PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979
Section 2.02.01 (d) and 3.02.01 the undersigned Paul R. Chanin, Trustee of the
Sheri Trust respectfully petitioners the
Board of County Commissioners of Garfield County, Colorado, to exempt by resolu-
tion the division of a 52.33 acre tract of land into two tracts of
approximately 51.62 and .71 acres each, more or less, from the difinitions of
"subdivision" and "subdivided land" as the terms are used and defined in C.R.S.
(1973) Section 30-28-101 (a) - (d) and the Garfield County Subdivision Regulations,
for the reasons stated below:
The conveyance is solely for the purpose of adjusting property lines with his neighbors,
Richard and Peggy Piffer (See Application for Exemption submitted by the Piffers.)
The conveyed tracts will become part of existing tracts. No new parcels will be created.
In support of this petition, the petitioner also submits the following:
(a) Map drawn to scale showing proposed lot
subdivision and access
(b) Copy of deed
(c) Vicinity Map
(d) State on source of domestic water
(e) Statement on method of sewage disposal

Re: Petition for Exemption from Subdivision Regulations
Dear Ms. Bowman:
I am submitting the attached Petitions for Exemption from the
subdivision regulations on behalf of my clients, Richard and Peggy
Piffer and Paul R. Chanin, Trustee.
The Piffers and Mr. Chanin would like to exchange a small
portion of their neighboring parcels for the sole purpose of
adjusting their property lines. The exchanged parcels will become
part of their existing tracts. No new parcels will be created.
In support of these Petitions, I have attached to each a map
drawn to scale showing the proposed lot subdivisions (Exhibit "A"
to each Petition.) In addition, I have enclosed a color -coded map
showing exactly what the Petitioners are proposing. The green
area shows Mr. Chanin's present parcel (approximately 52.33
acres.) The red area shows the Piffer property (approximately
2.92 acres.) The shaded areas are the portions they propose to
exchange.
I also submit the following information on behalf of these
Petitions:
1. A copy of the deed by which the Piffer's and Mr.
Chanin took title to their respective properties, and a copy of
the Quit Claim Deed by which Mr. Chanin transferred title to his
property into The Sheri Trust (Exhibit "B" to each Petition.)

2. A Vicinity Map of the subject property appears on
Exhibit "A" to each Petition.
3. The source of domestic water to the Chanin
property is the Sherwood Well No. 1, as decreed in Case No. W-679
in Water Division 5, State of Colorado, by decree dated November
22, 1972. The source of domestic water to the Piffer property is
the Snethen Well, Permit No. P-22-486.
4. Both properties utilize a septic tank for sewage
disposal.
5. No live stream crosses or adjoins either tract.
6. I also enclose copies of the Soil Conservation
Analysis provided by the Soil Conservation Service (Exhibit "C" to
each Petition.)
7. Finally, I enclose a check in the amount of $52.00
to cover the application fee for the Piffers and a check in the
amount of $51.00 to cover Mr. Chanin's application fee.

