RE: Technical Completeness Letter & Determination of Approval for non -substantial change
determination regarding internal road width changes to Ranch @ Counter Creek Planned Unit
Development (PUD)
Dear Mr. Moak,
Thank you for the application and information letter received by this office on June 1, 2012. As a result
of the evidence in your application, I have deemed the application technically complete. Furthermore, I
have reviewed the request to amend the Ranch at Counter Creek PUD to reduce the road 'lane' width of
the main looped road (Cattle Creek Ridge Road) from two 11 -foot lanes to two 10 -foot lanes and have
approved the request as it has met the review requirements in the Garfielld County Unified Land Use
Resolution of 2008, as amended. Specifically,
1) The request is consistent with action(s) taken during previous Land Use Change Permit approval;
2) The request does not change the use category of the proposed development between
residential, commercial and industrial uses;
3) The request does not change the basic character of the approved use of land on which the
activity occurs, including basic visual appearance and method of operation;
4) The request does not constitute a new land development activity;
5) The request does not violate any Land Use Code standard;
6) The request does not substantially increase off-site impacts (including but not limited to
increased traffic, water use, wastewater generation, etc.) in the surrounding neighborhood;
7) The request does not substantially increase the need for on-site parking or utilities;
8) The request does not increase the floor area of the use by more than five (5) percent or
decrease the open space on the site by more than five (5) percent; and
9) The request does not endanger the public health, safety or welfare.

In addition, the proposal includes paving the new road sections which exceeds the County's minimum
standard of a gravel surface and has been approved by the Carbondale Rural Fire Protection District.
As required in the administrative process, you have provided proof that public notice was properly
provided to adjacent property owners at least 15 calendar days prior to the date of the Director's
decision. As such this decision of approval has been sent to the Board of County Commissioners in the
proper time frame.
In the event that public notice results in written comments in opposition to the proposed Permit, and
said opposition is based on relevant development standards in this Resolution, the Director shall place
the Permit on the earliest available scheduled meeting agenda of the Board of County Commissioners to
determine if a public hearing would be required. The requesting party has to file a written request
within ten (10) calendar days of the date of the decision by the Director (July 19`h)
