HomeMy WebLinkAbout2.0 Resolution 77-67• • RESOLUTION 11-] -1 -(G 7 WHEREAS, MARTHA PORTER, has petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28- 101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division of a 215 acre parcel of land into two parcels of 4.82 and 210.18 acres, more or less, and more particularly described as follows: A parcel of land situated in the SW4 of Section 11, Township 6 South, Range 92 West of the Sixth Principal Meridian, County of Garfield, State of Colorado, said parcel of land is described as follows: Beginning at an iron post with a brass cap found in place and properly marked for the SW Corner of said Section 11; thence N. 63° 51' 33" E. 1676.65 feet to a point in County Road No. 311 the True Point of Beginning; thence N. 03° 44' 26" W. 360.58 feet along a fence as constructed and in place; thence S. 82° 54' 20" W. 420.27 feet along said fence; thence N. 03° 44' 26" W. 243.32 feet; thence N. 82° 54' 20" E. 600.00 feet; thence S. 03° 44' 26" E. 600.00 feet to a point in said County Road No. 311; thence S. 82° 14' 54" W. 58.15 feet along a line in said County Road No. 311; thence S. 81° 23' 24" W. along a line in said County Road No. 311, 121.85 feet, more or less to the True Point of Beginning. WHEREAS, the Petitioner has shown to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that she desires said exemption for the purpose of re -sale into single-family residential acreage; and, WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended; NOW THEREFORE, upon Ve!1 CSC-t-i.ct-- and carried, said 215 acre tract of land is hereby exempted from such definition and transfer of said tract may be made by division into two tracts of 4.82 and 210.18 acres, more or less, all as is more fully described above.