-This map unit i6 on Mountainsides and mesa breaks. Elevation is
,,400 to 7,709 feet. The average annual precipitation is 14 to
16 inches, the average annual air temperature is 42 to 46 degrees
F, and the average frost. -free period is 85 to 105 days. The
native vegetation is vainly small conifer trees, woody shrubs,
grasses, and fords.
$I01 This unit is 45 percent Tridell and 35 percent [3rownsto.
The components of this unit are so intricately intermingled that
it was not practical to map them separately at the scale used.
$I01 Included in this unit are small areas of Forelle and
Evanston soils in less sloping areas of clearings. Also included
are small areas of basaltic,-uoek outcrop and soils that are
'.:hilar to this Tridell soil but have less gravel and stones.
Included areas make up about 20 percent of the total acreage.
$101 The Tridell soil is deep and somewhat excessively drained.
It formed in alluvium and colluvium derived dominantly from
sandstone and basalt. Typically, the upper part of the surface
layer is grayish brown gravelly fine sandy loam about 2 inches
thick. The lower part is grayish brown very cobbly fine sandy
loam about 7 inches thick. The upper 16 inches of the underlying
material 1s very cobbly fine sandy loan. The next 12 inches is
very stony fine sandy loam. The lower part to a depth of 5u
inches is very stony loamy sang. Depth to hdrd basalt ranges
from 40 to 70 inches. The soil is calcareous throughout the
rofile. A thin layer of partially decomposed needles, twigs,
and leaves is or, the surface in many places.
:0I01 Permeability of the Tridell soil is moderately rapid.
Available water c,,p.iciLy 1:; low. Effective rooting depth is 20
40 inches. Runoff is rapid, and the hazard of water erosion
very high.
$I01 The Brownsto soil is deep and well drained. It formed in
alluvium derived dominantly from coarse textured calcareous
sandstone and basalt. Typically, the upper part of the surface
layer is light brownish gray gravelly sandy loam about 4 inches
thick. The lower part is 1 ignt gray loam about 7 inches thick.
The upper 10 inches of the underlying material is gravelly sandy
loam. The next 12 inches is gravelly loamy sand. The lower part
to a depth of 60 inches is gravelly sandy loam. A thin layer of
partially decomposed needles, twigs, and leaves is on the surface
in many places.
101 Permeability of the Brownsto soil is moderately rapid.
Available water capacity is low. Effective rooting depth is 20
to 40 inches. Runoff is moderately rapid, and the hazard of
water erosion is very high.
$I01 This unit is used mainly for livestock grazing and wildlife
habitat. It is also used for firewood, posts, Christmas trees,
and limited homesite development.
$I01 The potential plant community on the fridell soil is mainly
pinyon pine and Utah juniper with an understory of bluebunch
wheatgrass, Indian ricegrass, Wyoming big sagebrush, and
muttangrass. On the Brownsto soil it is mainly Wyoming big
pbrush, needleandthread, Indian ricegrass, western wheatgrass,
scattered pinyon pine and Utah juniper. Other vegetation
..ommonly present in the potential plant community on these soils
includes bottieurusn squirreitail, antelope bitterbrush, and true
mountainmahogany. The average annual pru'iuetion ut' native
-understory vegetation on the Tridell soil is about 300 pounds of
it -dry vegetation per acre.. The average annual production of
air-dry vegetation .on the drownsto soil is about 600 pounds per
acre.
$101 If the range condition deteriorates, Wyoming big sagebrush,
cheatgrass, and annual weeds increase. These plants are dominant
when the range is in poor condition; therefore, grazing should be
managed so that the desired balance of species is maintained in
the plant community. Management practices suitable for use on
this unit are proper grazing use and a planned grazing system.
Slope limits access by livestock and results in overgrazing of
the less sloping areas. Mechanical treatment is not practical,
because the surface is stony and the slopes are steep. Selective
!inning of the pinyon and juniper improves the quality of the
understory for grazing and provides firewood, posts, and
Christmas trees.
$101 The Tridell soil is suited to limited production of pinyon
pine and Utah juniper. The average annual production is
cords per acre. The average stocking rate is p;C- trees per
acre. To insure sustained yields and continued use, the kind of
wood production should be considered before using management
'practices such as thinning and cleaning. Special care is needed
to minimize erosion win thinin,), and when applying other forest
management practices. The low available water capacity generally
influences seedling survival in areas where understory plants are
,merous.
$101 This unit is poorly suited to, development. If this unit
is used for, development, the .vain limitations are slope and
`ones in the soil. Erosion is a hazard in the steeper areas.
Only the part of the site that is used for construction should be
disturbed. Topsoil .can be stockpiled and used to reclaim areas
disturbed during constructior►. Plans for homesite development
should provide for the preservation of as many trees as possible.
Removal of pebbles and cobbles in disturbed areas is needed for
best results when landscaping, particularly in areas used for
lawns. Areas in this unit adjacent to hillsides are occasionally
affected by runoff, which may also be accompanied by movement of
rock debris. Population growth has resulted in increased
construction of hones on this unit.

Re: Piffer and Chanin Petitions for
Subdivision Exemption
Dear Ms. Bowman:
As we discussed on the phone last week, Richard and Peggy
Piffer are trying to close a loan on their property by the end
of September. As a result they are anxious to get approval of
their Petition so that the exchange with Mr. Chanin can take
place prior to executing the loan documents.
In an effort to expedite the approval process, you
graciously offered to try to prepare a form resolution prior to
our meeting with the Commissioners on September 28th. Toward
that end, at your request I enclose herewith a copy of the
legal descriptions for the two small parcels that the Piffers
and Mr. Chanin want to exchange. John Baxter at KKBNA told me
he will deliver directly to you a legal description of the
balance of the Piffer property after the smaller parcel is
split off.

