public Meeting held on March 2,2009, extended the approva! to March 10, 2010. A second request for extension was approved by the Board in a Public Meeting held on June 7, 2010, Resolution 201044 (Exhibit E), which granted a one year extension, until March 10,2011. A third request for extension was approved by the Board in a Public Meeting held on February 7,2011, Resolution 2011-09 (Exhibit F), which granted a two year extension until March 10,2013. A technically complete final plat was not received, nor was a request made to extend, prior to the expiration of the Preliminary on March 10,2013. BOCC 8t5t2013 KE II. AUTHORITY Section 4-{01 l. Extension of Conditional Approval. !t is the Applicant's responsibility to timely satisfy any conditions of approval. Prior to the expiration of a conditional approva!, however, the Applicant may request an extension of the expiration date as follows: Supporting Documentation. Application shall be made to the decision maker that issued the original approval and shall include a written explanation of the reasons why the conditions have not been met and the estimated timeframe in which the conditions will be met or completed. First Extension. Extensions of 1 year may be granted for all conditional Land Use Change approvals, and Subdivision or Conservation Subdivision Preliminary Plan approvals. Exemptions and Final Plat approvals may be extended by a period of 90 days. Additional Extensions. Requests for longer periods of time, or additional time extensions following the first extension, shall be made to the decision maker that issued the original approval, prior to the expiration of the current approval. Garfield County is a legal and political subdivision of the State of Colorado for which the Board of County Commissioners (Board) is authorized to act. B. The Board considered a two year extension of the Preliminary Plan at a Public Meeting held on August 5,2013 and found that extenuating circumstances did exist in the failure to request the necessary extension and that an extension would benefit the public interest. The forgoing Recitals are incorporated by this reference as part of this Resolution. B.
