Recitals
A. Garfield County is a legal and political subdivision of the State of Colorado for
which the Board of County Commissioners (Board) is authorized to act.
B. On 4TH day of May, 2015, the Board considered whether a request to extend the
90 -day timeframe in which the Applicant is required to satisfy conditions of approval and
record a final plat should be granted, granted with conditions, or denied at which meeting the
public and interested persons were given the opportunity to express their opinions regarding
the issuance of said extension.
C. The Board of County acted on the basis of substantial competent evidence
produced at the aforementioned .meeting.

D. The request for the Minor Subdivision of the 22.65 -acre site was approved by
the Board on the 17th day of February, 2015 and memorialized in Resolution No. 2015-12
for real property owned by Wayne and Lois Vagneur as described in the records of the
Clerk and Recorder, Garfield County, Colorado.
E. In accordance with the 2013 Garfield County Land Use and Development
Code, as amended (LUDC) the Applicant was required to satisfy conditions of approval
and obtain a Land Use Change Permit prior to May 18, 2015.
F. In accordance with the LUDC the Applicant filed a request for an extension of
the timeframe for the Vagneur Minor Subdivision.
Resolution
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Garfield County, Colorado, that:
A. The forgoing Recitals are incorporated by this reference as part of this Resolution.
B. The request for extension of the timeframe to satisfy conditions of approval and
record a final plat is consistent with the requirements of the LUDC.
C. The public meeting before the Board of County Commissioners was extensive
and complete; all pertinent facts, matters and issues were submitted; and all
interested parties were heard at that hearing.
D. The granting of a one-year extension to satisfy conditions of approval and record
a final plat is in the best interest of the health, safety and welfare of the citizens of
Garfield County.
E. A motion was made to approve the requested six-month extension to satisfy
conditions of approval until February 17, 2015. The motion was approved by a
vote of 3-0.

Re: Vagneur Minor Subdivision Extension Request
Dear Commissioner Martin:
On May 18, 2015, 90 days will have passed since the approval of the Vagneur Minor Subdivision per
resolution 2015-12. Lois and Wayne Vagneur request a six-month extension to complete the conditions of
approval for their Minor Subdivision. Attached for your reference is a copy of the recorded Resolution No.
2015-12.
The following is an update to the BOCC regarding the conditions of approval that need to be addressed in
Resolution No. 2015-12 prior to the recording of the Vagneur Minor Subdivision:
a. A plat mylar with signed Certificates that include Dedication and Ownership, Title, Taxes,
Surveyor, and any mortgagees;
The Applicant is currently preparing the plat for signatures.
b. Improvements Agreement, and associated collateral, as approved by the County
Attorney's office;
The Vagneur Minor Subdivision proposed improvements include improvements to Flying
Fish Road to meet Garfield County road standards, and the installation of a shared water
system for the three lots. Lois and Wayne Vagneur are implementing the improvements to
Flying Fish Road, and are applying for individual well permits for all three lots rather than
sharing a well. Once the well permits are in place, the Vagneurs plan to drill a well on Lots 1
and 3, and complete water quality and pump tests per Garfield County requirements. Rather
than providing collateral and an Improvements Agreement to Garfield County for these
improvements, Lois and Wayne Vagneur plan to complete the improvements within the six-
month extension period.
c. Covenants, Condition and Restrictions, as approved by the County Attorney's office;
A Draft of the Vagneur Minor Subdivision Covenants, Condition and Restrictions has been
provided to the County Attorney's office and refinements are being coordinated.

d. A Well Sharing Agreement, as approved by the County Attorney's office; and
As mentioned above, Lois and Wayne Vagneur are applying for individual well permits for
all three lots rather than sharing a well. Once the well permits are in place, Lois and Wayne
Vagneur plan to drill a well on Lots 1 and 3, and complete water quality and pump tests per
Garfield County requirements. Because an individual well will be provided on each lot, a
Well Sharing Agreement is not required.
e. Recording Fees.
Recording Fees will be provided to Garfield County at the time of recording.
While substantial progress has been made per the above update, Lois and Wayne Vagneur request a six-
month extension to complete the conditions of approval for the Vagneur Minor Subdivision. Please do not

Recitals
A. An application for Administrative Review of a Minor Subdivision application was
submitted for a property described in a Warranty Deed recorded at Reception Number 394389 in
the office of the Garfield County Clerk and Recorder (the Vagneur Parcel).
B. The Director of Community Development is authorized to approve, deny or approve
with conditions a Minor Subdivision application resulting in issuance of' a Land Use Change
Permit pursuant to the 2013 Land Use and Development Code, as amended (LUDC).
C. Prior to issuance of a Director decision, the Director of Community Development
called up the application to a public hearing before the Board of County Commissioners (the
Board) due to the requirement for public improvements in the subdivision which the Board must
authorize pursuant to the LDDC.
D. A public hearing was scheduled before the Board pursuant to Section 4-112 of the