'"his snap unit is on :mountainsides and mesa breaks. Elevation is
,,400 to 7,709 feet. The average annual precipitation is 14 to
16 inches, the average annual air temperature is 42 to 4o degrees
E, and the average frost -free period is 85 to 105 days. The
native vegetation is .vainly :,111�311 cc,rriter trees, woody shrubs,
grasses, and fords.
$I01 This unit is 45 percent Tridell and 55 percent Brownsto.
The components of this unit are so intricately intermingled that
it was not practical to map them separately at the scale used.
$I01 Included in this unit are small areas of Forelle and
Evanston soils in less sloping areas of clearings. Also included
are small areas of basaltic, 1ktoek outcrop and soils that are
'.:riilar to this Tridell soil but have less gravel and stones.
Included areas ,make up about 20 percent of the total acreage.
$101 The Tridell soil is deep and somewhat excessively drained.
It formed in alluvium and colluvium derived dominantly from
sandstone and basalt. Typically, the upper part of the surface
layer is grayish brown gravelly fine sandy loam about 2 inches
thick. The lower part is grayish brown very cobbly fine sandy
loam about 7 inches thick. The upper 16 inches of the underlying
material is very cobbly fine sandy loan. The next 12 inches is
very stony fine sandy loam. The lower part to a depth of 5u
inches is very stony loamy sand. Depth to herd basalt ranges
from 40 to 70, inches. The soil is calcareous throughout the
rofile. A thin layer of partially decomposed needles, twigs,
and leaves is on the surface in many places.

layer is light brownish gray gravelly sandy loam about 4 inches
thick. The lower part is ligrit gray loam about 7 inches thick.
The upper 10 inches of the underlying material is gravelly sandy
loan. The next 12 inches is gravelly loamy sand. The lower part
to a depth of 60 inches is gravelly sandy loam. A thin layer of
partially decomposed needles, twigs, and leaves is on the surface
in many places.
101 Permeability of the Brownsto soil is moderately rapid.
Available water capacity is low. Effective rooting depth is 20
to 40 inches. Runoff is moderately rapid, and the hazard of
water erosion is very high.
$I01 This unit is used mainly for livestock grazing and wildlife
habitat. It is also used for firewood, posts, Christmas trees,
and limited homesite development.
$I01 The potential plant community on the Iridell soil is mainly
pinyon pine and Utah juniper with an understory of biuebunch
wheatgrass, Indian ricegrass, Wyoming big sagebrush, and
cnuttongrass. On the Brownsto soil it is mainly Wyoming big
pbrush, needleandthread, Indian ricegrass, western wheatgrass,
scattered pinyon pine and Utah juniper. Other vegetation
.,ommonly present in the potential plant community on these soils
includes bottiebrusn squirreitail, antelope bitterbrush, and true
mountainmahogafy. The average annual production of native
-understory vegetation on the Tridell soil is about 300 pounds of
it -dry vegetation per acre.. The average annual production of
air-dry vegetation .on the Brownsto soil is about 600 pounds per
acre.
$I01 If the range condition deteriorates, Wyoming big sagebrush,
cheatgrass, and annual weeds increase. These plants are dominant
when the range is in poor condition; therefore, grazing should be
managed so that the desired balance of species is maintained in
the plant community. Management practices suitable for use on
this unit are proper grazing use and a planned grazing system.
Slope limits access by livestock and results in overgrazing of
the less sloping areas. Mechanical treatment is not practical,
because the surface is stony and the slopes are steep. Selective
;inning of the pinyon and juniper improves the quality of the
understory for grazing and provides firewood, posts, and
Christmas trees.
$I01 The Tridell soil is suited to limited production of pinyon
pine and Utah juniper. The average annual production is '
cords per acre. The average stocking rate is j,,, trees per
acre. To insure sustained yields and continued use, the kind of
wood production should be considered before using management
''practices such as thinning, and clearing. Special care is needed
to minimize erosion wh!n thining and when applying other forest
management practices. The low available water capacity generally
influences seedling survival in areas where understory plants are
,merous.
$101 This unit is poorly suited to;, development. If this unit

is used for. developrnent, the :vain limitations are slope and
tones in the soil. Erosion is a hazard in the steeper areas.
4n1y the part of the site that is used for construction should be
disturbed. Topsoil .can be stockpiled and used to reclaim areas
disturbed during construction. Plans for homesite development
should provide for the preservation of as many trees as possible.
Removal of pebbles and cobbles in disturbed areas is needed for
best results when landscaping, particularly in areas used for
lawns. Areas in this unit adjacent to hillsides are occasionally
affected by runoff, which may also be accompanied by movement of
rock debris. Population growth has resulted in increased
construction of hones on this unit.
