BEFORE THE BOARD OF COUNTY COMMISSIONERS
OF GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. 1973, 30-28-101(10)(d) the undersigned,
George J. Petre, respectfully petitions the Board of County
Commissioners of Garfield County, Colorado to exempt, by
resolution, from the definition of "Subdivision" and "Subdivided
Land" a certain parcel of land owned by said petitioner and,
in connection therewith, would show said commissioners as
follows:
1. That petitioner is the owner of certain property
generally located southerly of Glenwood Springs, Colorado,
on Cattle Creek, containing 27.78 acres, more or less, being
more specifically described as follows, to -wit:
STATE OF COLORADO - COUNTY OF GARFIELD
A parcel of land situate in Lot 13 of Section 10,
Township 7 South, Range 88 West, 6th P.M., being
shown (outlined in black) on Exhibit "A" attached
hereto and by reference made a part of hereof;
2. That petitioner has caused the above described
property to be surveyed into three separate parcels, each
containing 9.26 acres, more or less, for which the exemption
is sought, and said parcels are more specifically shown in
said Exhibit "A" (outlined in red) and labeled Parcel 1,
Parcel 2, and Parcel 3, and each parcel is more specifically
described as set for in Exhibits "Al", "A2" and "A3"
attached hereto and by reference made a part hereof;
3. That exemption of said property is sought to
unable the petitioner to sell said parcels;

4. That each of said parcels is adjacent to Garfield
County Road No. 113 and each has access to said road, and
telephone and electrical lines are adjacent to said proper-
ties as such lines are currently installed along the fore -
said county road;
5. That petitioner desires to sell the parcels in
the sizes indicated, and the size of each parcel lends it-
self to division in this manner due to the fact that each
is of such size that makes it susceptible to location of
both a water well and septic system, with leach field, and
the size of each will maintain and promote the characteristics
of development of neighboring properties for "ranchette" style
purposes and uses;
6. That, at the time of the sale of each said parcel,
petitioner will cover each said parcel with covenants re-
stricting the use of each parcel for single family dwellings,
with appropriate outbuildings, and, inter alia, prohibit
the raising of livestock and other animals for commercial
purposes and require certain square footage minimum on dwell-
ings to be constructed thereon;
7. The granting of this exemption will in no way
interfere with the property rights of others, will permit
the undersigned to use and benefit from ownership of said
property, will maintain the existing character of the area
and is within the spirit of Senate Bill No. 35 allowing
division of land in his manner.

88 West of the Sixth Principal Meridian, lying Northerly of the Southerly line
of said Section 10, Easterly of the Westerly line of said Section 10 and South-
erly of the Southerly right-of-way line of a county road as constructed and in
place being County Road No. 113, said parcel of land is described as follows:
Beginning at the Section Corner common to Sections 9, 10, 15, and 16 in said
township and range; thence N.00°16'17" W. along the Westerly line of said Sec-
tion 10, 1070.37 feet to a point on the Southerly right-of-way line of said
County Road; thence N.89°03'00" E. 370.89 feet along said right-of-way line;
thence South 1120.26 feet to a point on the Southerly line of said Section 10;
thence N.83°10'43" W. along the Southerly line of said Section 10, 368.38 feet
to the Southwest Corner of said Section 10, the point of beginning.
The above described parcel of land contains 9.26 acres, more or Tess.
