PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as
amended, and the Subdivision Regulati.ons of Garfield County,
Colorado, adopted April 23, 1984 Section 2:20.49, the undersigned
Harry L. and nhonda-X. Naug1e respectfully petition the Board of
CounLy Commissioners of Garfj-e1d County, Colorado, to exempt by
nesolirtion the divi-sion of a 248.22 acre tract of land into Tt{O
tracts of approxi-matety 6.89 and 241.33 acres, more or 1ess, from
the definitions of "su6division" and "subdi-vided Iand" as the
terms are used and d.efined in C.R.S. (1973) Section 30-28-
101 (10) (a) - (d) and the Garfield County Subdivision Regulatj-ons
for the reasons stated below:

The 248 aeres owned by applicants are a portion of the mul-
tiple tracts conveyed by Annie Eshe to N.P. Dodge Company in 1964
(see deed recorded in Book 359 at Page 181 attached). This par-
cel was segregated from other parts of the property by Hwy. 6&24
and later I-70 and remained intact through conveyance to the
Naugles by deed recorded in Book 868 at Page 145. The only con-
veyance by the Naugles has been a part of the Nvrl/4NW1/A of Sec.
29, T. 6 S., R. 94 W. described in Book 943, Page 854, attaehed.
Therefore this application qualifies for exemption from the Sub-
division Regulations of Garfield County.

2. The applicant shall nolify the office specilied on the permit at l€ast 48 hours p.ior to construction. A copy ol the ps,mit shall
be available ,o, review at th€ conslruction site. lnspections will be made during construclion.
3. The sccess conslruction within highway lighl-of-way must b€ completed within 45 days.

the pernrit. lf the permittee wishes to use the accsss prior to complotion, arrangements must be approvad by th6 issuing
authority and Oepartment and included on the permit. The Oepartment or issuing authority may order a hall to any

braced with an approved end posl belore the fence is cut to prevent any slacking ol the remaining lence. All posts and wire
removed are Deparlment property and shall be turned ovor to a reprgsentative of lhe Oepartment.
6. A copy ol lhe psrmii shall be available for review al the conslruction site. l, necessary: minor changes and additions shall be
ordered by the Oepartnlent or local authority ,ield inspector to meet unanticipated sito conditions.

8. Where necessary lo remove, relocale, or repair a trallic conlrol device or public or privato utiliti€s for the construclion ol a
permitted access, the work shall be accomplished by th6 permitlee without cost to the Departmenl or issuing authority, and
at lhe direction of the Department or utility company. Any damage to lhe state highway or other public righl-or-way bayond
that which is allowed in Ure permit shall be repaired immediately.

lll Changes in use and Ylolaliont
I . ll lhere are changos in the use ol the access, the access pormit-issuing authority must b€ notirl6d ol the change. A chang€ in
property use whictr makes the existing access design or use in non-conlormance with the Access Code or the terms and
conditions o, the permit, may require ihs reconstruction or relocation o, the access. Examples o, change3 in accgss use are:
an increase in vehicular volume by 20 percent, or an increase by 20 peacent ol a directional characteristic auch as I lell turn.
The issuing authority will revi€w the original permiU it may decide it is adsquate or request that you apply lor a new permit.
2. All terms and conditions ot the permit are binding upon all assign3, successors-in-inter€st and heirs.
3. When a permitted driveway is conslructed or used in violation of the Access Code, the local gov€tnmonl or O€parlment may
obtain a courl order io halt the violation. Such access permils may b€ revoked by tho issuing authoiily.

The applicant shall notily the office specified on the permit at least 48 hours prior to construction. A copy of the permit shall
be available lor review at the construction site. lnspections will bo made during construction.
The access conslruclion within highway right-of-way must be completed within 45 days.
It is the responsibiliry o, lhe permittee to completB the construction ol the access according to the torms and conditions ol
tne permif. tf tne permitte6 wishes to use the accoss prior to compleiion, arrangements must be approvod by th€ issuing
authority and Department and included on lhe permit. The Department or issuing.authority may order a halt to any
unauthorized use ol the access. Reconstruclion or improvemenls to the access may be roquired when the permittee has

Where nec€ssary to remove, relocate, or repair a tralfic control device or public or privato utililies tor the construction ol a
permitfed accesi, the work shall be accomplished by the permittee without cost to the Dopartmont or issuing authority, and
it the direction olthe Department or utility company. Any damage to the statB highway or other public right-or-way beyond
that which is allowed in tho permit shall be repaired immsdiately.
Adequal6 advance warning is required at all iimes during access construction, in conformance with the Manual on Uni,orm