E. The Board opened a public hearing on the 12th day of January, 2015 for consideration
of whether to approve, approve with conditions or deny the request for a Minor Subdivision and
Improvements Agreement, based upon compliance of the proposal with the applicable standards
and criteria required by the LUDC. The public and interested persons were given the
opportunity to express their opinions regarding the request at this hearing.
F. The Board closed the public hearing on 12t day of January, 2015 to make a final
decision.
G. The Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determinations of fact:
1. That proper public notice was provided as required for the hearing before the
Board of County Commissioners.
2. That the hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that hearing.
3. That for the above stated and other reasons, and upon compliance with conditions
of approval, the request for a Minor Subdivision of the Vagneur Parcel is in the best
interest of the health, safety, convenience, order, prosperity and welfare of the
citizens of Garfield County.
4. That, upon compliance with adopted conditions of approval, the application is in
general conformance with the 2030 Comprehensive Plan, as amended.
5. Tbat, upon compliance with adopted conditions of approval, the application bas
adequately met the requirements of the Garfield County 2013 Land Use and
Development Code, as amended.

1. All representations of the applicant within the application and public hearing shall be
considered conditions of approval unless otherwise modified by the Board of County
Commissioners.
2. No further subdivision of these parcels is permitted by Minor Subdivision application.
3. Prior to BOCC signature on the Plat the Applicant shall provide Fee In -Lieu of School Land
Dedication in the amount of $1,104.33 made payable to the Garfield County Treasurer.

REQUEST
Wayne and Lois Vagneur requests the Board of County Commissioners (the Board) grant
a six-month extension to the 90 -day timeframe to record the final plat as required by the
Board in Resolution 2015-12 and Section 4-101 H. (3) of the Garfield County Land Use
and Development Code, as amended (LUDC).
Section 4-101 I. (1.) of the LUDC allows an Applicant to request extension of a
Conditional Approval upon demonstrating the reasons why the conditions have not met
and estimating the timeframe necessary for completion. The Applicants are requested a
six-month extension, until November 18, 2015.
11. BACKGROUND
The Board granted conditional approval for the minor subdivision of the site into three
parcels at a public hearing on Tuesday, Februaryl7, 2015, and a resolution (2015-12)
was subsequently recorded.
Prior to the expiration of the approval the Applicant requested the Board consider a six-
month extension to the timeframe to satisfy conditions of approval and record the final
plat.

III. AUTHORITY
Section 4-101
I. Extension of Conditional Approval.
It is the Applicant's responsibility to timely satisfy any conditions of approval. Prior to the
expiration of a conditional approval, however, the Applicant may request an extension of
the expiration date as follows:
1. Supporting Documentation. Application shall be made to the decision
maker that issued the original approval and shall include a written
explanation of the reasons why the conditions have not been met and the
estimated timeframe in which the conditions will be met or completed.
2. First Extension.
a. Extensions of 1 year may be granted for all conditional Land Use
Change approvals, and Subdivision or Conservation Subdivision
Preliminary Plan approvals.
b. Exemptions and Final Plat approvals may be extended by a period
of 90 days.
3. Additional Extensions. Requests for longer periods of time, or additional
time extensions following the first extension, shall be made to the decision
maker that issued the original approval, prior to the expiration of the current
approval.
4. New Application Required. If an Applicant fails to timely request an
extension as set forth in section 4-101.1., the approval will be void and the
Applicant must submit a new application for the desired Land Use Change
or division of land approval notwithstanding the foregoing, the BOCC may
grant an extension of an otherwise expired approval upon a finding by the
BOCC that the failure to file for an extension was due to extenuating
circumstances and that it benefits the public interest to grant the extension.
IV. BOARD CONSIDERATION
The Board may consider an extension to the timeframe to satisfy conditions of approval
and record the final plat for the Vagneur Minor Subdivision. Should the Board approve
this request a Draft Resolution with a six-month extension to November 18, 2015 is
included as Exhibit D.

C. The public meeting before the Board of County Commissioners was extensive
and complete; all pertinent facts, matters and issues were submitted; and all
interested parties were heard at that hearing.
D. The granting of a six-month extension to satisfy conditions of approval and record
a final plat is in the best interest of the health, safety and welfare of the citizens of
Garfield County.
E. A motion was made to approve the requested six-month extension to satisfy
conditions of approval until November 18, 2015. The motion was approved by a
vote of 3-0.
