Authority. This application for a Building Permit must be signed by the Owner of the property, described above, or
an authorized agent. If the signature below is not that of the Owner, a separate letter of authority, signed by the
Owner, must be provided with this Application.
Legal Access . A Building Permit cannot be issued without proof of legal and adequate access to the property for
purposes of inspections by the Building Division.
Other Permits. Multiple separate permits may be requi red : (1) State Electrical Permit, (2) County OWTS Permit,
(3) another permit required for use on the property identified above, e .g. State or County Hi ghway/ Road Access or
a State Wastewater Discharge Permit.
Void Permit. A Building Permit becomes null and void if the work authorized is not commenced within 180 days of
the date of issuance and if work is suspended or abandoned for a period of 180 days after commencement.

understand that the Building Division accepts the Application, along with the plans and specifications and other
data submitted by me or on my behalf (submlttals), based upon my certification as to accuracy. Assuming
completeness of the submittals and approval of this Application, a Building Permit will be issued granting
permission to me, as Owner, to construct the structure(s) and facilities detailed on the submittals reviewed by the
Building Division. In consideration of the issuance of the Building Permit, I agree that I and my agents will comply
with provisions of any federal, state or local law regulating the work and the Garfield County Building Code, OWTS
regulations and applicable land use regulations (County Regulation(s)). I acknowledge that the Building Permit
may be suspended or revoked, upon notice from the County, if the location, construction or use of the structure(s)
and facility(ies), described above, are not In compliance w i th County Regulation(s) or any other applicable law.
I hereby grant permission to the Building Division to enter the property, described above, to inspect the work. I
further acknowledge that the issuance of the Building Permit does not prevent the Building Official from: (1)
requiring the correction of errors in the submittals, If any, discovered after issuance; or (2) stopping construction

RIGHT OF WAY AGREEMENT

KNOW ALL PERSONS BY THESE PRESENTS Benzel Land, LLLP ("Grantor", whether one or more),
for and in consideration of Ten and More Dollars ($10.00+) in hand paid, the receipt and sufficiency of which arc
hereby acknowledged and additional consideration paid pursuant to that certain Payment Agreement for Pipeline
Right-of-Way Grant and Release of Damages executed concurrently herewith, does hereby grant, convey and
warrant unto Grand River Gathering Company, LLC, its successors and assigns ("GRANTEE") a temporary
easement of up to forty-five feet (45') in width, in addition to a permanent easement of thirty feet (30') in width, for
the purpose of laying, constructing, maintaining, operating, inspecting, repairing, replacing, protecting, changing the
size of, and removing a pipeline or pipelines, fiber optic, electric lines and other appurtenances (including cathodic
protection equipment, valves, vents, test leads, fittings, drips, line markers, taps and other surface and subsurface
facilities appurtenant thereto), along with a one hundred foot by one hundred foot (100' x 100') valve site, for the
transportation of natural gas, hydrocarbons, and any other substances, whether fluid or solid, any products,
derivatives, combinations or mixtures of the foregoing upon and along a route to be selected by GRANTEE in
consultation with GRANTOR, on under and across lands of GRANTOR, situated in the County of Garfield, State of
Colorado, described as follows:
Township 6 South -Range 93 West of the 6111 P.M.

Together with an easement for restricted rights of ingress and egress to, from and along said pipeline and
facilities of GRANTEE on, over and across said lands and adjacent lands ofGRANTOR, and GRANTEE shall have
all privileges necessary or convenient for the full use and enjoyment of the rights herein granted.
GRANTEE may record this Right of Way Agreement attaching a plat as Exhibit "A" (incorporated herein
by reference) of the actual route of the facilities constructed hereunder and/or of the ingress/egress easement to
further identify the locations thereof.
GRANTEE shall bury the top of its pipelines at or below four feet in depth. GRANTEE shall restore the
land as soon as practicable after the pipelines are completed. Restoration shall be made as near as practicable to the
condition when GRANTEE first entered onto the land.
GRANTOR, their successors and assigns, reserves all oil, gas and minerals, if owned, on and under said
lands and the right to farm, graze and otherwise fully use and enjoy said lands, provided GRANTOR agrees not to
construct or create any obstruction, structure, or engineering work on the herein granted right of way that will
interfere with the rights and interests of GRANTEE herein granted, and provided further that GRANTEE shall have
the right hereafter to keep clear obstructions from the herein granted right of way and ingress/egress easement.
GRANTEE agrees to pay GRANTOR or any tenant, as their interests may appear, for actual damages to crops,
pastures, timber, livestock, fences and other improvements on said premises which may arise from exercise of the
rights herein-granted, provided GRANTEE shall not be liable for damages for future clearing of the right of way and
ingress/egress easement in exercise of the rights herein granted.
GRANTEE shall be liable for reclamation and damages resulting from a breach or spill. GRANTEE shall
continue to re-seed the field as necessary until grass has been established. GRANTEE shall also monitor and control
all weeds along the easement.
GRANTEE agrees to comply with all applicable state and local regulations.
GRANTEE shall indemnify, defend and hold bannless GRANTOR from any and all claims, demands,
causes of action, or liability for damages, loss or injuries that arise out of GRANTEE'S operations on the land. The
parties agree that in no event shall either be liable for special, exemplary, consequential or other indirect damages to
the other, and all such damages are hereby waived to the extent permitted by law.

