Said appeal is to request the recission of the denial of the issuance of a building permit for a single family dwelling on the above-described property. The fact that a deed was recorded for a parcel ' ,. that had legally existed prior to that time did not raise any red flags in the Assessoy's office, thus no questions were asked about the legality. In that letter he opines that the only relevant resolution of the County is the Subdivision RegulationJ and not the Zotrng Regulations. He additionally opines that there is no "operative rule" for merger,.only a "definitional" rule. The definition of "lot" in the Subdivision Regulations of Garfield Countyido not apply. The property was not subdivided. These regulations specifically ap* to the ,rfdiririoo of tand within the unincorporated area of Garfield County. According to Mr. Stuver's earlier position, the creation of the 2 acre lot was not a subdivision as it is defined in the statute, Section 30-28-101(10). These regulations are for the orderly subdivision of property in the county and do not apply to lands that are not going through the subdivision process. The regulations establish a subdivision regulatory pro..ir of sketch plan, preliminary plan atrd final plat. This does not apply to the lot or problem in question. The definition of "lot" in the Subdivision Regulations is "a portion of a subdivision intended as a unit for transfer of ownership or for development." According to Mr. Stuver's first letter, the creation of this parcel was not a subdivision and is noi considered to be subdivided pursuant to Section 30-28-101(10). Bean Page2 July 10, 1998 The argument that the difference between an "operative rule" and a "definitional section" changes the way that the County can enforce its resolution, comes without any tegal basis. Whether it appears in a definition or in a rule makes no substantive difference for our purposes. Additionally, even though the 1975 conveyance to the South Rifle District could have been created pursuant to eminent domain, such was not done. No action was commenced in the Courts and the County was not provided notice. Even though the land was conveyed to the South Rifle District there was no Court action. Nor was there any finding that such land was trecessary for the purposes for which the District was criated or that it qualified as property that could be condemned. Therefore, the reliance on that section is misplaced'because it did not actually occur as was intended by the statute. See Section 30-28-101(10)(cXII). The position that the parcels have merged is a position the County has taken in the past. That position is supportable under the evidence of this case. We have been infonned that the County has taken the position that this two acreparcel is an "illegal lot" and that as a result, building permits cannot be issued. The two acre paroel, along with the surrounding acreage, were acquired by S. W. Anderson and Lola Marie Anderson as a single parcel in the 1960's. The two acre paroel was later conveyed by the Andersons to the Rifle Village South Metropolitan District in September of.1975 for the District's purpose of constructing a water plant. Then, in March of 1987, when the District's needs had changed, the parcel was conveyed back to the Andersons. We submit that the L975 conveyance to the District was a legal division of property and not in violation of the subdivision laws. The 1975 conveyance to the Rifle Village South Metropolitan District was exempted by statute from restrictions dealing with the division of land. By Act of 1973, a division of land "which could be created by any court in this state pursuant to the law of eminent domaln" was exempted from the definition of "subdivision." Colo. Rev. Stat. S 106-2-33(3)(c)(iii). qAll}HrLD (X^fiyfY At the time of the L975 conveyance, Metropolitan Districts clearly could exercise the power of eminent domain both within and without their districts. Colo. Rev. Stat. S 32-3-114(1)CI) (1973). Thus, this division of land could have been created pursuant to the law of eminent domain. It follows that the 1975 division was exempt by statute. The C-ounty may argue that the 1975 definition in its own regulations did not contain such an exemption, and only exempted divisions 'bhich [are] created by order of any court in this state or by operation of law." Garfield Counf Subdivision Regulations. S 1.02.17(b)(2) (1975). However, the County was without authority to delete the state exemptions from the definition of subdivision. A County does not have the authority to adopt a definition of subdivision which is contrary to the express statutory definition. Pennobscot. Inc. v. Board of C-ounty C;ommissioners of Pitkin County. 642 P.zd 915 (Colo. 1982). Pennobscot reaffirurs ttre well established principle that subdivision regulations imposing restrictions on the free alienation of property are in derogation of common law. and therefore such regulations must be strictly construed. By exempting "divisions of property which could be created by any court in this state pursuant to the law of eminent domain" from the definition of subdivision, the legislature abstained from granting counties the authority to impose subdivision regulations on tlese divisions. Senate Bill 35 only authorlzes countles to pass subdlvision rrcgulations controlling those divisions not exempted by statute. It has also been suggested that the two acre parcel, which was created in 1975 upon transfer to the Dstrict, somehow merged with the surrounding parcel when the Andersons regained simultaneous ownership of both parcels some twelve yeani later. We find no authority for this proposition. Mere common ownership of separate adjoining parcels does not merge the adjoining parcels into a single tract. Terry v. Salazar. 892P.2d 391 (Colo.App. 1994), which holds that when a common owner acquires title to adjoining tracts, any agreement as to the boundary that had previously been made while the ownership was in two different persons ceases to exist or be effective, is not persuasive in the instant case. Nothing in Terr!,suggests that common oumership of adjacent parcels effects a merger of the parcels into one. Typically, the doctrine of merger applies to the merger of life estates, easements, and the like with remainder interests or servient estates. See 28 Am Jur 2d, Estates $ 374: "The doctrine of merger applies to different estates in land, not to different divisions of a parcel or tract." We find no case law which, absent expression of ovrner intent, even suggests that adjoining parcels merge upon acquisition of common ownership of the respective fee interests. At the time ttre acreage surrounding the two acre parcel was conveyed by the Andersons to a third party, tle separate existence of the two parcels had been established. It follows that the 1975 conveyance to the District was the only dlvislon of property which ever occurred and the only division which can be examined. And, as indicated above, this division was exempt under state law from county regulation. It is also worth noting that the two acre parcel has been and continues to be taxed by the C;ounty as a separate parcel. For years ou client has reasonably relied upon this representation by the County. Throughout the years of separately taxing this two acre parcel, the County gave our client no reason to believe that any branch of county government would assert a position contrary to those of the Assessor and Treasurer. As a result, the C-ounty is estopped from denlng the separate legal identity of this parcel. LLC Parcel Dear Mark: Enclosed please find potions of the map for the Alleman, Nicholas, Campbell, LLC properry (Lake Toueye) which shows the two island parcels which are currently owned by Lola Anderson. One island parcel is a square, 2 acres in size and the other one is circular .5 acres. Also enclosed are copies of the deeds of ownership in the chain of title for these parcels. As I review the deeds, I find the following: 1. The properry in its entirety was corveyed to S. W. Anderson and Lola Marie Anderson in August of 1960. A large parcel of land, which encompassed these nro island parcels, was conveyed. b L975 the Andersons conveyed a square 2 acre parcel to S. W. Anderson and Lola Marie Anderson and Rifle Village South Metropolitan District. The 2 acre square tract wuls conveyed back to S. W. Anderson and Lola Marie Anderson by deed dated March 1987. The 2 properties merged at that time. The Andersons lost the property surrounding the square 2 acre parcel as is evidenced by deed to Rocky Mountain National Bank dated May 1987. The larger parcel (surroundin g tJre 2 acre square parcel) was conveyed back to Anderson on October 8, 1987 and the 2 acre square parcel and the larger surrounding parcel would have merged.
