PRELIMINARY PLAN SUPPLEMENTAL DATA
Casa del Monte' Subdivision
The Casa del Monte' subdivision is planned for 10 single family
dwelling units on 10 lots encompasing 13.23 acres. The existing
zoning of this parcel and the surrounding property is Residential/
General/Suburban Density. This zoning is proposed to remain un-
changed. The development is planned for residential use only which
is in accordance with surrounding development. Adjacent lot sizes
vary from less than 8,000 sq ft to approximately 24,800 sq ft. Ex-
isting adjacent devely ment is shown.
The lots in Casa del Monte' subdivision are platted in order to
providea minimum of 1 acre level ground (less than 40% slope)to
each. Access to Lots 1,2 and 3 is proposed from the existing Coun-
ty Road 127 (old U.S. Hwy 6 and 24). Access to Lots 4 through 10
will be from a private drive (Sandy Lane) approximately 420 feet
long with a large turn -around at the South end.
This development requires 9 additional water taps and water supply
serviceagreements with the No -Name Water Users Association. These
taps and agreements have tentatively been approved by the Associa-
tion. A 6" diameter water main will be installed by the developer
to run from the existing water main within County Road 127 right-
of-way to a fire hydrant between Lots 8 and 9. A smaller line can
be extended for service to Lot 7. An additional fire hydrant will
be installed between Lots 2 and 3 at the North property line and
connected to the existing water main. Lots 1, 2 and 3 can be ser-
viced from this extension.
Sanitary wastes will be treated by on-site sewage disposal. Septic
tanks of 1,000 gallon capacity are proposed with layout and install-
ation subject to health and county building code requirements. As-
suming 3.2 persons per dwelling unit and 75 gpd waste per person,
each dwelling unit will generate 240 gpd septic tank waste. Perco-
lation tests were made at 3 locations. These test results and lo-
cation of test holes are shown on the Utility Plan.
The lots shall be covenanted as follows:
1. A minimum of two off-road parking spaces shall be required
at each lot.
2 There will not be any commercial business or enterprise
operated on the property. No signs advertising business
shall be allowed.
3. Mechanic work on vehicles shall not be permitted on the
property.
4. No mobile homes trailers, tents or other non -permanent
shelters shall fie allowed on the property other than motor
homes, travel trailers or pick-up campers which must be
parked off roadways or public or private easements.

5. Fences must be constructed from wood. No fence more than
3 feet in height shall be built on the front one-third
of the property.
6 All domestic potable water facilities shall be constructed
in accordance with No -Name Water Users Association require-
ments.
7. No residence shall be constructed within 15 feet of side
lot lines.
8 No dogs shall be allowed to run on the property without
owners in attendance. Not more than two dogs shall be al-
lowed to any one property owner. Dogs shall be either le-
ashed or penned while unattended.
9. These covenants shall run with title and transfer to new
owners with equal responsibility as to original owners.
Parking along County Road 127 is presently restricted and the de-
veloper wishes to see this restriction retained and enforced. The
school bus presently stops along the county road just west of the
proposed private drive. A widened area South and adjacent to the
county road at the intersection of Sandy Lane and County Road 127
is proposed for the safety and convenience of pick-up and discharge
of children by the school bus.
The Soil Conservation Service defines the soil type as Lazear-Cushman-
Ascalon. In general, it is described as shallow to deep, well drain-
ed, moderately sloping to very steep soils on mountains, mesabreaks
and alluvial fans. The soils formed in material weathered from sand-
stone, limestone and shale in mixed alluvium. Understory vegetation
is sparse and dominated by oak brush and juniper with some cedar and
pinion tree masses.
There are no significant drainage features upon the site. The No -Name
Water Users Association has established a line bleeder near the East
end of Lots 10 and 9 which will need to be relocated. Only on-site
drainage needs to be accomodated and rain or snow melt: is easily ab-
sorbed by the ground. The site generally slopes from the East to West
averaging 6% along the plain above the river bank. The bank slopes
approximately 45% to the Colorado River with some high benches bor-
dering the river and above the 100 year flood plain. A drainage ease-
ment isproposed at the South end of the cul-de-sac. Any drainage in-
tercepted by Sandy Lane will be carried in drain swales along both
sides of this private drive to the end of the cul-de-sac and to the
drainage easement. No channeling or other disturbance of native veg-
etation is proposed for the minimal flows which could occur during
and significant storm. County Road 127 intercepts and conveys all
run-off which could come from North of this development;and tribu-
tary area to the drainage easement is less than 3 acres. There should
be no damage or flooding of residences in a storm intensity of 100
year frequency.

Casa del Monte' Subdivision
The subsurface geology of the site is comprised of limestone of the
Mississippian Leadville formation overlain by Quaternary alluvium.
This alluvium is in large part derived from outwash from the No -Name
Creek drainage and is comprised of a heterogeneous mixture of large
boulders, cobbles, gravel and sand representing exposed formations in
the No -Name Creek drainage from Precambrian through Mississippian age
This material provides excellent structural foundation base and con-
tains no known material which would result in radiation hazzard.
There is a power line to an old well near the North West corner of
the site. This line is to be removed and new underground utilities
(gas, electric and telephone) are planned. The developer will ex-
tend underground power and gas along the private drive. Letters of
intent to provide service from electric and gas utility companies
are attached. Easements will be dedicated as necessary to protect
underground utilities and to provide for maintanance.
The Wildlife Conservation Officer for this area has assured that
this land is not considered a wintering area for any big game spe-
cies. Raccoon, opossum, skunk and rabbit are likely to occasionally
cross the property. Since no construction will be performed within
the river channel nor within a 25 foot set -back from high water line
no disturbance of fish or waterfowl should occur.