Fu.lhcr lnlormatlon
1. When lhe permit holder wishes to make improvements to an existing legal access, he shall mako his request by liling a
completed permit application lorm with the issuing auihority. The issring authority may take action only on the rsquest lor
improvemenl. Denial does not revoke lhe Bxisting access.
The permittee, his heirs, successors-in-interest, and assigns, ol the property serviced by lhe access shall be responsible for
meeiing the terms and conditions ol ihe permil and the removal or clearance ol snow or ice upon the access ev€n lhough
deposiild on the access in the course ol Deparlment snow removal operations. The O€partmont shall maintain in
unincorporaled areas the highway drainage system, including lhose culverts under the accsss which are Parl ol that system
within the right-ol-way.
Th6 issue daie ol the permit is the date the Oepartment representative signs the permil which is after the permittee haE
roturned the permit signed and paid any required fees.
The Department may, when necessary tor the improved salety and operation ol the roadway, rebuild, modify, remove, or
redesign the highway including any auxiliary lane.
Any driveway, whether constructed belore, on, or after June 30, 1979, may be required by lhB Deparlmont, with written
concurrencaol the appropriate local auihorily, to be reconstructed or relocated to conform to the Access Code' either at
the property owner'sexpense il the reconslruction or relocation is necessilated by a change in lhe use o, ths proporty
which resulis in a cnange in the type of driveway operation; or at tho expense of lhe Oepartment il lha reconstruclion or
relocalion is necessitat;d by changes in road or iiairic conditions. The necessity ,or lhe relocation or reconstruction shall
be dotermined by relerence to the standards set lorth in the Access Code.

Green Rivei shale and Uinta sandstone. Annual precipi-
tation is about 20 inches, and average annual tempera-
ture is about 40 degrees F.
This map unit covers about 16 percent of the survey
area, or approximately 100,000 acres. The unit is about
30 perceni'Parachute soils, 30 percent Rhone soils, 20
perient lrigul soils, 15 percent Northwater soils, and 5
percent soils of minor extent.
Parachute soils are on ridges and mountainsides. They
are moderately deep and well drained. The surlace layer
is loam, and the su6soil is loam that grades to extremely
channery loam. Bedrock is sandstone.
Rhon6 soils are on mountainsides. They are deep and
well drained. The surface layer is loam in the upper part
and sandy clay loam in the lower part. The substratum is
very channery sandY claY loam.
liigul soils are on crests and sides of ridges. They are
shdlow and well drained. The surface layer is channery
loam, and the substratum is extremely channery sandy
clay loam. Bedrock is sandstone.
This unit is used entirely for grazing and wildlife habi'
tat. lt is poorly suited to other uses. lt is grazed rylnJV
from early summer to early fall. This unit is well suited to
wildlife niUitat. Deer, elk, mountain lion, grouse, rabbits,
and squinels are common.
2. Bock outcroP'Torriorthents
Rock outcrop and moderately deep and shallow, well
drained, very steep and ertremely steep soils on escarp'
ments and mountains
This map unit is in the northwestern part of the survey
area below the Roan Plateau from the escarpment
edges down to the toe slope. Average annual precipita-
tion is about 14 inches, and average annual temperature
is about 46 degrees F.
This map unit covers about 5 percent of the survey
area, or approximately 30,000 acres' This unit is about
45 percent Rock outcrop, 40 percent Torriorthents, and
15 percent soils of minor extent.
Fiock outcrop is on the nearly vertical clitfs from the
rim of the Roan Plateau to the talus slopes below. lt
consists of exposures of shale of the Green River For-
mation. This shale is locally known as "oil shale."
Torriorthents are on the colluvial slopes below the
Rock outcrop. They are moderately deep and shallow
and are weil drained. They are clayey to loamy and
contain variable amounts of gravel, cobbles, and stones.
This unit is used primarily for grazing and wildlife habi-
tat, mainly on the toe slopes where browse plants and
some grasses grow. The deer and elk feed at the lower
elevations in winter. Sage grouse, mountain lion, rabbits,
and coyotes also find habitat on this unit. There has
been limited mining of "oil shale" from the Flock outcrop.
Commercial development is extremely limited.
3. Arvada.Torrifluvents'Heldt
Deep, well drained to somewhat poorly.drained, nearly-trnii'to iinity Aoping soils on benches, tenaces, alluvial
fans, and flood Plains
This map unit is in the central part of the survey area'
The soils iormed in mixed allwium. Average annual pre'
cipitation is about 13 inches, and average annual tern'
perature is about 48 degrees F.' This map unit coveri about 6 percent of the survey
area, or afproximately 41,000 acres. This unit is about
40 perceni'Arvada soils, 20 percent. Torrifluvents, 20
perient Heldt soils, and 20 percent soils of minor extent
Arvada soils are on benches, terraces, and fans' They
are deep, well drained, and alkali affected' The surface
tayer is'loam, the subsoil is strongly alkaline silU clay
loam, and the substratum is silty clay loam.
Torrifluvents are on flood plains and low teraces'
They are deep and well drained to somewhat PooJl.y
drained. They are sandy loam or loam stratified with
sand, gravel, or cobbles.
Heldl soils are on alluvialfans. They are deep and well
drained. The surface layer and subsoil are clay loam'
and the substratum is claY.
Minor in this unit are Nifrill, Kim, and Olney soils'
These soils are deep and well drained.
inis unit is used ior irrigated crops, grazing, and wi!{-
life habitat. Most of the inigated crops are on the Heldt
ioils. The major crops are alfalfa, small grains, and ini'
giied pastur6. me'suitabitity of the Arvada soils for
irrigatei crops is poor because of the strongly.saline'

