Ji R000pt:ion No . __ Jj'' c�d 7+:1wdroct Aa.sdorf, Rgoorder BEFORE THE BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO RESOLUTION NO. 79-71 WHEREAS, Bob and Dorothy Pretti have petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of an 80.00 acre tract described as follows: EZSEQ of Section 3, T.6S., R.93W of the 6th P.M. into 2 tracts of approxi- mately 75.0 and 4.9 acres each, more or less, which proposed divided tracts are more particularly described as follows: Tract A: A tract of land in the S.E.4, Section 3, T.6S., R.93W., of the 6th Principal Meridian, more particularly described as follows: Beginning at a Point from which the S.E. corner of said Section 3 bears S.30°42'35"E. a distance of 1644.10 feet; thence N.87°29'19"E., a distance of 132.00 feet; thence S.02°30141"E., a distance of 266.39 feet; thence S.44°35'23"W., a distance of 495.43 feet; thence S.87°29'19" W., a distance of 264.12 feet; thence N.02°30'41" W., a distance of 285.00 feet; thence N.87°29'19"E., a distance of 152.15 feet; thence N.44°35123"E., a distance of 468.10 feet more or less to the Point of Beginning. Containing 4.917 acres more or less in the State of Colorado and County of Garfield; and, WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the proposed division does not fall within the purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that the impact created is not large enough to proceed through full subdivision review; and, WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the b(QK Pf,ESS:3 requested division is not part of an existing or larger development and does not fall within the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended; N0W, THEREFORE, upon the motion of Larry Velasquez , seconded by R.C. Jolley , and carried, the division of the above described tract "A" from the above described 80.0 acre tract is hereby exempted from such definitions and said tract may be divided into tract "A", all as is more fully described above, and said divided tract may be conveyed in the form of such smaller tracts without further compliance with the aforesaid subdivision statutes and regulations; provided, however, that this exemption is granted on the condi- tion and with the express understanding and agreement of the Petitioners that no further exemptions be allowed on said tract "A", and that a copy of the instrument or instruments of conveyance when recorded shall be filed with this Resolution.
