meeting of the Board of County Commissioners for Garfield County, Colorado,
held at the Court House in Glenwood Springs on Monday , the 14th day of
September A. D. 19 81 , there were present:

RESOLUTION # 81-282
RESOLUTION CONCERNED WITH THE VACATION OF A ROADWAY IN SECTION 2,
TOWNSHIP 6 SOUTH, RANGE 89 WEST OF THE SIXTH PRINCIPAL MERIDIAN
WHEREAS, Don Sillivan and Herbert Sillivan filed a petition with
the Board of County Commissioners of Garfield County, on or about
June 20, 1980 for the vacation of a roadway in the unincorporated area
of Garfield County, is more particularly described below; and
WHEREAS, public hearing was held by this Board on September 14,
1981; and
WHEREAS, based on the evidence, testimony,exhibits, study of
the master plan for the unincorporated area of the County, comments of
the Garfield County Planning Department, comments of public officials,
and comments from all interested parties, this Board finds as follows:
1. THAT proper publication of public notice was provided as
required by law for the hearing before the Board.
2. THAT hearing before the Board was extensive and complete,
that all pertinent facts, matters, and issues were submitted
and that all interested parties were heard at that hearing.
3. THAT no land adjoining said roadway is left, by reason of
this vacation, without an established public road connecting
said land to another established public road.
4. THAT said road vacation does not inhibit in any way the
public travel of vehicles on County Road 129 and is beneficial
to the applicant in terms of the proposed Casa Del Monte
subdivision.
5. THAT for the above stated, and other reasons, the proposed
vacation is in the best interests of the health, safety,
morals, convenience, order, prosperity and welfare of the
citizens of Garfield County.
NOW, THEREFORE, be it resolved that the partial vacation of
County Road 129, as more particularly described below, is in the unin-
corporated area of Garfield County, Colorado, be approved:
A parcel of land situated in the NZSWQ of Section 2, Township 6 South,
Range 89 West of the Sixth Principal Meridian, Garfield County, Colorado,
lying within the right-of-way lines of Old U.S. Highway 6 & 24 and County
Road No. 219, all lying Northerly of the Southerly right-of-way line of
said road, said parcel of land is more fully described as follows:
Beginning at a Brass Cap Highway right-of-way Marker on said Southerly
right-of-way line; whence the West Witness Quarter Corner of said
Section 2 bears: N.52°21'02"W. 1508.81 feet; thence S.54°23'12"W. 37.75
feet along said right-of-way line; thence 630.57 feet along the arc of
a curve to the right, having a radius of 643.00 feet, the chord of which
bear8: N.64°05'21"W. 605.61 feet along said right-of-way line; thence
N.04 06'22"W. 56.56 feet; thence 262.83 feet along the arc of a curve
to the left, having a radius of 615.00 feet, the chord of which bears:
S.43°45'24"E. 260.84 feet; thence S.66°21'56"E. 117.36 feet; thence
S.72°19'13"E. 100.12 feet; thence S.81°49'16"E. 99.95 feet; thence

N.87°25'23"E. 97.77 feet to a point on the East line of the NW;SWQ of
said Section 2; thence N.80°20'27"E. 701.57 feet; thence S.00°26'10"E.
25.26 feet to a point on said right-of-way line; thence along said
right-of-way line, S.80°20'27"W. 652.15 feet; thence 49.80 feet along
the arc of a curve to the right, having a radius of 623.00 feet, the
chord of which bears: S.82°37'51"W. 49.79 feet to the point of beg -
ginning, containing 0.936 acres, more or less.
AND BE IT FURTHER RESOLVED that said parcel is subject to a
ten foot access road easement line Southerly and adjacent to the
Northerly line of the above described parcel of land situated in the
NW aSW a of said Section 2.
AND BE IT FURTHER RESOLVED that an easement for the continued
use of existing utility pipelines, ditches, canals, and similar lines
and appurtenances is hereby reserved.
