APPLICANT: Marlin (Colorado), Ltd. LOCATION: A tract of land located in a portions of Sections 24 and 35, T6S, R88W of the 6th P.M.; located approximately '/2 mile south of Glenwood Springs off of County Road 163. SITE DATA: 191.0 Acres WATER: Well SEWER: ISDS ACCESS: CR 163 EXISTING/ADJACENT ZONING: A/R/RD RELATIONSHIP TO THE COMPREHENSIVE PLAN The site for the proposed lots is located in the Medium Density Residential (6 to less than 10 ac/du) and the Low Density Residential (10 and greater ac/du) on the Proposed Land Use Districts, Study Area 1 Map. The proposed lots are consistent with the proposed density in the Comprehensive Plan, since the average density of the whole property exceeds 10 ac/du. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The property is located on adjacent to the Roaring Fork river, due south of the Glenwood Springs municipal airport. Four Mile Creek runs through a portion of the northeastern section of the property. The original owner's house is located on the property, along with various other buildings. All of the proposed new lots are located on a bench located above the river, that is presently an open pasture -1- area. Most of the property sits on a north facing slope, with slopes ranging from 12% to 65% according to the soils information contained in the application. The native vegetation is primarily sagebrush and scrub grasses. 1 B. Project Description: The applicants are proposing to amend the exemption at for the Prehm Ranch which split a 191.0 acre tract into four (4) parcels of 4.00 , 4.077, 4.123 and 178.755acres each. The proposed amendment would add a 2 ft. wide private access easement from the southern boundary of Lot 3, through the Remainder Lot to an access through Lot 22 of the Westbank subdivision to Oak Lane. . Each end of the access easement will be gated, to prevent public access to the property. Primary access to the smaller lots will be via CR 163. V ei III. MAJOR ISSUES AND CONCERNS A. Subdivision Regulations: Section 8:52 of the Garfield County Subdivision Regulations states that "No more than a total of four (4) lots, parcels, interests or dwelling units will be created from any parcel, as that parcel was described in the records of the Garfield County Clerk and Recorder's Office on January 1, 1973, and is not a part of a recorded subdivision; however, any parcel to be divided by exemption that is split by a public right-of-way (State or Federal highway, County road or railroad) preventing joint use of the proposed tracts, and the division occurs along the public right-of-way, such parcels thereby created may, in the discretion of the Board, not be considered to have been created by exemption with regard to the four (4) lot, parcel, interest or dwelling unit limitation otherwise applicable; " The County Commissioners previously accepted a legal opinion from the applicant's attorney that the property in question has been in existence since prior to January 1, 1973 without any parcels being split from it. The applicant's qualified to request up to four (4) lots by exemption. B. Zoning: The subject property is located within the A/R/RD zone district, which allows a minimum lot size of two (2) acres. All proposed lots are in excess of the minimum, lot size requirement. C. Water: The applicant obtained a contract from the West Divide Water Conservancy District to allow them to obtain new individual well permits for each of the exempt lots. Once the exemption application was conditionally approved, the three permits were approved by the State Engineer's Office, as well permits no. 54873-F, 54874-F and 54875-F. Each of these wells was drilled and pump tested, prior to the -2- authorization of the exemption plat subject to the following criteria:. a) A well be drilled and a 4 hour pump test shall be performed; b) The applicant supply, to the Planning Department, the well completion report demonstrating the depth of the well, the characteristics of the aquifer and the static water level; c) The results of the 4 hour pump test indicating the pumping rate in gallons per minute and information showing drawdown and recharge shall be submitted to the Planning Department; d) A written opinion of the person conducting the well test that this well would be adequate to supply water to the number of proposed lots and be submitted to the Planning Department; e) An assumption of an average of no less than 3.5 people per dwelling unit, using 100 gallons of water per person, per day; f) The water quality be tested by an approved testing laboratory and meet State guidelines concerning bacteria and nitrates. D. Sewer/Soils: The applicant proposes use of individual sewage disposal systems as the method for waste water treatment. According to the Natural Resource Conservation Service, the soils on-site for the three smaller lots, when used for building site development and placement of ISD systems have slight constraints. The other soils have severe constraints due to slope and depth to bedrock. Staff would normally recommend the inclusion of a plat note to address the severe limitations, but since the soils for the new lots have slight constraints and the remainder lot has an existing house, no plat note appears to be necessary. E. Access: Access to all of the proposed new lots was originally to be via CR 163 As a condition of approval of the original exemption request, the applicants were required to make some road improvements to CR 163. This application is being made to amend the proposed access to all of the property included