ATTN: Scott Aibner 110 E. 3rd Street #213 Rifle, CO 81650 Garfield County Community Development Department RE: Amended Final Plat Parcel 5, Robinson Subdivision Exemption and Parcel A of the Subdivision Exemption Approved by Resolution No. 81-50 (File No. FPAA-01-16-8416) Dear Scott: This letter is in regard to the Application you filed on behalf of Ed and Sheila Allen and Cecil Phillips and Janice Barlow for an amended Final Plat for Parcel 5 of the Robinson Subdivision Exemption and Parcel A of the subdivision exemption approved by Resolution No. 81-50 also known as the Meeks Exemption. The properties are known by Assessor's Parcel Numbers 2127-301-00-213 and 2127- 301-00-196. The Application has been reviewed in accordance with the Administrative Review procedures contained in the Land Use and Development Code as amended. Said provisions require a decision by the Director of the Community Development Department on whether to approve, approve with conditions, or deny the request. The Director's Decision is hereby issued approving your Application for an Amended Final Plat of Parcel 5, Robinson Subdivision Exemption and Parcel A of the Subdivision Exemption Approved by Resolution No. 81-50, with a finding that the application meets the requirements of the Garfield County Land Use and Development Code as amended including the Amended Plat Review Criteria contained in Section 5-305 and subject to the following conditions: 1. That all representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. The Plat including signature blocks and plat notes shall be subject to final review and approval by the County Attorney's Office prior to submittal of the plat for final execution. 1 3. Plat notes shall be required indicating the purposes of the amended plat and that all previous plat notes set forth on the Robinson Subdivision Exemption Plat shall remain in effect. 4. The Applicant shall record prior to and concurrently with the filing of the amended plat two quit claim deeds resolving a deeded overlap associated with Parcel A and an ownership and access issue for Parcel 5. The documentation and deeds shall be subject to review and acceptance by the County Attorney's Office prior to recording. The deeds are further described as follows: a. A quit claim deed on Parcel A, that will resolve a technical survey issue associated with a deeded overlap at the northwest corner of Parcel A with the adjoining property owners David and Cynthia Powers. The surveyor's statement of record explaining the purpose of the quit claim deed shall be recorded with the quit claim deed. b. A quit claim deed on Parcel A, that will resolve an ownership and access issue north of Parcel 5 immediately adjacent to the County Road. The quit claim deed will convey to Edwin and Sheila Allen that portion of Parcel A that lies between the Allen Property, Parcel 5 and the County Road. The Land Use and Development Code requires notification to the Board of County Commissioners for their review and potential call-up of the Director's Decision. The Board review is for a period of 10 calendar days commencing on the date of the Director's Decision. The call-up period shall expire on April 10th. The Amended Final Plat will be scheduled on the Board of County Commissioner's consent agenda after expiration of the call-up period and once all conditions of approval have been satisfied including editing of the plat and acquisition of all necessary signatures. Please note that you will have 90 days from the date of approval to submit a plat suitable for recording. Extensions of this time period may be requested prior to the expiration of the original time limit.
