FURMAN JENNIFER M. SMITH T. DAMIEN ZUMBRENNEN JEFFREY J. CONKLIN Leavenworth & Karp has been retained to review the legal water supply available to serve a two lot subdivision for property owned by Don and Nanette Seaton. Because this subdivision will result in only two lots, the water supply plan requirements in the land use code at section 5-502 C 13 (a) do not apply. The existing well on the property serves two existing residential units and provides water for landscape irrigation. The existing well is permitted as Well Permit No. 173988. A West Divide Water Conservancy District contract has been obtained to augment depletions from the existing well for the following uses within the proposed subdivision: (a) use in two single family primary residences, (b) use in two accessory dwelling units, and ( C) irrigation of up to 35,000 sq. feet of lawn and garden to be divided between the two lots. An Application has been filed with the State Division of Water Resources to obtain a new well permit for the property that is incorporates the uses permitted under the West Divide Water Conservancy District contract. I anticipate that the new well permit will be issued before the Board of County Commissioners hearing on the subdivision. Because the well is augmented by the West Divide contract, it can provide water to the subdivision even when there is a call on Four Mile Creek. According to the Well Construction and Test Report, the well can produce 30 g.p.m. for a sustained period of time. Thus, the existing well as augmented by the West Divide contract provides an adequate water supply to meet the needs of the subdivision. 1 ',Clic nIsL5f.ton, Dan. mfA LCIICr,\l.v I.
