HomeMy WebLinkAbout3.0 Resolution 77-60RESOLUTION WHEREAS, JOSEPH and MARIA HERCZEG, have petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division of a 1.6 acre tract of land into five (5) tracts of approximately 11,540 square feet, 8,400 square feet, 7,500 square feet, 7,500 square feet, and 34,756 square feet, more or less, and more particularly described as follows: A tract of land situated in Lot 4, Section 6, T6S, R89W, of the 6th P.M. and being more fully described as follows: Beginning at the Northeast Corner of said Lot 4 whence the corner common to Sections 33 and 34, which is a point on the First Correction line South and also a point on the North line of said Lot 4, bears S. 89° 50' W. 650.86 feet; thence S. 01° 06' E. 770.0 feet along the East line of said Lot 4; thence S. 890 50' W. 89.47 feet; thence N. 29° 29' E. 113.54 feet; thence N. 02° 16' W. 81.84 feet; thence N. 26° 20' W. 160.05 feet; thence N. 28° 20' W. 139.50 feet; thence N. 61° 40' E. 60.50 feet to a point on the Easterly bank of the Burton Ditch; thence N. 28° 20' W. 20.00 feet along the Easterly bank of the Burton Ditch; thence S. 61° 40' W. 60.50 feet; thence N. 28° 20' W. 136.00 feet; thence N. 19° 19' W. 197.11 feet to a point on the North line of said Lot 4; thence N. 89° 50' E. 298.03 feet along the North line of said Lot 4 to the point of beginning. Together with all water and water rights connected therewith or appurtenant thereto. There is excepted herefrom all that portion of the above described property described in deed recorded as Doc. No. 235776 in Book 378 at Page 384. WHEREAS, the Petitioners have shown to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that they desire said exemption for the purpose of re -sale into single-family residential acreage; and, WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board that both water and sewer service would be obtained from the West Glenwood Water and Sanitation Districts, that there is adequate ingress and egress to said tracts, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivision land: as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended; tc� Y v it Ve. Pk. vein C'e and carried, said 1.6 acre tract of land is NOW THEREFORE, upon motion of seconded by hereby exempted from such definition and transfer of said tract may be made by division into five (5) tracts of 11,540 square feet, 8,400 square feet, 7,500 square feet, 7,500 square feet, and 34,756 square feet, more or less, and further that before conveying any of the above tracts of land a proper legal description be prepared. A copy of the instrument or instruments of conveyance when recorded shall be filed withtthis Resolution. Dated this 21S- day of --1�� �y , A.D. 1977.