in the application, by the addition of a southern access point off of Oak Lane in the Westbank subdivision and the creation of an access easement 25 ft. wide from the southern boundary of exemption lot 3 to the proposed access point to Oak Lane. The proposed access easement needs to be legally described and shown on the proposed amended plat. As a part of this proposal, the northern and southern entrances to the property will be gated. A proposed "Access Easement Agreement" has been drawn up to define the use of the proposed access point onto Oak Lane, that includes between Marlin (Colorado) Ltd., Lynne S. Cantrell, Westbank Ranch Homeowners Association, Inc. and the Prehm Ranch Homeowners Association, Inc.. Each gate will require a special "click card" or "proximity card" to open the gate or a code number to be used on a key pad at the gate. The southern gate will also have a "relay counter:" installed to record -3- each opening and closing of the gate. Included in the agreement is a provision to allow the southern gate to have a maximum of 27 vehicles trips per day, averaged on a bi-monthly basis, to use the gate to access or leave the property. A vehicle trip is defined in the agreement as one vehicle entering or leaving the Prehm Ranch property. A plat note should be added to the existing plat notes that states that the southern gate will be limited to a maximum of 27 vehicle trips per day, averaged on a bi- monthly basis, and a violation of this limit could result in closure of the access due to a breach of an agreement between Marlin (Colorado) Ltd., Lynne S. Cantrell, Westbank Ranch Homeowners Association, Inc. and the Prehm Ranch Homeowners Association, Inc.. F. Fire Protection: Included with the last application was a letter from the Glenwood Springs Fire Department that noted the need for certain changes to the proposed fire protection plan and that the plan be included as a plat note on the exemption plat. The plat for the exemption includes three plat notes that address the fire protection issues associated with the lots created by the exemption. Additionally, a pond and fire hydrants were installed prior to the signing of an exemption plat. The largest pond is located on lots 1 and 2, and has a maximum depth of 11 feet. A smaller pond is located on Lot 2, which is three feet in depth and feeds into the larger pond. The large pond has a pipe outlet built into the low end of the pond, with hydrants on lots 2, 3 and the remainder lot. G. Easements: The Cristy ditch is located along a northern portion of the remainder lot that is adjacent to Four Mile Creek and the ditch feeds the previously noted ponds. The ditch easement is not noted on Lot 2 and 3. The easement is necessary to the maintenance of the water supply to the ponds, which provides the fire protection to the lots. A maintenance and repair easement needs to be shown for the entire length of the ditch on the plat. The fire hydrants are located on lots 2. 3 and the remainder lot and all connected to the large pond by a pipe system. A maintenance and repair easement from the fire hydrants and connecting pipe needs to be noted on the amended plat and a maintenance and repair easement should placed around the two ponds supplying fire protection water. H. Floodplain: The Roaring Fork River runs along the east side of the proposed new lots, but at an elevation at least 25-30 ft. below the main bench proposed for buildings. Since there was no restriction on the location of the buildings proposed in the application, it was deemed to be necessary to identify the floodplain on the exemption plat and include a plat note stating that any dredging, filling or construction in the floodplain will be subject to the approval a Floodplain permit by Garfield County. The plat note was included on the plat, but the 100 year floodplain line was not included on the plat. Any approval of the plat should include a requirement that -4- the 100 year floodplain be graphically shown on the plat. Covenants: Included in the original application were proposed covenants that include a number of restrictions and definitions. One issue that the covenants did not deal with was the County's restriction on the number of dogs per lot. The Subdivision Regulations limit each dwelling to one (1) dog. This was included as a plat note and the covenants recorded June 13, 2001, Book 1280, Page 360 and reception number 582502 of the Garfield County Clerk and Recorders records. Additional language dealing with the Right to Farm language was included in the covenants. . J. School Site Acquisition Fees: The applicant paid the required school site acquisition fees of $200, for each lot created by this exemption, prior to the signing of the exemption plat.. IV. SUGGESTED FINDINGS 1. That proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION Staff recommends APPROVAL of the application pursuant to the listed conditions: 1. That all representations of the applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval. 2. The proposed Exemption Plat shall be modified to show the following: a. A maintenance and repair easement from the fire hydrants and connecting pipe needs to be noted on the amended plat and a maintenance and repair easement should placed around the two ponds supplying fire protection water. b. A maintenance and repair easement needs to be shown for the entire length of -5- the Cristy ditch on the plat. c. The proposed access easement from the north entrance to the south entrance to the property will be legally described and shown on the proposed amended plat. d. The plat will include the 100 year floodplain graphically shown on the plat, with elevations noted. 