PROJECT INFORMATION AND STAFF COMMENTS
REQUEST: Exemption from the Definition of
Subdivision
APPLICANT: Ralpn Braden
LOCATION: A parcel of land situated in
Section 31, T7S, R87W;
approximately 3-1/2 miles east of
Carbondale, off County Road 100 and
Hwy 82.

I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The site is located in the Carbondale Urban Area of Influence, as
designated on the Comprehensive Plan Management Districts Map.
II. DESCRIPTION OF THE PROPOSAL
A. Site Description: Topography on the site is generally
level, with several ponds and drainage swales crossing the
parcel. Improvements on the site include a horse training
facility with riding arenas, paddocks, barns and residential
housing. The horse facility, with existing well and sewage
disposal, will be located on proposed Lot #1.
B. Project Description: The applicant proposes to divide the
57.9 acre tract into three parcels of approximately 23.5
acres, 32.3 acres, and 2.1 acres.
C. History: Since January 1, 1973, only one new lot has been
created out of this parcel. A Special Use Permit for an
agricultural -related business, for retail of equestrian
equipment, was approved on the site in January of 1988.
III. MAJOR ISSUES AND CONCERNS
1. The application has been referred to the Town of Carbondale,
with no comments received at this time.
2. The applicant has represented that domestic water for each
new lot will be provided by individual wells, obtained
through contracts with the Basalt Water Conservancy
District. Irrigation water rights are to be proportionally
divided between the three parcels.

3. The creation of the three proposed lots, in addition to the
one previous split, represents the maximum of 4 lots allowed
to be created out of the parcel, as it existed in 1973, in
accordance with Section 8.52 of the Subdivision Regulations.
4. The applicant has submitted a Geology and Soils Study for
the site and adjoining lands, completed by Lincoln DeVore.
The study notes the presence of cobble and boulder sized
particles iri the soil, and indicates that the presence of
high water tables "will require special consideration in the
design and construction of foundations."
IV. SUGGESTED FINDINGS
1. That proper posting and public notice was provided as
required for the meeting before the Board of County
Commissioners.
2. That the meeting before the Board of County Commissioners
was extensive and complete, that all pertinent facts,
matters and issues were submitted and that all interested
parties were heard at that meeting.
3. That for the above stated and other reasons, the proposed
exemption is in the best interest of the health, safety,
morals, convenience, order, prosperity and welfare of the
citizens of Garfield County.
V. RECOMMENDATION
APPROVAL, with the following conditions:
1. That the following plat notes be included on the recorded
Exemption Plat:
a) No further divisions by exemption from the definition
of subdivision will be allowed.
b) Each lot may be subject to engineered foundations and
septic systems.
2. That all access easements on the site be included on the
plat.
3. That the applicant submit approved contracts with the Basalt
Water Conservancy District and copies of well permits
providing for individual wells on each of the proposed
tracts. In addition, irrigation water rights associated
with the site shall be proportionately divided between the
tracts.
4. That the applicant submit a letter from the appropriate fire
district, indicating that they serve the site.
5. That the applicant submit $400 in School Impact Fees for the
creation of two new lots.
6. That all representations of the applicant, either within the
application or stated at the meeting before the Board of
County Commissioners, shall be considered conditions of
approval.
