information:
Sketch m-ap at a minimum scale of I "=200' showing the legal description of the
propertyi dimension and area of all lots or separate interests to be created, access
to a public right-of-way, and any proposed easements for drainage, irrigation,
access or utilities;
Vicinity map at a minilntuu scale of l"=2000'showing the general topographic
and geographic relation of the proposed exemption to the surrounding area
within two (2) miles, fior which a copy of U. S. G.S. quadran gle map rnay be used.
Copy of the deed showing ownership by the applicant, or a letter from the
property owner(s) if other than the applicant; and
Names and addresses of owners of record of land immediately adjoining and
within 200 feetof theproposed exemption, mineral ownersand lesseesofmineral
owne$ of record of the property to be exempted, and tenants of any structure
proposed for conversion; and
Evidence of the soil types and characteristics oleach type; and
Proof of legal and adequate souroe of domestic water for each lot created,
method of sewage disposal, and letter of approval of fire protection plan from
appropriatq fire district; and
If connection to a community of municipal water or sewersystem is proposed,
a letter from the governing body stating a willingness to serve; and
Narrative explaining why exemption is being requested; and
It shall be demonstrated that the parcel existed as describecl on January l,1973
or the parcel as it exists presently is one of not more l.han three parcels crealed
from a larger parcel as it existed on January l, 1973,

alluvium and colluvium derived dominantly from redbed
sandstone and shale intermi-xed with gypsiferous
materj-al. The surface Iayer is cobbly sandy loam 3
inches thick. The upper if inches of the underlying
material is gravelly l.oam. The next t2 inches are very
gravelly loam. The next 34 inches to a depth of 60
inchesormoreareverycobb}yfinesandyloam.The
amount of stones and coubles increases with depth.
Permeability Is moderate. Available water capacity is
1ow. gffeciive rooting depth is 60 inches or more.
Runoff is rapid, and tle hizard of water erosion is
very hrgh.

Dear Mark,
Peter Nichols stopped by today to discuss his proposed sub-division exemption for his
proporty on County Road 106 in Garfield County. As I understand it Mr. Nichols is planning
to build a single farnily residence on 3 ll2 acros.
The Carbondale & Rural Fire Protection District will provide service to the property.
Access to the prope(y is adequate utilizing County Road 106 from the west as the
Carbondale Fire Department does not use the Hardwick bridge anymore.
Water supply for fire protection will consist of the water carried on the Carbondale fire
trucks, or approximately 6000 gallons. Additional water for fire protection will be provided by
the district's water shuttle program utilizing tanker trucks.
Response time to the property is approximately l2-15 minutes, with response coming out of
the Carbondale fire station,

separated by the Roaring Fork River. The tract has its own access from County Road 106
and is developable as a home site.

The proposed small tract is split by the Roaring Fork River from the other tract. The
propor.d dMsion is the center lini of the river. The river prevents joint use ofthe two
proposed tracts.
The county's limitation on the creation of parcels is irrelevant because the subject parcel is
exempt Uy virtue of the fact that it "...is split by a public right-of-way (State or Federal
highway,-County road or railroad) or natural f"ut.rr", preventing joint use of the proposed

I have been talking to Don DeFord, researching records, and trying to tiedown the status of the
Denver and Rio Grande Rail Road right-of-wa!. I have not gotten it trackeddown yet. It
uppru6 tt ut tt. Rail Road may have a prescriitive right. It iould get expensive to establish that'
ii;;y aho affect the need for a setback exemption as well- Don said that he would talk to you
aboui it when you return to clarify the need for that condition.
Unfortunately, I will b€ out of town for a couple of weeks, during which my current extension
expires (I believe). May I please be granted an additional extension to comply with the conditions
attached to my application for a subdivision exemption?

our oplnton ot ;une 29, 1965 are photocopies of the abstracted
entries for these documents and the following comments are
made in connection therewith: (a) Document No' 35201 --Entry
No; 55: The location of this tract is impossible to determine
from the description in the deed. This tract is now owned by
the Torvn of Carbondale and a correctly-surveyed description
of the tract intended to be conveyed should be obtained and this
portion of the title could then be corrected by exchanging deeds
ior this purpose with the Town of Carbondale. (b) Document
No. 168?99 and Document No. 226000--Entries numbered
?6 and 95, respectively: The two tracts conveyed by these
documents are accurately described and can be determined
and located on the ground. (c) Document No. 27427 --Entry
No. 50: The tract conveyed by this document is also accurately
and completely described and can be located on the ground in
the Northwest corner of Lot 8 of said Section 29.
5. Entry No. 64 of the abstract, Document No. 9?398,
(copy attached to our opinion of June 29r 1965) discloses a
Quit Claim Deed for a right-of-way for the purpose of
constructing and maintaining a power line "across a portion of
said premises. An inspection of the premises is necessary
to determine whether any such right-of-way now exists and an
accurate survey of the same should be obtained to determine
the exact location thereof.
6. Entry No. 69 of the abstract, Document No. 122878,
(copy attachld to our opinion of June 29, 1965), discloses a
rig-tri-ot-way deed in favor of the Mquntain States Telephone
"r,d T"lugraph Company fof conStructing and maintaining
transmission lines across a portion of said pfemises. The
exact location of such easement should also be determined by
an accurate survey of the portion of said real property involved.
7. The abstract discloses a map filed by Rocky Mountain
Natural Gas Company indicating that the right-of-way for their
transmission line might cross a portion of the above-described

real property; but rro deed for such an easement appears in the
abstract and an accurate survey and inspection of the premises
is necessary to determine whether such an easement actually
exists.
8. Said real property is included within the boundaries of
the Mt. Sopris Soil Conservation District, the CarbohdaLe and
Rural Fire Protection District and the west Divide water
Conservancy District, and is consequently subject to any levies
which mighf be made by reason thereof
9. The Warranty Deed to former olrners of the proper.ty
contains a mineral reservation in the following language: ttThe
grantors hereby reberve unto themselvds, their heirs and assigns,
in perpetuity, a seven per cent (7%l rcyalty from and out of all
of the oil, gas and other minerals produced and saved from said
lands, said royalty to be delivered and paid to..the grantors, their
heirs or assigns, free of costs of production.
Said Deed also contains a reservation of a right-of-way as

10. The water rights appurtenant to this real property include
an undivided 7/+Otfrs interest in the Kaiser and Seivers Ditch and
all water rights appropriated thereto and an undivided 44/60ths
interest in the Southard and Cavanaugh Ditch and all water rights
