PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30 -28 -101(10)(a) -(d) as amended, and the
Subdivision Regulations of Garfield County, Colorado, adopted April 23, 1984. alae
undersigned William & Sandy Heley respectfully petitions the li o.rd of
County Commissioners of Garfield County, Colorado, to exempt by Resoiutier:
division of 43,75 acre tract of land into 2— tracts
of approximately 8, 25 A & 35 acres each, more or less, ti+:>tr the
definitions of "subdivision" and "subdivided land" as the terms are used and defined in
C.R.S. (1973) Section 30-28-101 (10)(a) -(d) and the Garfield County Subdivision
Regulations for the reasons stated below:

The Board of County Commissioners has the discretionary power to exempt a division of land from
the definition of subdivision and thereby from the procedure in these Regulations, provided the Board
determines that such exemption will not impair or defeat the stated purpose of the Subdivision
Regulations nor be detrimental to the general public welfare. The Board shall make exemption
decisions in accordance with the requirements of these regulations, Following a review of the
individual facts of each application in light of the requirements of these Regulations, the Board may
approve, conditionally approve or deny an exemption. An application for exemption must satisfy, at
a minimum, all of the review criteria listed below. Cotnpliance with the review criteria, however,
does not ensure exemption. The Board also may consider additional factors listed in Section g:60
of the Subdivision Regulations,
A. No more than a total of four (4) lots, parcels, interests or dwelling units will be created
from any parcel, as that parcel was described in the records of the Garfield County Clerk
and Recorder's Office on January 1, 1973, In order to qualify for exemption, the parcel as
it existed on January 1, 1973, must have been 35 acres or greater in size at that time and
not a part of a recorded subdivision; however, any parcel to be divided by exemption that
is split by a public right-of-way (State or Federal highway, County road or railroad),
preventing joint use of the proposed tracts, and the division occurs along the public right-of-
way, such parcels thereby created may, at the discretion of the Board, not be considered to
have been created by exemption with regard to the four (4) lot, parcel, interest or dwelling
unit limitation otherwise applicable. For the purposes of definition, all tracts of land 35 acres
or greater in size, created after January 1, 1973 will count as parcels of land created by
exemption since January 1, 1973.

Kit here is the provisions for the Healy Exemption driveway mit.
1. Driveway entrance will be 40 feet wide to accommodate large vehicles and due to the turning radius
from County Road 306.
2. 40 feet of galvanized culvert pipe will be installed in the bar ditch to continue drainage flow.
3. A slope of no more than 4% away from County Road 306 will be required to prevent drainage onto
County Road 306.
4. A S0 -foot section of Class 6% inch road base surface cover 40 foot wide into driveway will be required.

In regard to the subdivision exemption for William and Sandy Heley,
Practical Description: Parcel is located west of Parachute, near the 7
mile marker along County Road 306.
Said subdivision exemption will create two (2) tracts of land from
44 acre+/- parent tract. The two (2) tracts of land created will be about
8,36 acres in size, more or less.
We feel that due to the rural area and size of adjacent properties of
35 acres or more , approval of this exemption would create a precedent
for future development of small parcels.
We suggest that the 35 acre minimum be adhered to. We therefore
object to the exemption.

Explanation of Exemption Request
The land is situated on a volcanic outwash terrace on the northwest
slope of Battlement Mountain. The terrace is bisected by a deep gulch
on the eastern side, and east of that gulch is very rocky, covered with cedar
trees growing in a thin soil mantle. On the western side, is a section
of very similar terrain before coming to a irrigated grass pasture stooping
about 5% northward toward the Colorado River.
The terrain lends itself to a natural split separating the rockier
portion with a cedar knoll and view to the mountains and river for a
housesite. We were hoping to split out this parcel, possibly as a
homesite for our son and his wife, and to keep the irrigated pasture
parcel for our horses and home.

