At a regular meeting of the Board of County Commissioners,
for Garfield County, Colorado, held in the Commissioners' Meeting Room,
Garfield County Courthouse in Glenwood Springs on Monday , the 25th
day of February A.D. 185, there were present:

When tne following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 85-32
A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT
APPLICATION BY JERRY FAZZI AND JON JULIUS
WHEREAS, the.Board of County Commissioners of Garfield County,
Colorado, has received an application from Jerry Fazzi and Jon Julius for
a Special tJse permit for'an agriculture related.bus.iness, specifically,
farm equipment sales and livestock auction on the following described
tract of land:
See Exhibit "A"
(in the State of Colorado and the County of Garfield); and
WHEREAS, pursuant to required public notice, the Board conducted a
public hearing on the 19th day of February, 1985, upon the question of
whether tne above-described Special Use permit should be granted or
denied, at which nearing the public and interested persons were given the
opportunity to express tneir opinions regarding tne issuance of said
special Use permit; and,
WHEREAS, tne Board on the basis of substantial competent evidence
produced at the aforementioned hearing, has made the following
determination of fact:
1. That proper publication and public notice was provided as
required for the nearing before tne Board of County
Commissioners.
2. That the hearing before•tne Garfield County Commissioners was
extensive and complete, that all pertinent facts, matters and
issues were submitted and that all interested parties were heard
at that hearing.
3. That the proposed Special Use permit application is in general
compliance witn the Garfield County Zoning Resolution.
4. The proposal is generally compatinle with the existing land uses
in the area.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Garfield County, Colorado that the Special Use permit be and hereby is
authorized permitting the use.of the above described tract of land for an
agriculture related business; specifically farm equipment sales and
livestock auction upon the following specific conditions:
1. That the use of the tract of land comply with all regulations of
Garfield County relating to agriculture related business in the
zone district in which the property is located.
2. All proposals of the applicant snail be considered conditions of
approval unless stated otherwise by the Board of County
Commissioners.
3. That all conditions must be met within 120 days and that .the said
Special Use permit shall be taken out within 120 days of the date
of issuance of the resolution approving the Special Use permit
unless an extension is granted by the Board of County
Commissioners.
4. The Special Use permit shall only be valid for a period of 120
days from tne date of issuance unless construction or use has
commenced thereunder; and if construction or use has not
commenced within this specified period, the permit snail expire.
5. That the petitioner screen tne east boundary of the property with
a row of Russian Olive trees, or other appropriate vegetation.
6. Use of the site shall be limited to tne proposed uses for Farm
Equipment Sales and Livestock Auction.
7. That tne applicants shall, to the best of their ability, mitigate
impacts on surrounding property, including but not limited to,
noise, odor, glare, traffic and visual impacts.