3. That the applicant shall have 120 days to present a plat to the Commissioners for signature, from the date of approval of the exemption. The Board may grant extensions of up to one (1) year from the original date of approval, provided the applicant submits a request for an extension prior to the approval expiration date. 4. That the following plat note be included on the amended exemption plat: "The southern gate will be limited to a maximum of 27 vehicle trips per day, averaged on a bi-monthly basis, and a violation of this limit could result in closure of the access due to a breach of an agreement between Marlin (Colorado) Ltd., Lynne S. As you know, the information requested in that letter has already been submitted to Garfield County as part of the Subdivision Exemption Application filed by Peter Belau of Enartech, Inc. on behalf of the owners of Prehm Ranch on September 12, 2000. A copy of Mr. Belau's cover letter identifying the documents submitted is appended hereto. On November 27, 2000, the Subdivision Exemption Application was considered at a hearing before the Garfield County Board of County Commissioners and approved. The approval was subject to certain conditions, all of which were satisfied prior to the execution and recordation of the Subdivision Exemption Plat on June 13, 2001 as Reception No. 582501. On March 22, 2001, Mr. Belau submitted the documentation that was required as a part of the subdivision exemption approval. A copy of that letter is also appended hereto. All of the information previously submitted remains accurate. We respectfully request that Garfield County incorporate the entire Application for Subdivision Exemption as originally filed by Mr. Belau, and all supplemental filings, as part of the Application currently pending. You will also recall that in August of 2001, we processed an Amendment Application to reconfigure Exemption Lots 2 and 3. This Application was approved without the need to resubmit the entire initial Application. With respect to the matters identified in the March 1, 2002 letter, we did submit the required map showing the items required by Code § 8:41. Letter to Mr. Bean March 5, 2002 Page 2 The requirements of § 8:42 are fully addressed in our prior submittals and include documentation and information demonstrating the types of soils; the availability of domestic water through private, permitted and tested wells; adequacy of sewage disposal systems; compliance with fire protection plan; and related information. This information and the status of the property with respect thereto has not changed. You will recall that my client has installed the required improvements to County Road 163, including turn -outs and guardrails. This work was required by the Road and Bridge Department, was installed, inspected and accepted. The records regarding this work are in the County files. Three wells were drilled on the Exemption Lots. Copies of permits, water contracts and proof of supply were all submitted to the County. My client constructed the fire protection system required in the form of a large pond connected to dry hydrants. All utilities were installed to the lots, and all other required improvements were completed, inspected and improved in advance of the recordation of the Exemption Plat. These improvements remain in place and are operational. You will also recall that my client permitted, through the special review process, the bridge over Four Mile Creek. Because this is part of our access depicted on the pending Application, we request that, to the extent necessary, the Special Use Permit Application file retained by Garfield County be incorporated into our Application for Amendment to the Exemption Plat. Appended hereto is a current list of surrounding property owners. I have requested that Enartech deliver to Garfield County today a complete set of plans for road improvements installed between the Exemption Lots and Oak Lane. With respect to the new legal description for Prehm Ranch, I have requested our surveyors to prepare a description of the parcel to be conveyed to Westbank Ranch Homeowners Association. That description is also appended hereto. The Plat, however, does not presently depict the parcel to be conveyed to Westbank. We can Amend the Plat to include this parcel, if required by the County. Finally, a copy of the information regarding the security gates as prepared by Securus, Inc. is enclosed herewith. It is my hope that through incorporating the existing documentation, the County will be in a position to complete the processing of our application. Because of numerous time constraints related to these applications, we respectfully request that the public hearing before the Board of County Commissioners be set no later than April 8, 2002. Both the North and South Gates will have buried safety loops to ensure that gates do not close until the vehicle has cli>ared the entry area. A relay counter will be installed in the South Gate opeator, so that every gate cycle will be recorded. For homeowner's: Owner's arriving at the Ranch North or South Gates can use a click card, or a proximity card to open the gate. If you wish, you can issue them an override code that they can enter at the telephone entry keypad located at the gate. Owner's departing the North or South gates will find that the gate opens automatically as their vehicle passes over a buried loop.