AGREEMENT
This is an agreement between the Noname Creek Water Association, Inc.
0048 Wildwood Lane, Glenwood Springs, CO 81601 and Donald Sillivan
of 108 Capitol Avenue, Carbondale, CO 81623.
Whereas the Noname Creek Water Association Inc. is a cooperative
eater association supplying water for domestic, irrigation and
fire protection purposes in the general area of Noname Creek
located north and south of Exit 119 of Colorado Interstate
Highway 70;
Whereas hereinafter the Noname Creek Water Association, Inc. will
be known as the "NCWA";
Whereas Donald Sillivan is the managing partner of Sillivan
Brothers, f Donald ,

Sillivan, formed for the purpose of developing approximately
14 acres of real property in the Noname Creek area to be known
as the Casa del Monte subdivision in the records of the Garfield
County, Colorado Courthouse and is hereinafter known as the
"developer";
Whereas the NCWA owns certain waters from Noname Creek as
adjudicated to it by the People of the State of Colorado in
the District Water Court and whereas Claycomb Engineering
Associates, Inc. of Glenwood Springs, CO has determined in a
study of the NCWA system that "the existing system was found
to have adequate capacity to meet the additional requirements of
the proposed Casa del Monte subdivision and should have no
significant impact upon present users";
Whereas the developer requests water from the NCWA for the purposes
of domestic, irrigation and fire protection for the use of the
purchasers of lots in Casa del Monte subdivision and also for
purposes of meeting Garfield County Subdivision Regulations that
require a subdivider to show where future landowners will obtain
water from;
It is therefore agreed that the developer will
1) construct, cause to have constructed or place in escrow the
funds necessary to construct a 6 inch water line, hydrants, valves,
•tc., as generally shown on Claycomb Distribution System Schematic
habit A, dated 12/18/80. This donstruction is to comply with
apocifications used by the City of Glenwood Springs for Ductile
:-Icon Pipe, valves, hydrants and other materials and also for
construction details such as depth of burial, bedding of pipe,
thrust blocks, etc. The crossing of paved County Road 129
(Noname Lane) is to be done by sharp cutting of the existing
pavement. First class road bedding materials shall be mechani-
cally compacted in 6 inch 1•ifts. Hot patch type asphalt base

be responsible for repairing any settlement, cracking or holes
that develop for a period of fourteen months from the application
of the pavement. The developer shall pay to the NCWA such monies
as are necessary for the NCWA to hire a competent inspector to
observe the installation of facilities and to certify their
compliance with the specifications to the NCWA.

75 to 100 foot depth. The well must be capable of producing 200
gallons per minute continuously 24 hours a day without lowering
the level of the water in the well significantly. The location
of the well shall be in the general area of Lot 1, Casa del Monte
subdivision near an existing 15 foot deep well.

Claycomb Engineering Associates have estimated the cost of items
#2 and #3 to be 364,550.00. The NCWA understands that the fa-
cility can probably be obtained for less than this estimated
amount. The NCWA will review or cause to have reviewed any
plans or estimates submitted by the developer, his contractor
or engineer.
4) dedicate a usable 10 foot wide permanent easement along County
Road 129 through the north edge of Lots 1, 2, and 3 for permanent
access to well house mentioned in tem 3 and the NCWA facilities
located under the County Road 129 bridge over Noname Creek.
5) dedicate a permanent easement in Lot 1 for the well house
and all its appertenences including overflow.
6) convey a deed to the NCWA for the facilities mentioned in
items #1, #2, and #3.
7) transfer to the NCWA the existing conditional well permit
located in Lot 10 and all other water rights if any associated
with the property.
8) restrict the onsite disposal system to be located in Lot 1
to 200 feet from the well mentioned in item #2 and further that
the NCWA shall review and approve plans for this disposal system
so that its well !hall not be contaminated.
9) dedicate a 20 foot wide easement along the common lot line
between lots 7 and 8 for the purposes of a future water line
extension.

10) provide permanent easements for any water line intentionally
or inadvertently placed on private property.
Only after all of the above items are completed to the satis-
faction of the NCWA does the NCWA herewith agree to provide
water of a quantity and quality normally associated with its
system to the water mains mentioned in item #1 above.
Further, the NCWA agrees to sell two shares of its capital stock
to any lot owner in Casa del Monte subdivision at such time
as the lot owner requests these shares. The sale of these
shares is subject to the normal rules and regulations of the
NCWA. The lot owner shall construct, operate and maintain a
3/4 inch service line from the main to his dwelling. Currently
the NCWA requires that a new dwelling be equipped with a water
meter, pressure reducing valve and an approved cartridge type
filter. The ownership of two shares of stock in the NCWA
entitles the lot owner to water for domestic and irrigation
purposes associated with one single family dwelling.
The price of one share of NCWA capital stock on March 1, 1981 is
one thousand dollars ($1,000.00). The price of stock shares is
adjusted periodically for inflation and assessments. An annual
fee to cover the cost of operating the system is invoiced in
July of each year.
Upon acceptance the NCWA, its heirs and assigns will own, operate
and maintain the water mains, well house and appertenences
mentioned above.
By means of the signatures affixed here below all of the above
is recognized and agreed to on Januarys, 1981.

Dear Ray,
This is to inform you that the Noname Creek Water Association,
Inc. has agreed with Donald Sillivan to supply water for
domestic, irrigation and fire protection purposes associated
with single family dwellings in the proposed Casa del Monte
subdivision, Garfield County, Colorado.
A study by Claycomb Engineering Associates dated December
1980 indicates that water can be extended to the subdivision
with no significant impact upon present users. The study
further indicates that ISO fire flow requirements of 750
gallons per minute for two hours can be delivered to the
subdivision.
A copy of the water extension agreement is attached. Please
note that several easements need to be added to the plat.
