Dear Mr. & Mrs. Porter:
As you are aware, the Board of County Collunissioners approved your S.B. 35
Exemption with the following seven conditions:
1. That a letter be received from the Division of Water Resources
approving the proposed use of the domestic well or that a new
individual well permit be obtained for the 4 acre lot.
2. That a driveway access permit be obtained from the Garfield
County Road and Bridge Department for the 4 acre lot, prior to
final approval.
3. That a plat of the three lots be submitted to the Department of
Development including the following information:
a. Legal descriptions of each lot shall be written separately
on the plat including the legal description of all
waterline, well and ditch easements.
b. All waterline, well and ditch easements be shown on the
plat.
c. There shall be signature blocks for the County Surveyor and
the Board of County Commissioners.
d. The plat shall read Porter Exemption and make reference to
the Resolution Number approving the exemption.
e. A note be placed on the final plat that states no further
exemption shall be allowed on these parcels.
4. That prior to final approval, $400.00 ($200.00 per lot) shall be
paid to the Department of Development for the School Impact fee.
5. A declaration of easements shall be submitted prior to final plat
approval.
6. All conditions must be rnet within 120 days.
7. Only one dwelling unit shall be used for residential purposes on
the 23 acre lot.

Dear Mr. and Mrs. Porter:
As you are aware, the Board of County Commissioners have conditionally
approved a S.B.35 exemption for your 35 acre parcel in Section 23 T7S,
R92W. This decision was made on May 14, 1984. Condition #7 states that
you must meet all conditions of approval within 120 days. Thus, you have
until September 14, 1984, to meet all conditions of approval or your
conditional approval will expire.
The conditions are as follows:
1. That a letter be received from the Division of Water Resources
approving the proposed use of the domestic well or that a new
individual well permit be obtained for the 4 acre parcel (a
letter from the Division of Water Resources was received May 21,
1984).
2. That a driveway access permit be obtained from the Garfield
County Road and Bridge Department for the 4 acre lot, prior to
final approval.
3. That a plat of the three lots be submitted to the Department of
Development including the following information:
a. Legal descriptions of each lot shall be written separately
on the plat including the legal description of all
waterline, well and ditch easements.
b. All waterline well and ditch easements shall be shown on the
plat.
c. There shall be signature blocks for the County Surveyor and
the Board of County Commissioners.
d. The plat shall read Porter Exemption and make reference to
the resolution number approving the exemption.
e. A plat note shall state that no further exemptions shall be
allowed on parcels created by the exemption.

4. That prior to final approval, $400.00 ($200.00 per lot) shall be
submitted to the Department of Development for the school impact
fee.
5. Each of the three parcels shall have a partial interest in the
well, waterlines and ditch easements. A declaration of easements
shall be submitted and reviewed prior to final approval.
6. All conditions of approval must be met within 120 days.
7. Only one dwelling unit shall be used for residential purposes on
h%e 23 acre lot.

frame to meet the conditions of approval of your Senate Bill 35

RE: Senate Bill 35 Exemption extension for Bill and Della Porter

Dear Commissioners;
You approved an exemption last spring for the Porters. Then in
September you approved a sixty (60) day extension of that exemption.
Economic conditions still prevent the expenditures necessary to
complete the conditions of the exemption approval. Surveys up
West Divide Creek tend to get costly. Because of cost, Porters
have hoped that they would have had the opportunity to put some
property under contract to sell before incurring the cost of a survey
and other conditions of the exemption.
Acting as their agent, I can state that real estate activity in
the West Divide Creek area is almost nonexistent. With the farm and
ranch business also being poor, it is impossible to incur the cost of
the exemption conditions at this time. However the Porters want to
keep the exemption and/continue to accept the conditions thereof.
The Porters would like to have the exemption extended through
the winter months, with enough time to possibly sell the property this
coming spring, or find another way to finance the cost of the conditions.

Re: SB 35 Exemption Request
Dear William and Della:
This letter is in regard to the above referenced application which you
currently have pending with the Garfield County Planning Department and,
based on our records, has not received any final approval.
Additional submittals or conditions of approval remain to be satisfied
prior to any final approval of your application. These conditions are
outlined on your Resolution of Conditional Approval or in the minutes of
your meeting with the Board of County Commissioners and are available
through this office. Our staff is available to assist you in clarifying
what conditions remain to be completed.
The standard time limit and your requested extensions to satisfy these
conditions, as indicated in your Resolution of Conditional Approval or the
Subdivision Regulations, has expired. We request that you contact this
office within 30 days and indicate if you are still actively pursuing
approval of your proposal. If this is the case, further extensions can be
requested.
If you do not intend to pursue final approval or do not contact this
office within 30 days, it will be necessary for triis office to begin
action to formally withdraw any approvals and close your file.
We encourage you to contact this office as soon as possible and look
forward to working with you in regard to this matter.

Dear Mr. Porter:
Your request of January 28th to actively pursue completion of a SB 35
Exemption Request proposed on your property has been reviewed by the
Garfield County Board of County Commissioners and the County Attorney.
The Board has determined that they will reconsider your SB 35 application,
however due to the expiration of required time limits and extensions
thereof, a public meeting will be required. No additional application
fees or information will be needed. Public notice for the meeting will be
required including mailings to adjacent property owners and mineral rights
owners in addition to posting the site.
Notice forms and poster will be provided by the Planning Department,
however you will be responsible for the actual completion of the notice
requirements.
As all previous approvals are technically void, due to the expiration of
the required time limitations, it is important that you initiate this
reconsideration process as soon as possible. Please contact this office
for further information and if you have any additional questions or
concerns.
