II .DESCRIPT]ON OF THE PROPOSAL
Site Description: The site is located in a rural portion ofthe County, with land uses in the vicinity mainlyagricultural and single-family residential. Improvements onLhe overall site include a residence and several sheds,while the proposed 7 acre tract is vacant. An irrigationditch crosses the 7 acre tract adjacent to County Road 214.
Project, Description: The applicant proposes to divide theffi two parcels, 7 acres and 167 acres insize. (See Page
C. History: The Board of County Commissioners did approve thecreation of four parcels on the site by subdivision
exemption in 1987 (Resolution #87-83). One of these splits
was based on separation by a County road, and therefore didnot count toward the four lot limit on lots being created by
exemption since 1973.

3. The applicant has submitted copies of a contract with the
West Divide lrlater Conservancy District providing for a
domestic water supply for Lhe proposed 7 acre tract.
Assessor rs office information indicates that the site islocated in the Silt-New Castle Fire Protection District.Verification from the District that they do serve the site
should be provided.
Soil Conservation Service soils information indicates thatportions of the site may be subject to severe limitations onseptic systems and foundations due to slopes and largestones in the soil.
SUGGESTED FIND]NGS
1. That proper posting and public notice vras provided asrequired for the meeting before the Board of County
Commissioners .
That the meeting before the Board of County Commissionerswas extensive and complete, that all pertinent facts,matters and issues were submitted and that all interestedparties were heard at thaL meeting.
That for the above stated and other reasons, the proposed
exemption is in Lhe best interesL of the health, safety,morals, convenience, order, prosperity and welfare of thecitizens of Garfield County.
RECOMMENDATTON
APPROVAL, with the following conditions:

That the applicant submit a l-etter from the Silt-New CastleFire District indicating that they serve the site.
That the applicant submit $200 in School fmpact Fees for thecreation of one new lot.
That all representations of the applicant, either within theapplication or stated at the meeting before the Board ofCounty Commissioners, shall be considered conditions of
approval .

The Subject 7 acres ls non-productive, non-irrigatabl-e, agrlculturalland, that offers a very desirable homesite location. The parlel doesnot signiflcantly contrlbute to the agrlcultural incom" g"rr"r.ted by theremainder of the farm ground. Because of locatlorr, a""""s, and vl.ew, thehighest and best use for the subJect property woul_d be that of a ruralhomesite.
In addressing part of the ltems in the applicatlon regulrements fromparagraph F & G, the sewage dlsposal systen would be by r"itt" tank andleach field meeting county specificattrons. The subJect property does notfaII within the boundaries of a fire protectlon dlsirict, nor fs wlthlna counmunlty or munlclpal water or sewer system.
Pubric access could be frou either county roads, 233 or 2L4, whlchboth adjoin the property. An Lrrigation easement and a utility easementboth cross the property for which title reservations would be made.
One acre foot of water has been purchased from the West Dividewater conservancy Distrlct for augmentation purpose in applylng fot adomestic welJ- perurit to satlsfy the requlrement of a legai and-adeguatesource of donestic Lrater for the subject property.
