This hearing is conducted pursuant to the laws of the State of Colorado. The purpose of this hearing is to receive information, data, and testimony by interested parties in order to enable this Board to make findings and reach the conclusions required to be made by state law as to whether or not the zone change amendment should be granted and the Planned Unit Development approved. A record is being made of these proceedings so that those who desire to be heard must identify themselves. by name and address. The order of this hearing will be: first, examina- tion of the application; second, the applicant is given the opportunity to present evidence he desires to submit; next, interested parties may present or submit matters to this board. The Board may give the applicant an opportunity to rebut matters submitted by interested parties if the Board should feel that rebuttal is desirable. Interested parties and the applicant may be represented by counsel. Insofar as practical this hearing will be conducted in conformity with the Colorado Administrative Procedure Act. All testimony shall be given under oath, which will be administered by the Chairman. Exhibits shall first be marked and then identified before offering them to the Chairman for admission into the record of this proceeding. The Chairman will rule on the question of admissibility of all exhibits and testimony and his ruling will stand unless objected to by a member of the Board during the hearing, in which event the question of admissibility will be decided by the majority of the members of the Board present. A record will be kept of evidence refused or testimony rejected. Cross-examination of witnesses at this hearing may be permitted` However, it should be clear that the Board will limit cross-examination which produces cumulative evidence or in order to protect witnesses against harassment or embarrassment. (End of opening comments) 3. The Chairman asks the applicant whether he is ready to proceed. If the applicant answers in the affirmative, then inquires of other interested parties whether they are ready to proceed and if not, ask for reasons why this hear- ing should not now proceed. OATH - Do you swear under the penalty of law that the test- imony or evidence you will give before this Board shall be the truth, the whole truth, and nothing but the truth.
