BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted September 1,
1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the under-

respectfully petitions the Board of County Commissioners of Garfield County,
Colorado, to exempt by resolution the division of 30,6:5 acre tract of

more or less, and which tract to be subdivided is more particularly described as

Subdivision Regulations, for the reasons stated below:

A parol of land situated in the Northwest Quarter of Section 17, Township
7 South, Range 88 West of the Sixth Principal Meridian, Garfield County,
Colorado, more particularly described as fol lows :
Beginning at the Northwest Corner of said Section 17, a brass cap monument
in place; thence S.53034120"E. 828.87 feet to a rebar and cap monument at
the Southwest Corner of Government Int 4, the True Point of Beginning; thence
due east 660.24 feet along the southline of said Government Lot 4, to a rebar
and cap monument; thence 5.22°56'00"W. 476.76 feet to a rebar and cap mon-
ument, on the northerly line of County Read 113 right -of -sway; thence along
said northerly right -of --way line the follow::I.ng courses and distances; thence
northwesterly 81.53 feet along the arc of a curve to the right, having a radius
of 1048.81 feet, a central angle of 04°27'13" chord bears N.38°14'17"W. 81.50

Witnesseth, That the said part iesof the first part, for and in consideration of the sum of
Ten Dollars and other good and valuable considerations-I)O.LI.ARS,_
to the said part ie s of the first part in hand paid by the said parties of the second part, the receipt whereof is
hereby confessed and acknowledged, haVe granted, bargained, sold and conveyed, and by these presents do
rant, bargain, sell, convey and confirm unto the said parties of the second part, not in tenancy in common but in
joint tenancy, the survivor of them, their assigns and the heirs and assigns of such survivor forever, all the following
described lot or parcel of land, situate, lying and being in the County of Garfield and State
of Colorado, to -wit:
A tract of land situated in Lot 5, Sec. 17 and Lot 1, Sec. 18, all in Tp. 7 S., R.
88 W., 6th P.M. and more fully described as follows: Beginning at the Witness
Corner to Sections 7, 8, 17 and 18; thence West 38.2 feet, thence South 1797.2
feet; thence East 965 feet; thence N. 22°56' E. 1433.6 feet; thence West 690.62
,feet; thence North 70 feet; thence N. 61°2' W. 927.45 feet; to the point of
beginning, containing 38.62 acres, more or less. Together with all ditch and ditch
rights, water and water rights used on and in connection with said lands, including
therewith the interest formerly owned by Joseph McLarning in and to the Barger
'Ditch No. 33A and Priorities Nos. 37A and 113; a proportionate interest in the Mason
Ditch No. 82, together with its Priorities No. 110 and 171 in the Decrees of the
'District Court of Garfield County for Water District No. 38; less.33 of a cubic foot
ri;of water previously conveyed to Elva Campbell by Doc. No. 161437 in the records of
it
Clerk and Recorder of Garfield County.
There is excepted from the above described property the 2.92 acres hereto=
fore conveyed to Ralph A. George and Kathleen L. George by the deed recorded
as Doc. No. 219576 in Book 345 at Page 496, and the 5.07 acres heretofore
conveyed to Edward M. Greenwood and Margaret A. Greenwood by the deed
recorded as Doc. No. 212401 in Book 331 at Page 597 of the Garfield County,
Colorado records.
Together with all and singular the hereditaments and appurtenances thereto belonging, or in anywise apper-
taining, and the reversion and reversions, remainder and remainders, rents, issues and profits thereof; and all the
estate, right, title, interest, claim and demand whatsoever of the said part ie s of the first part, either in law or
equity, of, in and to the above bargained premises, with the hereditaments and appurtenances.
To Have and to Hold the said premises above bargained and described, with the appurtenances, unto the said
parties of the second part, the survivor of them, their assigns and the heirs and assigns of such survivor forever.
And the saidpart, forhemselvesa a their
parties of the first theirs executors and administrators, do
covenant, grant, bargain and agree to and with the said parties of the second part, the survivor of them, their assigns
and the heirs and assigns of such survivor, that at the time of the ensealing and delivery of these presents, they
well seized of the premises above conveyed, as of good, sure, perfect, absolute and indefeasible estate of inheritance,
in law, in fee simple, and ha ve good right, full power and lawful authority to grant, bargain, sell and convey
the same in manner and form aforesaid, and that the same are free and clear from all former and other grants,
bargains, sales, liens, taxes, assessments and incumbrances of whatever kind or nature soever, except
easements and rights of wayof a public or private nature;
and the above bargained premises in the quiet and peaceable possession of the said parties of the second part, the
survivor of them, their assigns and the heirs and assigns of such survivor, against all and every person or persons
lawfully claiming or to claim the whole or any part thereof, the said part ie s of the first part shall and will
WARRANT AND FOREVER DEFEND.