Map unit: 58 Potts-Ildefonso complex, 12 to 25 percent slopes
Description Category: SOI
These soils are on mesas and sides of valleys. The Potts soil formed in alluvium
derived from sandstone, shale, or basalt. The Ildefonso soil formed in very strongly
calcareous, basaltic alluvium and small amounts of eolian material. Potts soil makes up
about 60 percent of the map unit, and the Ildefonso soil makes up about 30 percent.
Potts soil is deep and well -drained. The surface is loam about 4 inches thick. The
subsoil is clay loam about 24 inches thick. The substratum is loam to a depth of 60
inches. Permeability is moderate, and available water capacity is high. Effective ro
oting depth is 60 inches or more. Runoff is rapid, and the erosion hazard is high.
Ildefonso soil is deep and well drained. The surface layer is stony loam about 8 inches
thick. The underlying material is very strongly calcareous very stony loam to a depth of
60 inches. Permeability is moderately rapid, and available water capacity is
low. Effective rooting depth is more than 60 inches. Runoff is rapid, and the erosion
hazard is high.

CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested
water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-92-602(3)(b)(II)(A) as the only well on a tract of land of 39.457 acres described as that
portion of the SVV 1/4, SE 1/4, Sec. 35, Twp. 7 South, Rng. 96 West, 6th P.M., Garfield Caw rio,„ par described on
the attached exhibit A.
4) The use of ground water from this well is limited to fire protection, ordinary household purposes inside not more than
three (3) single family dwellings, the irrigation of not more than one (1) acre of home gardens and lawns, and the watering
of domestic animals.
5) The maximum pumping rate of this well shall not exceed 15 GPM.
6) The return flow from the use of this well must be through an individual waste water disposal system of the
non -evaporative type where the water is returned to the same stream system in which the well is located.
7) This well shall be constructed not more than 200 feet from the location specified on this permit.
NOTICE: This permit has been approved for the location as noted above. The original proposed location did not place the
well on the parcel. The Footage distance from the South section line was amended locating the well iri the center of the
parcel. You are hereby notified that you have the right to appeal the issuance of this permit, by fling a written request with
this office within sixty (60) days of the date of issuance, pursuant to the State Administrative Procedures Act. (See Section
24-4-104 through. 106, C.R.S.)

After speaking with you regarding your subdivision project west of Parachute at or near
the Una area, I offer the following as minimum requirements for such a proposal.
The options available to you include either a local water supply for each residence or a
central pressurized water supply for all residence as well as fire protection sprinklers.
Because of the size of your project, it would appear that the localized water supply
systems (NFPA 1231) and fire protection sprinkles might be better suited to provide such
protection.
The use of sprinklers in new construction is always encouraged, and has proved to be both
cost effective and to have made the critical difference in the "saving of a structure". The
key element of a 13D system is to provide enough suppressant to get the occupants out of
the residence. The system is designed to provide a 10 -minute water supply. In a normal
urban setting, with prompt notification to the fire department, a response and
extinguishment can be started during this 10 -minute time frame. However, with a small
volunteer fire department, which does not staff fire station crews, response times can be
much longer. Hence, it is hoped the sprinklers provided enough time for the occupants to
leave, but the fire has most likely continued to burn, and after the 10 -minute period of
water delivery, the fire may again start actively burning.
The recommendations of NFPA 1231 are to have a water supply located within 150 feet
of a residence, a 4 '/z" hydrant connection capable of providing 500 gpm and a capacity to
be determined by the square footage of the residence. After consulting other agencies
within Garfield County, a minimum size of 2500 gallon tank per lot is a reasonable
requirement for residence under 3500 square feet. Sprinkler systems would be optional
for residence up to 3500 square feet. Residences over 3500 square feet will need to have
both the calculated size storage tank and a sprinkler system to provide initial knockdown
capabilities. As far as access / egress requirements & defensible space, the Colorado State
Forest Service has recommended using the NFPA 299 standard, Protection of Life and
Property from Wildfire.
