PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101(10)(a) - (d) as amended,
and the Subdivision Regulations of Garfield County, Colorado, adopted
September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and

A parcel of land situated in the SWIT, of Section 11, Township 6 South, Range Pi,West of the
Sixth Principal Meridian, County of Garfield, State of Colorado; said parcel of land is
described as follows:
Beginning at an iron post with a brass cap found in place and properly marked for the
SW Corner of said Section 11; thence N. 63°51'33" E. 1676.65 feet to a point in County
Road No. 311 the True Point of Beginning; thence N. 03°44'26" W. 360.58 feet along a
fence as constructed and in place; thence S. 82°54'20" W. 420.27 feet along said fence;
thence N. 03°44'26" W. 243.32 feet; thence N. 82°54'20" E. 600.00 feet; thence S.03°44'26"
E. 600.00 feet to a point in said County Road No. 311; thence S. 82°14'54" W. 58.15

COMPLAINT
COMES NOW the Plaintiff, above named, by and through its
attorney, the attorney for the County of Garfield, and by way of
Complaint against the above-named Defendants, states and alleges
as follows:
FIRST CLAIM FOR RELIEF
1. Defendants, Barton Porter and Carl O. Short at all times
mentioned herein were and still are the owners of the fol-
lowing described premises in the County of Garfield, State
of Colorado, to wit:
A tract of land situated in Lot 9 of Section 10
and Lots 6, 7, 8 and 9, the S1/2SW4, the N1/2SE4 and
Sw4sE4 of Section 11 and Lot 8 of Section 12, all
in Township 6 South, Range 92 West of the 8th
Principal Meridian, lying Southerly of the center
of the Colorado River, Easterly of a fence,Nor-
therly of the centerline of the County Road and
Westerly of the centerline of Divide Creek, and
being described as follows:
Beginning at a point in Said Lot 9, said point
being at the corner of the existing fence, whence
the Section Corner common to sections 10, 11, 14
and 15 in said Township and Range bears: S. 29014'
18" E. 1067.50 feet; thence N. 00°54106" W. 900.24
feet along said fence to a point in the center of
a Channel of the Colorado River; thence S. 89°55'
04" E. 349.37 feet along the center of said River

thence along said centerline 314.14 feet along the
arc of a curve to the left having a radius of 524.60
feet, the chord of which bears: S. 76°39'33" W.
309.47 feet; thence along said centerline S. 59°30'
15" W. 304.90 feet; thence along said centerline S.
62°26'19" W. 439.98 feet; thence along said center-
line S. 65°34'33" W. 184.00 feet; thence along said
centerline S. 67°28'53" W. 265.22 feet; thence along
said centerline S. 67°25'03" W. 354.34 feet; thence
along said centerline S. 70°53'00" W. 1230.41 feet;
thence along said centerline 380.88 feet along the
arc of a curve to the left, having a radius of
2624.93 feet, the chord of which bears: S. 66°43'36"
W. 380.54 feet; thence along said centerline S. 62°
34'11" W. 357.75 feet; thence along said centerline
132.14 feet along the arc of a curve to the right,
having a radius of 384.73 feet, the chord of which
bears: S. 72°24'32" W. 131.49 feet; thence along
said centerline S. 82°14'54" W. 282.56 feet; thence
along said centerline S. 81°23'24" W. 121.85 feet;
thence N. 03°44'26" W. 360.58 feet along a fence to
a fence corner; thence S. 82°54120" W. 1219.09 feet
along said fence; thence S. 88°48'43" W. 793.46 feet
along said fence to the point of beginning, and con-
taining 217.89 acres, more or less, EXCEPT minerals
and mineral rights previously reserved. SUBJECT to
all road and ditch rights-of-way, easements and
rights-of-way of record or in use.
which premises are located within an unincorporated area
of Garfield County.
2. On a date unknown to Plaintiff, but on or about and no later
than April 7, 1976, Defendants moved or caused to be moved
upon the above-described premises an approximately 12 foot
wide by 65 foot long mobile home.
