BOX 669 GLENWOOD SPRINGS, COLORADO 81601/303-945-6917 December 1) 1970 Garfield County Planning Commission Gentlemen: Attached is the preliminary plan for the Asgard Subdivision to be located on Silt Mesa near Silt, Colorado. As a part of this information, we have included a report on water and sewer facilities, proposed covenants and street profiles. The drainage plan is noted on the plat. It shows; easements along 3 dry washes. Culvert sizes are shown on the profile sheets. It should be noted that most of the surface water is intercepted by the main irrigation ditch or by the large drainage way which forms the north boundary of the subdivision. It is proposed by the developer to dedicate all of the roads in the subdivision to public use and dedicate them to the county at such time as they are built to conform to county specification. Proposed utility easements are dedicated along all side and back lot lines as stated on the plat. There are no known existing easements in the area, except along the irrigation ditch. BOX 669 GLENWOOD SPRINGS, COLORADO 81601/303-945-6917 WA`t'i AND WASTE TREATMENT It is pnposed that the Asgard Subdivision be served by individual wells and waste trnatment systems. This is made necessary by the large lot size, averagir, 6.4+ acres. Standar percolation tests were conducted on the proposed subdivision in three lcations. The percolation rate was found to be 22 - 25 minutes of time per one inch drop of the water level. Application for septic tank systems ,'or the general site have been made to the Colorado Department of Health. There are several existing domestic wells in the area of the proposed sub- division. These wells have a production rate of about 5 - 10 gallons per minute. Most of them have been in long term usage. From study of the depths of each well, it is noted that the aquafer is nearly horizontal and probably is the unconsolidated gravel and boulder horizon which is observed in places along the west side of the property in the draw. It may however be a sand- stone member of the Wasatch formation. In as much as this has a favorable past production of domestic water it is reasonable to assume that such should continue to be true. Recharge of this aquafer will be derived from several sources. They are, percolation of rain and snow from surface, both above the immediate area and up in the higher country immediately to the north, and also seepage from the several irrigation ditches in the area. • r PROTECTIVE CONVENANTS KNOW ALL MEN BY THESE PRESENTS, THAT CHARLES J. BECKER, hereby declares, represents, agrees, restricts, and covenants that the use, enjoyment and ownership of the Asgard Subdivision shall be and the same is hereby restricted, limited, conditioned, and protected by the imposition of the following restrictions and limitations, for the purpose of developing a desirable residential area, and to maintain and increase property value, to wit: 1. TEMPORARY STRUCTURES: No structure of a temporary character, trailer, basement, or shack shall be used as a residence except during the period of construction of the principal dwelling on the premises. The period of construction shall not exceed twelve (12) months. 2. BUILDING MA'T'ERIALS: All structures shall have an exterior surface of wood, stone, glass, brick, or a combination thereof. Other materials may be used for exterior walls providing such materials are designed and located in harmony with surrounding natural land features, provided, however, no struct- ure shall have an exterior surface of tar paper, asbestos, or sheet metal. Asbestos shingles and metal shingles, however, may be used as roofing material. 3. GARBAGE AND REFUSE DISPOSAL: No part of the premises shall be used for or r,aintained as a dumping ground for rubbish. Parking of old cars, other than those in running condition and in use by the residents, will not be permitted. ). LAND USE: Residential use only. No part of the subject property may be subdivided. No operation, such as raising of pigs, where the odor is allowed to becoie offensive, shall be permitted.. Construction of garages or any out- buildings to shelter animals, etc., shall be constructed in a workmanship manner, and shall conform with, and not detract from the main residence. 5. TERM: The restrictions and limitations herein set forth are to be construed as covenants running with the land and shall be binding upon all parties and all persons claiming any part of the above described real property under said parties to these covenants for a period of 5 years from date these presents are recorded in the office of the County Clerk and Recorder of Garfield County, State of Colorado, after which time they shall be automatically extended for successive periods of 5 years unless an. instrument signed by the then owners of a mojority of the real property hereinabove described has been recorded in the office of said County Clerk and Recorder, agreeing to change said covenants in whole or in part. 6. ENFORCEMENTS: The owner or owners of any of the above described real property may enforce the restrictions and limitations herein set forth by proceedings at law or in equity against any person or persons violating or attempting to violate any of the said restrictions and limitations, either to recover damages for such violation or to restrain such violation or attempted violation. ?. SEVERABILITY: Invalidation of any one of the restrictions and limitations herein set forth by judgement or court order shall in no wise effect any of the other provisions which shall remain in full force and effect. The subdivision will have lots ranging in size from 2.6 to over 9 acres in size. The total area to be developed is about 140 acres containing 22 lots for an average lot size of 6.4 acres. No commercial development is planned. It is proposed to use individual wells and individual septic systems for each home. As consulting engineer for the owner we wish to request approval of the general area for septic systems. We are aware that as each individual system is built each will require a seperate application. Attention is also called to the area shown to the north. It is planned for future development in a similar manner. The enclosed location map shows the percolation test locations together with the location and depth of existing domestic water wells on the property. Dear Mr. Becker: This week we have conducted three standard percolation rate tests on the south tract of the two tracts of land of the Asgard Subdivision. The locations of the test holes are shown on the included 1" = 500' scale enlargement of the U.S.G.S. Quadrangle for Silt, Colorado. The locations of the present domestic wells known in the area is also noted with the depths for each well shown. The area in general is on the south slope of the Grand Hogback. The area has a soil cover ranging from a few inches to 10 - 15 feet which has been derived from the decay and weathering of the several formations in the Hogback. The Wasatch formation underlies the immediate area. Percolation test 1 was conducted at a depth of about 22 feet below the existing surface. The material is a sand -clay becoming somewhat more sandy with depth. The measured percolation rate was 25 minutes per one inch drop of water level in the test hole. Test hole f 2 was dug to a depth of about 3 feet and the percolation test was done at a depth of about 3 feet. The • irate::ial is a sandy clay.
