Dear Mr. and Mrs. Dechert;
The Building and Planning Department has reviewed the information submitted in the application
for a lot line amendment in Antler's Orchard. The submittal documents appear to be technically
compliant with the requirements in the Unified Land Use Regulations of 2008, as amended (ULUR),
A quick review of the assessor data on the adjacent properties shows that no changes have
occurred since May 215t when you completed the records search. A date of December 5, 2012 has
been set for the Director to make a decision on whether to approve or deny the application.
It is your responsibility as the Applicant to complete the public notice requirement. Please mail
the attached letter, certified mail with return receipt requested, to the adjacent properties within
200' of the subject lot (as included on the submitted list of owners within 200'). You must provide
both proof of mailing and proof of receipt prior to the Director Determination on the application.
The notice is required to be sent at least 15 days prior to the date of Director Determination (by
November 20th at the latest).
An outline of the review process is provided:
1. The Director Determination is set for December 5, 2012;
2. Public notice must be sent out (by you) prior to November 20th, 2012 (Tuesday) in order to
meet the necessary 15 day time requirement;
3. On December 5, 2012 the Director will issue the decision and notify both the applicant and
the Board of County Commissioners (BOCC) of the decision. The BOCC has the ability to
"call-up" the application for a public hearing before the Board of County Commissioners.
We are required to give the BOCC 10 days to review and determine if the application
should be called -up for hearing (December 17th).

4. You may obtain the mylar from your surveyor at this time and obtain the following the
signatures:
a. Dechert — signatures must be notarized
b. Jurmu — signatures must be notarized
c. Jurmu mortgage company
d. Your surveyor
e. Treasurer
f. Title Company (or attorney)
The planner will obtain the remainder of the signatures including the County Surveyor, Board of
County Commissioners and Clerk and Recorder.
Once the 10 days have passed (December 17th) and no one opts to call-up the application, the
Planner can then schedule the plat for Board of County Commissioner signature. Once signed we
will need recording fees ($21.00).

I. GENERAL PROJECT DESCRIPTION
Applicant seeks to amend a lot line between his and neighbor properties so that an orchard
is wholly contained on his parcel. Subject site is two parcels, the 10 -acre Dechert site and
10 -acre Jurmu site. The Jurmu's may authorize the Dechert's to act on their behalf to
accomplish this amendment or they would have to sign all of the submittal materials and be
a party to the application.
A final plat amendment is required of Antler's Orchard Tots due to its status as pre-existing
(prior to County zoning and subdivision regulations) development.
Amended Plat process is an Administrative Review meaning that the decision to approve or
deny is granted by the Director of Building and Planning. The Board of County
Commissioners is provided notice once the decision is made to determine if they will `call-
up' the application for a public hearing (this happens in rare instances).
II. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS
Garfield County Unified Land Use Resolution Sections:
Division 4 (Common Review Procedures and submittal requirements) 4-101 to 4-104
• Proof of Ownership (title commitment or deed);
• Names and mailing addresses of owners of properties within 200' of subject
lot, list and indicate those properties on an assessor map (check online for
map);
• If owner has a representative (if Jurmu wants Dechert to process the
application on their hehalf) a letter of authorization is required.
Section 5-502 — submittal requirements:
1. Copy of the Pre -Application Conference Form;
2. Application Form and Fee;
3. A copy of the proposed Amended Final Plat;
4. Narrative of request and any supporting documentation (photos, etc.);
5. Amended plat pursuant to state statute and 5-502 C.5.
Please submit three (3) copies of the application materials — once assigned to a planner
additional copies may be requested.
III. REVIEW PROCESS
a. Pre -application Conference

c. Assignment to a Planner — review for technical completeness
d. Upon determination of a "complete" application several things happen concurrently:
1. The date of Director Determination will be set (within 30 days)
ii. Public Notice to adjacent property owners is completed by the applicant (staff will
provide the document to mail, certified mail return receipt requested);
iii. Additional copies of the application materials are requested — for referral agencies
e. Planner reviews application and any comments that may be received from referral
agencies. Planner completes a report of the project with a recommendation to the
Director
f. Director makes a determination on whether to approve, approve with conditions, or deny
the application
Applicant obtains certain signatures on a "mylar" of the plat and submits to staff
A 10 -day call-up period occurs with the Board of County Commissioners given the option
to require a public hearing
I. If no call-up is requested then the amended plat is placed on the Board Consent Agenda
and, once signed by the BOCC, is recorded.