Torrifluvents for irrigation and most other uses is poor
because of flooding and a high water table. This unit has

4. Torrlorthents'Rock outcropCamborthlds
Dominantly shatlow to deep, well drained, steep to ex'
tremety sieep soils, and Rock outcrop, on mountains,
fans, and ridges
This map unit is throughout the survey area' The soils
formed in'sandstone and shale. Average annual precipi-
tation is about 14 inches, and average annual tempera-
ture is about 47 degrees F.
This map unit covers about 20 percent of the survey
area, or approximately 130,000 acres. This unit is about
50 percent'Torriorthents, 20 percent Rock outcrop, 20
per6ent Camborthids, and 10 percent soils of minor
extent.
Torriorthents are on steep and very steep mountain-
sides and steep fans. They are shallow and moderately

Permeability of the Morval soil is moderate, and availa-
ble water capacity is moderate. Effective rooting depth is
60 inches. Surface runotf is medium, and the erosion
hazard is moderate.
The Tridell soil is deep and well drained. Typically' the
surface layer is brown stony loam 10 inches thick. The
upper part of the underlying material is brown very stony
loam 11 inches thick, and the lower part is pinkish white
very stony loam to a depth of 60 inches.
permeiUitity of the Tridell soil is moderately rapid, and
available water capacity is low. Etfective rooting depth is
60 inches. Surface runotf is medium, and the erosion
hazard is moderate.
lncluded with these soils in mapping are small areas of
Villa Grove and Zoltay soils on the steeper parts of the
landscape. These areas make up about 15 percent of
the map unit.
These soils are used mainly for grazing.
The native vegetation on the Morval soil is manly
needleandthread, wheatgrass, and sagebrush. The
native vegetation on the Tridell soil is mainly pinyon,
Utah junipler, and some Flocky Mountain juniper and an
underbtory mostly of wheatgrass, lndian ricegrass, need'
leandthread, junegrass, serviceberry, bitterbrush, moun-
tainmahogany, and big sagebrush.
When ianle condition deteriorates, forbs and shrubs
increase. Properly managing grazing maintains and im'
lroves range condition. Seeding improves range in poor
;ondition on gently sloping Morval soils. Bluebunch
wheatgrass, western wheatgrass, and needleandthread
are suitable for seeding. Preparing a seedbed and drilling
the seed are good practices. Reducing brush improves
range that is producing more shrubs than are normally
found in the potential plant community' Properly manag-
ing the vegetation on the Tridell soil maintains wood
production -and grazing. Selectively thinning pinyon and
juniper improves grazing and provides firewood, posts,
and Christmas trees.' The Tridell soil is suited to production of pinyon and
Utah iuniper. lt can produce 8 cords of wood per acre
when trees more than 4.5 feet tall reach an average
diameter (at one foot) of 5 inches. Special care is
needed to prevent erosion during harvest. The low avail'
able water capacity atfects survival of seedlings'
Mule deer, wild turkey, and squirrel find habitat on
these soils.
Community development is limited by large stones. Cut
slopes are difficult to revegetate because of the stones
anil because of the shrink-swell potential and frost
action of the Morval soil.
This complex is in capability subclass Vle, nonirrigated.
46-Nlhllt channery loam, 1 to 6 percent slopes.
This deep, well drained, nearly level to gently sloping soil
is on alluvial fans and sides of valleys. Elevation ranges
from 5,000 to 6,500 feet. The soil formed in alluvium
lerived from Green Fliver shale and sandstone. The
average annual precipitation is about 13 inches, the
averale annual air temperature is about 48 de-grees F,
and t-he average frost-iree period is about 125 days'
Typically, thJsurface layer is light gray.and-very pale
Oro,i,h chinnery loam about 11 inches thick. The upper
part of the underlying material is v-ery pale brown very
bhannery loam ab6ut-14 inches thick, and the lower part
is very fale brown extremely channery-sandy loam and
ertremely channery loam to a depth of 60 inches.
lnclud6d with thjs soil in mapping are small areas of
Arvada and lldefonso soils. The Arvada soils are nearly
level, and lldefonso soils are steeper. These areas make
up 10 to 15 Percent of the maP unit.'Permeability is moderately rapid, and available water

