(1973) Section 30-28-101 (10) (a)-(d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1' 1972 and arBnded April 14, 1.975, Sections 1.02.17(d) and 3.02.0L, for the division of a 3.93 acre tract into five (5) tracts of .7n .8, !.2?.21. and 1.02 acnes, more or less, and nore particularly described as follo,'ts: A tract of land in the N!,1%, SEk of Section 5, Township 6 South, Range 89 West of the 6th P.M. between CountyRoad and U. S. Highway 5 and 24. IIHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Cormissioners that aII tract sizes meet the minimum zoning requirements. That the purpose of said .21 acre tract of land is to allow the petitioners to move an existing building to the Iot at that location for the purpose of creating a guest house, that the sing'le-family dwelling Iocated on the 1.2 acre parcel is considered an accessory use to the connercial greenhouse also 'located on said lot, and the exemption is being requested so that the tracts may be re-sold; and, WHEREAS, the Petitioner has deomonstrated that alI deve'loped parcels are service by municipal water and sewage systems, that all undeveloped parcels wilI have central water and sewage service available, that all parcels have adequate ingress and egress, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield, and should, therefore, b€ exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S.
