A RESOLUTION CONCERNED WITH THE APPROVAL OF THE PRELIMINARY PLAT
SUBMITTAL FOR CASA DEL MONTE SUBDIVISION
WHEREAS, Don and Herbert Sillivan hagefiled an application with the
Planning Department of Garfield County for the approval of a Preliminary Plat
in the Residential/General/Suburban Density Zone District; and
WHEREAS, based on the material submitted by the applicant and the
comments of the Garfield County Planning Department, this Board finds as follows:
1. That the Preliminary Plat conforms to Section 4.02 Preliminary Plat
Requirements of the Garfield County Zoning Resolutions.
2. That the Preliminary Plat conforms to the requirements of the zone
district which the development is in.
3. That for the above -stated and other reasons, the proposed Preliminary
Plat appears to qualify for approval by this Board.
NOW, THEREFORE, BE IT RESOLVED that the Preliminary Plat of Casa Del Monte
Subdivision for the following described unincorporated area of Garfield County be
approved.
A parcel of land situated in the N1/2SW4 of Section 2, Township 6 South,
Range 89 West of the 6th Principal Meridian, Garfield County, Colorado,,
described by Document No. 192074 as filed in the Garfield County, Colorado
records, lying southerly of the southerly right-of-way line of Highway
6 & 24, Federal Aid Project No. 240 J. westerly of the westerly line of
Document No. 139228 as filed in the said County records, northerly of the
southerly line of said N1/2SW1/4, and northerly of the northerly high water
line, more or less, of the Colorado River, said parcel of land is more
fully described as follows:
Beginning at a Brass Cap Highway right-of-way Marker of said highway being
a point on the North-South Centerline of said N1/2SW4; whence an iron pine
with a brass cap properly marked for the Witness Corner to the West Quarter
Corner of said Section 2 bears: N.52°21'02"W. 1,508.81 feet; thence along
said right-of-way line, 49.80 feet along the arc of a curve to the left,
having a radius of 623.00 feet, the chord of which bears: N. 82°37'51" E.
49.79 feet; thence N.80°20'27" E. 652.15 feet; thence leaving said right-
of-way line, S.00°26'10" F. along the westerly line of said Document No.
139228, 683.01 feet to a point on the southerly line of said N1/2SW4; thence
N.88°42'10" W. along the southerly line of said N1/2SW4, 708.31 feet, more
or less, to a point on the North-South Centerline of said N1/2SW4, said
point being within the Colorado River; thenceN. 01°06'27" E along said
Centerline, 222.87 feet, more or less, to a point on said high water line;
thence more or les8 along said high water line, N. 63°39'14" W. 121.78
feet; thence N. 60 31'04" W. 114.42 feet; thence N. 54047'34" W. 165.16;
thence N.41°10'07" W. 81.00 feet; thence N. 28'02'54" W. 66.97 feet; thence
N. 43°47'29" W. 145.68 feet; thence N 17°29'28" W. 127.90 feet; thence N
04°06'22"W. 18.17 feet, more or less, to a point on said right-of-way line;
thence along said right-of-way line, 630.57 feet along the arc of a curve
to theleft, having a radius of 643.00 feet, the chord of which bears:
S.64005'12" E. 605.61 feet to a brass cap right-of-way marker; thence N.
54°23'12" E. 37.75 feet to a brass cap right-of-way marker on the North-
South Centerline of said N1/2SW4, the point of beginning.
AND BE IT FURTHER RESOLVED that the following conditions shall be placed
upon this approval:
1. That the duplex designations on the preliminary plat be removed at
final plat.
2. That the easements requested by the No Name Water Users Association be
agreed to and shown on the final plat.
3. That a fee of $200/per lot be obtained and held for the school district
and provided for in the subdividers agreement at final plat.
4. That an agreement is reached with the fire district on the location
and marking of fire hudrants. That the new locations of hydrants he shown on final plat.
5. That aquisition of all property within the subdivision be made by the devel-
oper by final plat.