Surtacd runoff is slow, and the erosion hazard is moder-
ate.
This soil is used mainly for grazing and wildlife habitat'
Some small areas are in irrigated hay and pasture.
This soil is usually inigated by flooding. Sprinklers are
also suitable. Since this soil is droughty, frequent irriga-
tion is needed to grow hay or pasture. Drop structures in
irrigation ditches [revent ditch erosion. Keeping the irri'
gation run short prevents too deep percolation'- The native vegetation on this soil is mainly wheat'
grass, needleandthread, and sagebrush.- When range condition deteriorates' forbs and shrubs
increase. Wlien the range is in poor condition, undesira-
ble weeds and annual- plants are numerous. Properly
managing grazing maintains and improves r9ngq. condi-
tion. Hedu6ing biush improves the range. Seeding im-
proves range in poor condition' Crested wheatgrass'
western wh6atgrass, and Russian wildrye are suitable for
seeding. Preparing a seedbed and drilling the seed are
good practices.- Mulb deer, cottontail rabbit, chukar, and squirrel find
habitat on this soil.
This soil has few limitations for community develop'
ment. Community sewage facilities will be needed if pop-
ulation density increases.

This deep, well drained, moderately sloping to-hilly soil is

tation is about 15 inches, and the average annual air
temperature is about 44 degrees F.
Morval soils are similar to Detra and Villa Grove soils'
Detra soils have a mollic epipedon more than 17 inches
'hick. Villa Grove soils have a calcium carbonate content

Review of Harry Naugle Subdivision Exemption Application
I have reviewed the request made by I{arry and Rhonda Naugle and offer the following
regarding the fue protection plan submitted:
1. The proposed 6+ acres is within the Grand Valley Fire Protection District
There is'also a portion of the total 134.99 acres, the land wrthin section 29,
located in the iufl" Fir" Protection District, which is uraffected by this
review.
2. It is assumed that by "a11 parcels", the Naugles are referring t9 thgir personal
dwellinj and this pioporca farm and feed/convenience store. This review and
subseqtient

ls for this project and not for any future development.
During a wildfire hazard reyiew and inspection program whic\the fire district
was involved in last year, it was found that there is a lock on the pte through
the cDoT Highway deer fence leading into the Naugle properly. In the event
of a fire o. *Jdi"uiemergency, the time delay of stopping, getting out the bolt
cutters, cutting a link in the thuin, placing the cutters back in the tnrck and
then driving 6 the emergency .o.lA prove costly to both propery and life
safety. I wiuld suggest tt ut tt . gates be removed and a some other form of
barier/sectrrity be liovided This would have to be worked out between the
owners (Naugle) and CDOT. If the gates are to remain, it is advised that the
Naugles'provfde the fire deparfinent *itt a means of entry, i.e. a combination
lock with resettable combination capabilities.
There are no readily available sources of water on the properly.
Access to the Colorado River is limited by fencing and tenain' A tnrck
cannot be placed close enough to the river to supply other tnrcks with water'

Vegetation in the area is consistent with the ptan'
6. After speaking with Kelly at the Colorado State Forest Service, Grand
Junction District, he has advised me that there is no longer a CSFS Wildfire
guideline. The CSFS has been using the NFPA 299, Standard for Protection
of Lif. and Property from Wildfire for the past several years. In addition, they
promote the usi of "Defensible Space" and accessibility to properties. Copies
of materials which may further define/describe these topics can be obtained
from the CSFS orbY the fire district.
In sgmmary, I do not see any reason to deny this application as long as it is understood
that any dt*" developmeni would have to be re-evaluated at such time and that the
Naugles are aware ofthe aforementioned conditions/concens as otrtlined 1 - 6 above.

Enclosed is the original Well Sharing Declaration for the
Naugle Exemption Plat and our check in the amount of $200-00 in
p"Vfi."t of tfre School Site Acquisition Fee. Also enclosed is our
lnlcf in the amount of $16-00, payable to the Garfield County
Clerk and. Recorder's Office for the recording fees of the
Exemption pl-at and the Well Sharinq Agreement. The Well Sharing
agrelment should be delivered to the Clerk and Recorder with the
fiemption Plat for recordi-ng. The County Surveyor review fee was
paid (see enclosed copy of [ransmittal note to County Surveyor)'
The Naugle Exemption Plat should have been delivered di-
rectly to your office by the County Surveyor.
