WHEREAS, Robert and Oorothy Pretti have petit,ioned the Board of County Commissioners of Garfield Countyr Colorado, for an exempt.ion fromthe definit,ion of t,he t,erms nsubdivision'and'subdivided land' underC.R.S. 1973, 30-28-101 (10 ) (a )-(d ) , as amended, and Ehe SubdivisionRegulations of Garfield Countyr Colorado, adopt.ed april 23, 1984, Section8:00 through 8:60 and for the division of a 284.40 acre Lract as describedin Book 507 , Page 27L, as filed in the Office of Ehe Clerk and Recorder of Garfield Countyr Colorado inLo two (2) parcels of approximately 276.91 and 7.49 acres each, more or less, which proposed divided parcels are morepractically described as follows: Parcel A: Parcel B: See attached Exhibit "A" All of Ehe parcel described as RecepEion No. 284108in Book 507, Page 27J-, in t,he office of the carfield Count,y CIerk & Recorder, less thaE propert.y describedin Parcel 'A" above. (in the State of Colorado and the County of Garfield); and WHEREAS, the Petitioners have demonst.rated to the satisfaction of t.he Board of County Commissioners of Garfield CounEy, Colorado, that the proposed division does noE fa1l within the purposes of ParE 1, ArEicle 28, Title 30, Colorado Revised Stat.utes I973, as amended, for the reason thatthe division does not vrarrant further subdivision review, and WHEREAS, the PeEiEioners have demonst,raEed t,o the saEisf action of the Board of County Commissioners of Garfield CounLy, Colorado, thaE there isa reasonable probability of locabing domestic water on each of saidparcels, that Ehere is exisbing ingress and egress to said parcels, that, t,he location of septic tanks will be permiEEed by the Colorado DeparEment,of Hea1th, that the requested division is not part of an existing orlarger devel.opmenE and does noE fal1 within the general purposes andintenE of t.he subdivision regulaLions of the State of Colorado and t,he County of Garfield, and should, therefore, be exempted from the definit,ion of Ehe terms 'subdivision' and 'subdivided land' as set, fort,h in C.R.S. 1973, 30-28-10f (10) (a)-(d), as amended; NOW THEREE'ORE, BE IT RESOLVED Ehat t,he division of the above describedparcels oAn and "Bn from the above described 284.40 acre tract is herebyexempted from such definitions and said tract may be divided into'saidparcels 'An and 'B' and may be conveyed in the form of such parcels nA' ?nd "8", all as is more fully described above and t,hat a Lopy of theinstrument or instruments of conveyance when recorded shaIl be fileO withthis Resolution.
