LOCATION South of the intersection of County Roads 108 and 109, west of the Town of Carbondale ACCESS EXISTING ZONING FUTURE LAND USE MAP Crystal River Road, a 50' road easement Rural 2030 - Residential Medium (6 to < 10 acres/du) 2000 - Subdivision GENERAL PROJECT DESCRIPTION The owners of Lots 7 and 9 of the Rock Creek Subdivision seek to vacate an amended plat approved by the Board of County Commissioners in 1994 (below). This plat amendment incorporated the area of lot 8, a 5.58 -acre site, into the two adjacent parcels which increased the size of Lot 7 from 5.04 -acres to 7.83 -acres and Lot 9 from 5.12 -acres to 7.91 -acres. Board of County Commissioners January 16, 2012 KE Should the Board approve the vacation of the amended plat the legal description of the three Tots — 7, 8, and 9, will revert to the original final plat approved by the Board in 1972. A draft Resolution has been provided which would memorialize this decision. II. HISTORY The final plat for Rock Creek Subdivision was approved by the Board of County Commissioners on June 19, 1972 and created thirteen (13) single family lots Green Belt area, and a 50 -foot road easement on ±71 -acres. Each of the lots (7, 8 and 9) were required to pay HOA Dues which were split evenly between the two owners. In 1994, with one of the owners contemplating selling their property, the amended final plat incorporating Lot 8 into Lots 7 and 9 was submitted and ultimately approved by the Board. 2 ZONING AND ADJACENT USES Rural Zone District • Lot 7 _ rl 10,‘0\-- \ 0t9', • cinoti J-� 'Tar: IV. REVIEW CRITERIA & STANDARDS Board of County Commissioners January 16, 2012 KE The current zoning within the Rock Creek Subdivision is Rural, a zone district which requires a minimum lot size of two (2) acres. The re-creation of Lot 8 will not cause any non -conforming parcels. The Town of Carbondale lies to the east, across the Crystal River, from this site. The use of the area is residential and is comprised of a subdivision by the name of Crystal Village PUD which has Tots ranging from 5,000 to 14,000 square feet. Subdivision Final Plat Amendments require the following submittal documents and compliance with the requirements contained within Article V of the Unified Land Use Resolution of 2008, as amended. This is a unique situation as the subdivision originally co include the following sections of the ULUR. The criteria and standards for review are listed below, followed by a Staff Response. V. CONCERNS AND ISSUES Section 5-306, Amended/Corrected Subdivision Final or Exemption Plat, states that the review provides shall be use to modify plats such as, but not limited to, modifying lot lines, building envelopes, easement locations or other interests. This section goes on the say that this process cannot be used to increase the number of subdivision lots. It appears that this process can be utilized since the request is to vacate the amended plat, rather than "creating" a 'new' lot (Lot 8). A resolution would be signed by the Board to memorialize this action of plat vacation resulting in 'cleaner' Title to the property since an additional plat would not be required. VI. SUGGESTED FINDINGS Staff recommends that the Board consider incorporating the following findings in relation to the requested vacation of the Amended Plat of Lots 7, 8, and 9 of the Rock Creek Subdivision recorded at Reception No. 765473: A. That proper public notice was provided as required for the public meeting before the Board of County Commissioners. B. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted or could be submitted and that all interested parties were heard at that meeting. 3 Board of County Commissioners January 16, 2012 KE C. That for the above stated and other reasons, the request to vacate the amended plat of Lots 7, 8 , and 9 of the Rock Creek Subdivision is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. D. The application has adequately met the requirements of the Garfield County Unified Land Use Resolution of 2008, as amended. VII. BOARD OF COUNTY COMMISSIONER DECISION Staff recommends that the Board of County Commissioners approve the vacation of the Amended Final Plat of Rock Creek Subdivision, Lots 7, 8, and 9 recorded on July 6, 1994 at Reception No. 465473 and sign the proposed Resolution. This approval shall be granted conditional upon the properties maintaining compliance with all zoning and subdivision regulations as required by the Unified Land Use Resolution of 2008, as amended. Other options available to achieve the outcome of re-creating the three lots include holding a public hearing (in a process similar to a road vacation) or requiring that the Applicant create a new amended plat to legally describe Lots 7, 8 and 9 of the Rock Creek Subdivision. The original final plat for the subdivision created Lot 8, considered the potential impacts of that lot, and provided the necessary public improvements to serve this lot therefore staff could not determine any adverse impact from allowing this process to move forward as requested. 4 PUBLIC NOTICE TAKE NOTICE that Nanna Schov and Ann M Geupel Revocable Trust have applied to the Director of Building and Planning, Garfield County, State of Colorado, to request the vacation of an Amended Plat of Lots 7, 8, and 9 - Rock Creek Subdivision. on property situated in the County of Garfield, State of Colorado: to -wit: Leeal Description: Practical Description: Description of Request: Amended Plat of Lots 7, 8 and 9 - Rock Creek Subdivision 273 Crystal River Road and 361 Crystal River Road Vacate the Amended Plat which incorporated Lot 8 into the two adjacent lots, Lot 7 and Lot 9.