This instrument constitutes the entire agreement and understanding of the parties and supersedes all prior
understandings, negotiations and agreements of the parties related to the subject matter hereof. Each party agrees to
give the other a 30-day right to cure after notice of any default before seeking termination or exercising any other
remedy.
TO HA VE AND TO HOLD said right of way and easement unto said GRANTEE, its successors and
assigns for so long as same are used for the purposed herein granted. All provisions hereof are appurtenant to, run
with and burden the above-described land, and are binding upon and inure to the benefit of the successors, assigns,
heirs, executors, administrators and other legal representative of each of the parties.

East Mamm 20· Discharge Pipeline
Noxious Weed Report & Management Plan
This noxious weed inventory and management plan was prepared at the request of Red Rock
Gathering Company for the proposed East Mamm 20" Discharge Pipeline. Red Rock Gathering
Company, LLC (RRG), a subsidiary of Summit Midstream Partners, is proposing to construct
approximately 1.12 miles of 20-inch diameter buried steel natural gas pipeline and related
aboveground facilities. The proposed East Mamm 20" Discharge Pipeline project is located in
Garfield County, Colorado in Sections 35 and 36, Township 6 South, Range 93 West (6th Principal
Meridian). The proposed pipeline corridor follows existing pipelines, which were constructed by
Encana Oil and Gas (USA) Inc.
Both Garfield County's noxious weed list1 and the State of Colorado's noxious weed list2 were utilized
for Olsson's survey efforts (see Appendix A and 8). To summarize, our surveys found the following
State listed noxious weeds:

1.1. Description of Analysis Area
The proposed ROW passes through non-irrigated agricultural fields. The vegetation is dominated by
agricultural grasses, including orchardgrass (Dactylis g/omerata), western wheatgrass (Pascopyrum
smithi1), and smooth brome (Bromus inermis).

2. RESULTS OF SURVEY EFFORTS
The only noxious weed found in the project area was field bindweed (Convolvulus arvensis). It
occurred in very minor coverage near CR 319 (<5% cover).
It is also likely that bulbous bluegrass (Poa bu/basa) and redstem filaree (Erodium cicutarium) occur
in the project area, but given the lateness of the growing season these species were not conclusively
identified.

As mandated by the Colorado Noxious Weed Act and the Colorado Oil and Gas Conservation Act
(and in conformance with Bureau of Land Management (BLM) and U.S. Forest Service (USFS)
National Invasive Weed Strategies), an operator shall control noxious weeds on lands they disturb
during oil and gas exploration and development, including well pads, facilities, pipelines, roads and
any other disturbed areas on private property (and on BLM and USFS lands).
To meet the requirements of the Colorado Noxious Weed Act, the operator shall conduct prescribed
management techniques for noxious weeds included on one of three State weed lists: List A -
designated for statewide eradication; List B -managed to prevent further spread and, for selected
species, designated for eradication in large areas; and List C -of more localized concern, but for
which the State will provide education, research, and biological control assistance to jurisdictions that
choose to manage the species. The current State list is available in Appendix A.
If populations of List A species are present in the project area , every population shall be eradicated
prior to seed development. To stop the spread of List B species, populations of every species
designated for eradication in a particular county shall be eliminated prior to seed development.
Additionally, to meet reclamation objectives, the operator should eliminate or minimize those noxious
and invasive weeds designated as "undesirable species". Undesirable species include redstem
filaree and quackgrass, all other List C species (e.g., halogeton [Ha/ogeton glomeratus] and
cheatgrass [Anisantha tectorom]), and invasive species that commonly colonize disturbed or
reclaimed land and impede or prevent establishment of desirable species (e.g., kochia [Kochia
sieversiana, K. iranica, K. scoparia] and Russian thistle [Sa/so/a australis, S. iberica, S. kalm.
Control of invasive species is a difficult task and requires on-going control measures. Care must be
taken to avoid negatively impacting desirable plant communities and inviting infestation by other
pioneer invaders. Weed management is best achieved by employing aggressive control early on,
and persistent control efforts over several growing seasons, including direct treatments, prevention
through best management practices, monitoring of treatment efficacy, and subsequent detection
efforts. Weed management is often limited to controlling existing infestations and prevention of
further infestations, rather than eradication, but through effective weed management practices
eradication can be possible in small to medium sized weed populations.
