The Board of County Commissioners of Garfield County, Colorado,'nBoard' received a request for a call-up hearing by an adjacent property owner, Wewer Keohane, to review the Directors Determination regarding an Administrative Review Amended Final Pla! as further described in Exhibit A, Site Plan. B. Chris McGovern submitted an application for an Amended Plat on her properties to the CommunityDevelopment DeparEnent that was Approved with Conditions by the Director on Septerrber 12,2074. On Septemba 12,2014, Wewer Keohane submitted a letter requesting a Call-up to the Board of the Directors Determination. The subject properties are located within unincorporated Garfield County in the Rural zone district, approximately 5.miles east of Highway 82 accessed offCounty Road 113. D. Amended Final Plats maybe permitted with an Administrative Review. The Directors Determination of Approval with Conditions was upheld by the Board in a noticed public hearing on November 3,2014. E. The Board is authorized to approve, deny or approve with conditions an Administrative Review Amended Plat that has been called up to the Board. The application then will result in an amended plat(s) pursuant to the Garfield County Land Use and Development Code, as amended. F. The Board of County Commissioners opened a public hearing on the 3d day of November, 2014 for consideration of whether the proposed Amended Final Plats should be granted or denied, during which hearing the public and interested persons were given the opporfunity to express their opinions regarding the request. G. The Board of County Commissioners closed the public hearing on the 3d day of November, 20L4to make a final decision. H. The Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determinations of fact: 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners. 2. The hearingbefore the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at a the meeting. 3. That for the above stated and other reasons the proposed Amended Final Plats are in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. The forgoing Recitals are incorporated by this reference as part of the resolution. B. The Amended Final Plats for Baby Beans Subdivision I,ot 6A and Up Cattle Creek Lot 12A and owned by Cluis McGovern, are hereby approved subject to compliance with the following conditions: 1. That all representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. The Plat shall be subject to final review and approval by the County prior to submittal of the plat for final execution. All standard plat certificates and signature blocks shall be included on the final plat. 3. The Applicant shall provide verification that no utilities exist within the easernents to be relocated along the propefi boundaries. Any relocation shall be subject to review by the Garfield County contact engineer. 4. The proposed plat shall be edited as follows prior to submittal for final review by the County: 5. The Applicant shall add the following plat note: a.
