1. THIS PROPERTY IS SUBJECT TO RESERVATIONS, RESTRICTIONS,

2. DATE OF THIS SURVEY WAS MARCH AND APRIL 1996.
3. BASIS OF BEARINGS FOR THIS SURVEY IS A BEARING OF N 88'08'24" W,
BETWEEN THE SOUTHWEST CORNER OF SECTION 1, A BLM BRASS CAP AND
THE NORTH QUARTER CORNER OF SECTION 12, A BLM BRASS CAP. BOTH
FOUND IN PLACE.
4. THIS SURVEY IS BASED ON EXISTING SECTION CORNERS AND PROPERTY
CORNERS FOUND IN PLACE AS SHOWN, A PLAT OF J.V. ROSE PROPERTY
(TAYLOR RANCH) AS PREPARED BY SCARROW & WALKER, DATED JUNE
1967 AND DOCUMENTS OF RECORD.
5. BEFORE A BUILDING PERMIT IS ISSUED FOR ANY HOUSING UNIT A
$750.00 IMPACT FEE FOR THE R.F.T.A. IS TO BE PAID TO THE
COUNTY BUILDING AND PLANNING DEPARTMENT.
6. ALL STURCTURES IN THE ROSE RANCH P.U.D. SHALL HAVE ENGINEERED
FOUNDATIONS. BASEMENTS WILL ONLY BE ALLOWED WHERE SAFE, AS
DETERMINED BY A QUALIFIED GEOTECHNICAL ENGINEER.
7. XERISCAPE LANDSCAPING IS REQUIRED ON ALL LOTS LOCATED IN THE
HISTORICALLY NON -IRRIGATED AREAS SHOWN ON THE PLAT.
8. PRIOR TO ANY EXCAVATIONS, ALL UTILITY COMPANIES SHALL BE NOTIFIED
FOR A FIELD LOCATION OF THEIR RESPECTIVE UTILITIES.
9. NO WOOD BURNING OR SOLID FUELED FIREPLACES OR STOVES WILL BE ALLOWED
EXCEPT FOR TWO OPEN HEARTH FIREPLACES IN THE CLUBHOUSE BUILDING;
AND THERE WILL BE NO RESTRICTION ON THE NUMBER OF NATURAL GAS BURNING
FIRE PLACES OR APPLIANCES INCLUDED IN THE PROTECTIVE COVENANTS.
10. ONE DOG WLL BE ALLOWED IN EACH RESIDENTIAL DWELLING UNIT
IN THIS SUBDIVISION, THIS REQUIREMENT WILL BE INCLUDED IN
THE PROTECTIVE COVENANTS, AND WILL BE ENFORCED BY THE
HOMEOWNERS ASSOCIATION.
11, BEFORE A BUILDING PERMIT IS ISSUED ON ANY HOUSING UNIT, PROOF MUST
BE PROVIDED TO THE COUNTY THAT ALL REQUIRED FEES FOR A SANITARY SEWER
SERVICE HAVE BEEN PAID TO THE ROARING FORK WATER AND SANITATION DISTRICT.
12. AT OR PRIOR TO THE CLOSING OF ANY LOTS, A WAIVER OF CLAIMS AGAINST THE
COUNTY SHALL BE EXECUTED AND DELIVERED TO THE COUNTY FOR ANY CLAIMS
PERTAINING TO THE FOLLOWING:
A) HOMES WHICH WLL BE SUBJECT TO BREAKS IN THEIR FOUNDATIONS DUE TO
COLLAPSIBLE UNDERLYING GEOLOGY AND HIGHLY PERMEABLE SOILS AND THE EFFECTS
OF IRRIGATING THE GOLF COURSE HOLES AND THE LAWNS;
B) LINERS WHICH MAY BREAK WHEN A POND IS AT IT'S FULL WATER CAPACITY IF
DIFFERENTIAL SETTLEMENT OF SEVERAL INCHES OCCURS BENEATH THEM;
C) SEVERE HYDROCOMPACTIVE SOIL PROPERTIES WHICH ARE PROBLEMATIC FOR
ROADWAYS AND SLAB ON GRADE PAVEMENTS;
D) POTENTIAL GROUND SUBSIDENCE IN THE MAJORITY OF THE ALLUVIAL FANS WHERE
DEVELOPMENT IS PROPOSED RESULTING IN GROUND SUBSIDENCE, SINKHOLES, GROUND
FISSURING, AND PIPING SOIL DISSOLUTION; AND
E) POTENTIAL GROUND SETTLEMENT AND SUBSIDENCE IN THE RESIDENTIAL AREAS
SURROUNDING THE PROPOSED PONDS WITHIN THE ALLUVIAL FAN AREAS DUE TO SEVERE
WETTING OF THESE HYDROCOMPACTIVE SOILS BY THE PONDS.
13. THE SOLE PURPOSE OF THIS AMENDED PLAT IS TO MOVE LOT 127 BUILD ENVELOPE
FROM 20.0 FEET FROM THE PROPERTY TO 10.0 FEET FROM THE PROPERTY LINE
AS SHOWN.
