IIIIEREAS, the Board of Count,lr CornmisEioners of Garfield
CounEy has been requeeted to vacate porEions of a dedicated
public right,-of-way as such lies adjacent to their property and
is set forth below; and
IVEEREIS, The right-of-way as seE forth below is no longer
needed as a public right-of-way; and
WHEREAS, the Board of County Commlssj-oners is entitled E,o
vacate a right,-of-way by Resolutlon pursuant to the provieions of
Seetion 43-2-303(1) (b) C.R.S., as amended; and
IEIEREAS, a public hearing was conduct,ed by the Board of
County CormiEeionere concerning the need and appropriateness of
vacaEing said right-of-wdf, for which notification waa reqfuired
for property orrners adj oining the proposed vacaEed sect.ion of
roadway, whlch owners were the petitionere.,)t

NOW IHEREPORE, BE IT RESOL,VED by the Board of County
Commissioners of Garfield County as follows:
L. The right-of-way is generally deEcribed as J-ying
approxirnately one mile north of the Town of New Caetle and
runnlng paralle} to County Road 245, described in Exhibit 'tA'r
at,tached hereto, should be and hereby j-s vacat,ed.
2. That Pursuant to the foregoing vacat,ion title to euch
adjoining property oq,ners as set forth inproperty sha1I vest to
SecLion 43-2-301, et.seq. C.R" S. , as amended.
3. The foregoing vacation does not leave any property
adjoining said right-of-rrray vriEhout an establlshed road
connecting said land with another established public road-
4. This vacation dOes not leave any public land without
acceEs to a Public road.
5. The road hereby vacaEed conEalng no righE-of-waye or
eaaements for gewer, 9as, water, ditch, canal, electric,
telephone or other such utility that are dependent upon the
publi-c right-of-way for continued exj-strence.
6. This vacation is in the best, inEerest and for the
health eafety and welfare of trhe general public'
