(1973) Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted April 23, 1984, the undersigned Hish Aspen Ranch respectfully petitions the Board of County Commissioners of Garfield County, Colorado, to exempt by Resolution the division of 73.84 acres of a 1.146.296 acre land holdins (formerly Buck Point Ranch) into two tracts of approximately 69.821 acres. with 1.142'276 acres remainino of the orisinal land holdins. and 4.019 acres each, more or less, from the definitions of .subdivision' and 'subdivided land' as the terms are used and defined in C.R.S. (1973) Section 90-28-101(10) (a) - (d) and the Garfield County Subdivision Regulations for the reasons below. SUBMITTAL REQUIREMENTS ENCLOSED: Figure A. A sketch map is enclosed of 1" = 400' (in order to display the entirety of the subject property on a single plan sheet) showing the lega! description of the entire property, dimension, and area of all (two) lots of separate interest to be created, access to a public right-of-way (shared through Parcel 1 of Homestead Estates), and no proposed easements for drainage, inigation, or utilities except as cunenfly exists. Also enclosed is a blow-up of the proposed 4.02 acre lot. Figure B. Two vicinity maps are enclosed at a scale of 1" = 2,000'and 1' =1,760' (in addition to a location map at a scale of 1" = 19,200' or 2" =five miles to portray a more regional situation) showing the general topographic and geographic relation of the proposed exemption to the surrounding area within two miles. Figure c. A copy of the deed is enclosed showing ownership by the applicant (including the Quit Claim Deed correcting the prior error of an add-on of the subject 4.02 acres to Parcel 1 of Homestead Estates). Figure D. A list of the names and addresses of the owners of record of land immediately adjoining and within 200 feet of the proposed exemption of the property to be exempted is enclosed. Maintenrnce and Imorovement of Access Easement. LMK shall have the right to perform such maintenance and repair and to make such improvements to the Access Easement and the roadway therein as LMK may determine to be necessary or appropriate from time to time, provided that all such maintenance, repair and improvements shatl be performed in a good and workmanlike manner and in compliauce with all applicable codes. Further, LMK hereby covenants and agre$ to keep and maintain the entire length and width of the roadway within the Access Easement in a good and attractive condition and state of repair, at LMK's sole cost and expense. 3. Permitted Users. All family members, guests, invitees, employees, tenants, agents and contractors of LMK, and ofLMK's successors and assigns in the ownership of all of any part of Buck Point Ranch, shall be permitted to use the Access Easement for the purposes set forth herein, subject to all terms and provisions of this Grant of Easement. In addition, all emergency vehicles (police, fire, ambulances, etc.), school busses, and postal service vehicles shall be permitted to sue the Access Easement for tleir respcctive purposes. 4. Llabillty Insurance. LMK or its successors and/or assigns in the ownership of Buck Poiot Ranch agrees to maintain in effect at all times at its sole cost and expense, a liability insurance policy covering injury, Ioss or damage to persons or property arising from the use of the Access Easement by LMK or its successors or assigns in the ownership of Buck Point Ranch. Spracher shall bc an additional named insured in said policy. If a homeowners association is eventually formcd to govem the affairs of the owners of residential lots or parcels in Buck Point Ranch, LMK's obligations under this Paragraph 4 may be assigned to that Association. 5. Attorneys' Fees. In the event ofany litigation arising out ofthis Grant of Easement, including the interpretation of enforcement of any of the terms or provisions hereoi the prevailing party shall also be entitled to recover'its reasonable attomeys' fees and costs incurred therein. The laws of the State of Colorado shall govern the interpretation, validity, performance and enforcement of this Grant of Easement. Any legal action brought in connection with this Grant of Easement shall be commenced in the District Court of Garfield County, Colorado, and each party hereto hereby voluntarily submits to the jurisdiotion of such court. 7. Counterparts: Facsimile Sisnatures. This Crant of Easement may be executed in counterparts, in which case all such counterparts together shall constitute one and the same instnrment which binding on all of the parties thereto, notrvithstanding that all of the parties are not signatory to the original or the same counterpart. Facsimile signatures shall be treated as original signatures hereon. 8. Bindlng Effecti Covenants Runnlng With the Land. This Grant of Easement shall be binding upon and inure to the benefit ofthe parties hereto and their respective heirs, personal representativcs, succqssors and assigns forever, and the benefits and burdens hereof shall constitute covenants running with the title to Parcel I and Buck Point Ranch and all parts thcreof. Further, the Access Easement shall be deemed appurtenant to Buck Point Ranch and all parts thereof. 9. Entire Apreement. This Grant of Easement constitutes the entire understanding and agreement between the parties relating to the subject matter hereof. All prior representations or agreements relating to the subject matter hereof, whether written or oral, are hereby merged into this Grant of Easement. The average annual production of air-dry vegetation is about 900 pounds per acre. The potential plant community on the Morval soil is mainly needleandthread, western wheatgrass, muttongrass, prairie junegrass, and big sagebrush. The average annual production of air-dry vegetation is about 1,500 pounds per acre. The main limitation for range seeding or mechanical treatment is the surface stoniness in areas of the Showalter soil. Suitable management practices include proper range use, deferred grazing, and rotation grazing. Aerial spraying is suitable for brush management. lf this unit is used for hay and pasture, the main limitations are the surface stoniness, the slope, and the slow permeability in the Showalter soil. Grasses and legumes grow well if adequate fertilizer is used. This unit is very poorly suited to homesite development. The main limitations are the slope, the shrink-swell potential, and the stones throughout the profile. This map unit is in capability subclass Vle, nonirrigated.
